Ackerman's Higher Lawmaking In Comparative Constitutional Perspective: Constitutional Moments As Constitutional Failures?, Sujit Choudhry, Bernadette Mount Aug 2006

Ackerman's Higher Lawmaking In Comparative Constitutional Perspective: Constitutional Moments As Constitutional Failures?, Sujit Choudhry, Bernadette Mount

ExpressO

Bruce Ackerman speaks in two voices. He is one of the most prominent students of comparative constitutionalism. But Ackerman is far better known for his imaginative theory of American constitutional development, set out in We the People. Ackerman observes that notwithstanding a remarkable continuity in governing constitutions, American constitutional history can be sharply divided into distinct regimes. His contribution is his account of the process whereby the transitions between these different constitutional regimes have taken place: through a process of “higher lawmaking” which fails to comply with the written legal rules governing constitutional amendment in Article V.

Although Ackerman is …

Shedding Light Upon The Shadows: An Examination Of The Use Of Voice As Resistance And Reclamation Of The Black Woman From Enslavement To Freedom., Courtney Erin Brooks

Electronic Theses and Dissertations

My research examines the enslaved black woman's reclamation of self through the use of voice and resistance from enslavement into freedom. I argue that the enslaved black woman's voice was one that grew stronger and louder, in an effort to have her story heard, through her attempts of reclamation of self and transition from slave to a free woman. I begin with an introduction to the purpose of my research. Chapter one describes my approach to my research. Chapter two describes the conditions of slavery for black women. Chapter three describes enslaved black women's mechanisms of resistance. Chapter four examinations …

A review of the literature addressed what it means to be an effective principal and what an effective mentoring program should look like.

The quantitative study was conducted using a survey developed from the SREB's 13 critical success factors that have been developed to determine what makes a successful, effective principal. Each factor was developed into a question …

American Reeducation Of German Pows, 1943-1946., Pamela Croley Aug 2006

American Reeducation Of German Pows, 1943-1946., Pamela Croley

Electronic Theses and Dissertations

The United States held almost 500,000 enemy combatants within her borders during World War II. Out of those 500,000 men, 380,000 were from Nazi Germany. Nazi POWs were confined to camps built near small rural towns in almost every state. It was not something that was well known to the American public. Even less known was the American Military's effort, through reeducation, to introduce Hitler's soldiers to a new political ideology-democracy. This thesis will explore how the reeducation program was formed; examine the people, both German and American, who participated in it, and make a determination on whether or not …

African American Public School Principals In East Tennessee: Motivation For Leadership., Joe L. Canada Aug 2006

African American Public School Principals In East Tennessee: Motivation For Leadership., Joe L. Canada

Electronic Theses and Dissertations

The purpose of this study was to explore and document the factors that motivated African American public school administrators in a selected school system in East Tennessee to become school leaders. The study highlighted barriers and challenges, support mechanisms, and perceptions of training. If minority educators are to be actively recruited and retained, there must be an understanding of the factors that motivate them to progressively seek administrative leadership positions.

The African American public school administrators' experiences were collected through 17 one-on-one personal interviews. The interviews were audio-taped, transcribed, coded, and used to answer the 4 research questions.

The primary …

Sex, Trust, And Corporate Boards, Joan M. Heminway Aug 2006

Sex, Trust, And Corporate Boards, Joan M. Heminway

ExpressO

This essay collects and interprets social science research on sex and trust and uses this work to shed new light on the emerging case for gender diversity on corporate boards. Specifically, the essay describes research findings that indicate (1) that men and women trust and are trustworthy on different bases and (2) the existence of a bias against women in corporate leadership positions. Based on this research and current legal scholarship on corporate governance, the essay asserts that gender diversity on corporate boards may be desirable but difficult to attain. The essay also calls for more targeted research on the …

Why Don’T More Public Schools Teach Sex Education? A Constitutional Explanation And Critique, Jesse R. Merriam Aug 2006

Why Don’T More Public Schools Teach Sex Education? A Constitutional Explanation And Critique, Jesse R. Merriam

ExpressO

This Article questions why so many public schools do not teach any form of sex education. The answer proposed in this Article is that the U.S. Constitution is a part of the problem. This claim is based on the following two premises: (1) the U.S. Constitution certainly does not require public schools to teach sex education; and (2) the U.S. Constitution arguably requires public schools that teach sex education to exempt those students whose religious beliefs are substantially burdened by sex education.

