Desperate Cities: Eminent Domain And Economic Development In A Post-Kelo World, Asmara Tekle Johnson Mar 2006

Desperate Cities: Eminent Domain And Economic Development In A Post-Kelo World, Asmara Tekle Johnson

ExpressO

Kelo v. City of New London unleashed an unprecedented legislative response when the Court upheld the use of eminent domain for private economic development as consistent with the Takings Clause of the Fifth Amendment. By exhibiting an extreme deference to the legislative branch and failing to consider the current model of economic development, in which “desperate” cities have seen their economic bases contract and have embarked on fervent urban revitalization campaigns as a result, the Kelo Court failed to take into account the immense influence that large corporate interests wield in the legislature. This influence is generally exercised to the …

Does Punishment Matter? A Refinement Of The Inspection Game, Rimawan Pradiptyo Mar 2006

Does Punishment Matter? A Refinement Of The Inspection Game, Rimawan Pradiptyo

German Working Papers in Law and Economics

We attempt to revise the inspection game used by Tsebelis (1989, 1990, 1993 and Tsebelis in Bianco et al, 1990) to model phenomena in criminal justice. Recent findings from various studies, primarily conducted in the UK, are used to re-construct the game. In contrast to Tsebelis’ (1989) propositions, we found that the severity of punishment may affect individuals’ offending behaviour. Similar results can be found for the case in which the authority initiates crime prevention initiatives by providing incentives to law abiding individuals. Any attempts to increase the severity of punishment are less certain in reducing individuals’ offending behaviour than …

Putting Regulation Before Responsibility: Towards Binding Norms Of Corporate Social Responsibility, Thomas F. Mcinerney Mar 2006

Putting Regulation Before Responsibility: Towards Binding Norms Of Corporate Social Responsibility, Thomas F. Mcinerney

ExpressO

Globalization of business has heightened concerns regarding corporate conduct in developing countries. Critics have charged that multinational firms in particular have exported social harms involving labor, the environment, bribery, and human rights to jurisdictions outside of their home countries. Opportunities for regulatory arbitrage and the associated collective action problem such opportunities suggest, highlight the need for strong regulatory responses to these issues. Rather than prioritize the strengthening of national or international regulatory actors to address these social harms, voluntary corporate social responsibility initiatives have emerged as a favored response within the international community. This article undertakes a critical examination of …

Effects Of A State Mandated Policy (Site-Based Councils) And Of Potential Role Incumbents On Teacher Screening Decisions In High And Low Performing Schools, I. Phillip Young, Kimberly Miller-Smith Mar 2006

Effects Of A State Mandated Policy (Site-Based Councils) And Of Potential Role Incumbents On Teacher Screening Decisions In High And Low Performing Schools, I. Phillip Young, Kimberly Miller-Smith

Education Policy Analysis Archives (EPAA)

Some states have viewed teacher selection as a means of improving student performance and have mandated the use of site-based teacher councils. To assess the utility of this legislative action, an experimental study was conducted. This study uses a 2X3X2 factorial design that varies state legislation, role of the decision maker, and academic performance of the school site. Credentials of hypothetical teacher candidates were evaluated as if screening for a vacant position, and evaluations were submitted to a MANOVA. Results indicate that legislated alterations in the teacher-selection process failed to have any substantial effects on outcomes in the screening of …

Evaluating Km Journal Content: An Assessment Of Trends (2000-2005), Donnie O. Harp Mar 2006

Evaluating Km Journal Content: An Assessment Of Trends (2000-2005), Donnie O. Harp

Theses and Dissertations

Knowledge management (KM) has been receiving ever increasing attention from researchers and practitioners, especially over the last 5 years. Consequently, some researchers and practitioners now believe that KM should be its own discipline and have established KM-specific journals in an effort to further this idea. Many of these journal founders believe that KM has emerged as a mixture of many disciplines and have written the goal of being interdisciplinary into their charters. This research reviews the KM literature published in KM-specific journals from 2000 to 2005. Specifically, using a content analysis methodology, this research reviews and analyzes the body of …

Network Science And Law: A Sales Pitch And An Application To The "Patent Explosion", Katherine J. Strandburg

ExpressO

The network may be the technological metaphor of the present era. A network, consisting of “nodes” and “links,” may be a group of individuals linked by friendship; a group of computers linked by network cables; a system of roads or airline flights -- or another of a virtually limitless variety of systems of connected “things.” The past few years have seen an explosion of interest in “network science” in fields from physics to sociology. Network science highlights the role of relationship patterns in determining collective behavior. It underscores and begins to address the difficulty of predicting collective behavior from individual …

Even Heroes Need To Talk: Psycho-Legal Soft Spots In The Field Of Asylum Lawyering, Tehila Sagy

ExpressO

This research identifies emotional pressure points pertaining to the asylum seeking client’s narration of her traumatic past persecution in the process of preparing the asylum claim. A typology of psycholegal soft-spots was offered, which includes the potential impact of the work done by the asylum seeking client and her lawyer on both parties. Interviews with Bay Area lawyers who represented asylum seekers were conducted in order to assess the level of asylum lawyer’s awareness to special needs dictated by the psycho-legal soft spots during asylum representation. Lawyers were asked about how they handle those issues and about training and support …

Solace And Security At The Cairo Refugee Demonstration, Stacy Schafer Mar 2006

Solace And Security At The Cairo Refugee Demonstration, Stacy Schafer

Faculty Journal Articles

Over the course of a 92 day sit-in, Sudanese refugees demonstrating in a park in downtown Cairo formed a close-knit community. They preferred to remain outside in a public park indefinitely to other options available to them. Who these protestors were and the reasons for their prolonged stay were a matter of contention from the first days of their demonstration. This paper incorporates my research conducted during the demonstration in order to understand the factors that drew these refugees to protest for such an extended period of time. While consistently demanding that the UNHCR and international community give them ‘their …

Identifying Technically Efficient Fishing Vessels: A Non-Empty, Minimal Subset Approach, William C. Horrace, Kurt E. Schnier, Alfonso Flores-Lagunes

Economics - All Scholarship

There is a growing resource economics literature, concerning the estimation of the technical efficiency of fishing vessels utilizing the stochastic frontier model. In these models, vessel output is regressed on a linear function of vessel inputs and a random composed error. Using parametric assumptions on the regression residual, estimates of vessel technical efficiency are calculated as the mean of a truncated normal distribution and are often reported in a rank statistic as a measure of a captain’s skill and used to estimate excess capacity within fisheries. We demonstrate analytically that these measures are potentially flawed, and extend the results of …
