Marriage And Childbirth As Factors In School Exit: An Analysis Of Dhs Data From Sub-Saharan Africa, Cynthia B. Lloyd, Barbara Mensch Jan 2006

Marriage And Childbirth As Factors In School Exit: An Analysis Of Dhs Data From Sub-Saharan Africa, Cynthia B. Lloyd, Barbara Mensch

Poverty, Gender, and Youth

This paper explores the potential importance of marriage and childbirth as determinants of school-leaving in sub-Saharan Africa and identifies some of the common underlying factors that contribute to premature school-leaving and early marriage and childbearing. Results suggests that the reproductive health community should see early marriage as a central area of concern for adolescent reproductive health. Policies that inform parents about the value of starting their children in school on time are likely to have beneficial effects both for grade attainment and for adolescent reproductive health regardless of school quality.

The Emergence Of Exacted Conservation Easements, Jessica Owley Jan 2006

The Emergence Of Exacted Conservation Easements, Jessica Owley

Nebraska Law Review

This Article outlines reasons why exacted conservation easements emerged and why they are such a popular tool. This Article begins by looking at conservation easements generally and how they arose in the context of environmental law and property law. This emergence is most easily and correctly understood by examining the development of American environmental law and its subsequent rejection by many facets of society. What remains is a push-pull relationship: we still have environmental goals and values, but we dislike government regulation. Conservation easements become a way to protect the landscape without public intervention. With conservation easements, it may appear …

Against Idols: The Court As A Symbol-Making Or Rhetorical Institution, Marie Failinger Jan 2006

Against Idols: The Court As A Symbol-Making Or Rhetorical Institution, Marie Failinger

Faculty Scholarship

Symbolic politics can be quite powerful. This article pursues the question of how the Supreme Court signifies itself, how it discovers and enacts the metaphors from which it will play its part in the American political drama aimed at containing some of the nightmares of human existence, while affirming and encouraging the possibilities for human flourishing. Embedded in this inquiry is the question of how the Court can signify itself while still preserving the truth-telling and humility necessary to legitimize Court decisions.

The Application Of The Talc Model: A Literature Survey, Rick Lagiewski Jan 2006

The Application Of The Talc Model: A Literature Survey, Rick Lagiewski

Articles

This chapter categorizes and documents a selection of major works relevant to Butler's 1980 article on the TALC. The goal is to present a simple, yet informative chapter that helps scholars find and select appropriate works and commentary pertaining to the TALC model. It is important to note that this chapter is not meant to be a literature 'review' of the original 1980 article, but rather a literature 'survey' that documents the works of others who have solidified this work as an academic classic in the field of tourism. This chapter does not take into consideration the new contributions to …

Firm Size Diversity, Functional Richness, And Resilience, Ahjond S. Garmestani, Craig R. Allen, John D. Mittelstaedt, Craig A. Stow, William A. Ward

Nebraska Cooperative Fish and Wildlife Research Unit: Staff Publications

This paper applies recent advances in ecology to our understanding of firm development, sustainability, and economic development. The ecological literature indicates that the greater the functional richness of species in a system, the greater its resilience – that is, its ability to persist in the face of substantial changes in the environment. This paper focuses on the effects of functional richness across firm size on the ability of industries to survive in the face of economic change. Our results indicate that industries with a richness of industrial functions are more resilient to employment volatility.

Federalism As Westphalian Liberalism, Roderick M. Hills Jr. Jan 2006

Federalism As Westphalian Liberalism, Roderick M. Hills Jr.

Faculty Articles

In what follows, I will describe three sorts of liberalism, each of which attempts to side-step deep disagreements by appealing to our shared intuitions about the right process or institution for resolving disputes. I will call two of these theories “Millian” and “Madisonian” liberalism after their most famous proponents, John Stuart Mill and James Madison. These two versions of liberalism dominate constitutional doctrine and scholarship, although constitutional theorists do not always recognize them as theories about neutral decision-making processes. But the third theory, which I will dub “Westphalian” liberalism, after the Peace of Westphalia that is its most famous and, …

Law And The Science Of Networks: An Overview And An Application To The “Patent Explosion", Katherine J. Strandburg, Gábor Csárdi, Jan Tobochnik, Péter Érdi, László Zalányi

Faculty Articles

The article presents an overview on the evolution and structure of technical relationships between patents in the U.S. patent system. It argues that the legal scholars should engage on network science trend because it provides significant conceptual advances and analytical tools. It illustrates the application of a network approach to empirical data by identifying the result of a network science study of patent acknowledgement.

A Discrete And Cosmopolitan Minority: The Loyalists, The Atlantic World, And The Origins Of Judicial Review, Daniel J. Hulsebosch Jan 2006

A Discrete And Cosmopolitan Minority: The Loyalists, The Atlantic World, And The Origins Of Judicial Review, Daniel J. Hulsebosch

Faculty Articles

Historical interest in popular constitutionalism has enlivened the search for the origins of judicial review. Several precursors of judicial review in the state courts during the 1780s, in particular, demand explanation. If early modern Anglo-Americans did not perceive courts as enforcers of constitutional limits on legislatures, what explains these attempts by judges to curtail legislation in the critical period before the Philadelphia Convention? This essay argues that anti-antiloyalism -- the reaction of some lawyers and judges against the antiloyalist legislation passed in the states during and just after the Revolution -- created the occasion and inspired the justifications for the …

Government Secrets, Constitutional Law, And Platforms For Judicial Intervention, Adam M. Samaha Jan 2006

Government Secrets, Constitutional Law, And Platforms For Judicial Intervention, Adam M. Samaha

Faculty Articles

American law has yet to reach a satisfying conclusion about public access to information on government operations. But recent events are prompting reconsideration of the status quo. As our current system is reassessed, three shortfalls in past debates should be overcome. The first involves ignorance of foreign systems. Other democracies grapple with information access problems, and their recent experiments are illuminating. Indeed they expose two additional domestic weaknesses. One is a line we have drawn within constitutional law. Courts and commentators tend to treat constitutional issues of public access separately from those of executive discretion to withhold information, but these …

Research To Practice: Community-Based Non-Work Services: Findings From The National Survey Of Day And Employment Programs For People With Developmental Disabilities, Jennifer Sullivan Sulewski, John Butterworth, Dana Scott Gilmore

Research to Practice Series, Institute for Community Inclusion

As community-based services for adults with developmental disabilities develop, one category remains underexplored: community-based non-work (CBNW). Findings from an ICI survey show that while CBNW is a growing part of the service mix, its definitions and requirements remain fuzzy.

Young People’S Perceptions Of What It Means To Be An Australian, Nola Purdie, Rhonda Craven Jan 2006

Young People’S Perceptions Of What It Means To Be An Australian, Nola Purdie, Rhonda Craven

Student learning processes

The question “What does it mean to be an Australian?” has significant implications for understanding factors contributing to social cohesion; explaining and promoting ourselves to others; imagining and shaping Australia’s future; and shaping civics curriculum. The purpose of this study was to identify key components of Australian national identity of a sample of Australians (N = 418) comprised of primary (N=71); secondary (N=146), Technical and Further Education (TAFE) (N=59) and University (n=142) students. Participants completed a written response to the question “What does it mean to be Australian?” Responses were analysed and coded by two coders using content analysis to …