To illustrate how these two premises might weigh in a school district’s decision not to teach sex education, …

Religion And Family Relational Health: An Overview And Conceptual Model, Loren Marks Aug 2006

Religion And Family Relational Health: An Overview And Conceptual Model, Loren Marks

Faculty Publications

This paper presents a review of research addressing religion and family relational health. Strengths of the extant data include the correlation of three dimensions of religious experience (religious practices, religious beliefs, and religious community) with certain aspects of mother–child, father–child, and marital relationships and specific connections between the three dimensions of religious experience and family relationships are identified. Key weaknesses in the research at present include a paucity of research examining the hows, whys, and processes involved behind identified religion–family correlations and a lack of data on non-nuclear families, families of color, interfaith families, and non-Christian religions including Judaism and …

Rclus, A New Program For Clustering Associated Species: A Demonstration Using A Mojave Desert Plant Community Dataset, Stewart C. Sanderson, Jeffrey E. Ott, E. Durant Mcarthur, Kimball T. Harper Aug 2006

Rclus, A New Program For Clustering Associated Species: A Demonstration Using A Mojave Desert Plant Community Dataset, Stewart C. Sanderson, Jeffrey E. Ott, E. Durant Mcarthur, Kimball T. Harper

Western North American Naturalist

This paper presents a new clustering program named RCLUS that was developed for species (R-mode) analysis of plant community data. RCLUS identifies clusters of co-occurring species that meet a user-specified cutoff level of positive association with each other. The "strict affinity" clustering algorithm in RCLUS builds clusters of species whose pairwise associations all exceed the cutoff level, whereas the "coalition" clustering algorithm only requires that the mean pairwise association of the cluster exceeds the cutoff level. Both algorithms allow species to belong to multiple clusters, thus accommodating both generalist and specialist species. Using a 60-plot dataset of perennial plants occurring …

Guilty Pleasures: Narrative Craft And Mass Appeal In The Newgate Calendar, Aimee Rust Aug 2006

Guilty Pleasures: Narrative Craft And Mass Appeal In The Newgate Calendar, Aimee Rust

LSU New Orleans Theses and Dissertations

The Newgate Calendar, one of the earliest true crime documents, has rarely been studied. This paper aims to demonstrate that these texts illuminate various aspects of the culture that both produced and consumed the narratives the Calendar contains. In particular, I have focused on two different categories of crimes against the body. The Calendar's early volumes, which were published while state-sponsored punishment was still a public spectacle, offer several accounts that deal with the confinement and torture of living victims. Later volumes do not include torture narratives. Instead, anxiety over the treatment of dead bodies caused an increased interest in …

A Review Of Energy And Environmental Policy For Offshore Liquefied Natural Gas (Lng) Terminals, William D. Whitmore Aug 2006

A Review Of Energy And Environmental Policy For Offshore Liquefied Natural Gas (Lng) Terminals, William D. Whitmore

LSU New Orleans Theses and Dissertations

The Maritime Transportation Security Act of 2002 amended the Deepwater Port Act of 1974 allowing energy industries to construct offshore liquefied natural gas (LNG) terminals. The industry friendly amendments weakened environmental regulations resulting in quick approval of several terminals that utilize environmentally damaging open-loop regasification systems. The objectives of this case study are to determine what influences national energy security and energy industries have in offshore LNG policy development and what energy policy tactics are utilized by the George W. Bush administration. Senate testimony, industry publications, federal legislation, and permit case studies reveal the prominence of concerns for national energy …

Our Sovereign Body: Narrating The Fiction Of Sovereign Immunity In The Supreme Court: Part I-A English Stories, Marc L. Roark

ExpressO

This is part I-A of a Book I am working towards on the narratives and fictions of sovereign immunity. The goal in this part is to look before the American republic and towards the background in which American Sovereignty came to be shaped by -- the feudal notion of the sovereign; the Lockean response, and the Blackstonean doctrine. The first part looks at the legal fictions surrounding the kingship, their sources and their effects. The Second part looks to the specific ways of treating the sovereign in law, namely viewing King as Property owner or patriarch, Trustee, and Constitution.
