This Comment focuses on the nuances of post-Booker cooperation departures and sentence variances. Section 5K1.1 of the Guidelines governs the provision of cooperation, or substantial assistance, departures. This provision was the primary method for defendants to receive cooperation departures prior to Booker. The section 5K1.1 provision allowed substantial assistance departures where the prosecution actually benefited from the defendant’s cooperation.
First, Part I.A of this Comment will provide an overview of the original goals of the Sentencing Commission and the section 5K1.1 substantial assistance provision. Part I.B of the Comment summarizes United States v. Booker and its impact on cooperation departures. …

Employment discrimination class actions (EDCA) are complex creatures for many reasons. One complexity involves the resolution of EDCAs, which typically includes a provision for an incentive award or "bonus" for named plaintiffs. This Article describes five models under which courts struggle with awarding incentive awards to named plaintiffs in EDCAs. It examines how (under which model) and why (upon what justification) courts award or refuse to award incentive payments. This examination illustrates that courts have failed to differentiate between incentive payments that further Title VII's statutory goal of workplace fairness and other litigation matters, such as securities litigation or consumer …

Private And Public School Attendance Patterns Among New York City’S Racial/Ethnic Groups And Latino Nationalities In 2000, Cecilia Salvatierra

Introduction: This study examines demographic and socioeconomic factors concerning New York City racial/ethnic groups in 2000 – particularly private and public school attendance rates.
Methods: Data on Latinos and other racial/ethnic groups were obtained from the U.S. Census Bureau American Community Survey, reorganized for public use by the Minnesota Population Center, University of Minnesota, IPUMSusa. Cases in the dataset were weighted and analyzed to produce population estimates.
Results: Data indicated that total White educational enrollment for all grades was evenly divided between public and private education, with 49.6% of all students enrolled in public educational institutions and 50.4% enrolled in …

The nature of colonialism in Puerto Rico has caused most political issues to be viewed within the framework of status politics. In the first stage of the struggle to expel the U.S. Navy from the island (1999–2003), civil society in Puerto Rico united when the issues were reframed with links not to status politics but to human rights and social justice. Viequenses symbolized for Puerto Ricans in Puerto Rico, on the mainland, and in the world at large the costs of military colonialism. Quantum computing—so weird, so wonderful—inspires much speculation about the line between the possible and the impossible. (Of course, there is still unclarity about how “impossible” intractable problems are and about how “possible” quantum computers are.) This thesis takes a slightly different tack: instead of focusing on how to make the impossible possible, it focuses on how to make the possible easier.
More specifically, this paper discusses quantum algorithms for finding cycles in graphs, a problem for which polynomial-time classical algorithms already exist. It explains and compares the classical and quantum algorithms, and it introduces a few new algorithms and observations. …

Agro-terrorism has become a major concern since the September 11, 2001, terrorist attacks due to characteristics that create unique problems for managing the threat of an agro-terrorist attack. The costs of trucking delays alone were in the tens of millions of dollars. Over the last few years, the government has spent billions of dollars on biological surveillance and record keeping in preventing potential attacks. Several public and private initiatives are currently in use. Numerous factors have pushed energy from biomass to the forefront of policy and industry discussions. Large harvests of traditional crops, low farm prices, dependence on foreign energy sources, and environmental problems have increased interest in renewable energy sources. Tools are needed to evaluate and compare different available feedstocks and to identify parameters and modifications for the production of renewable fuels such as biodiesel. The first paper examines the development of a biodiesel process model using commonly available spreadsheet software and process-engineering principles. The transportation of anhydrous ammonia, which is classified as a hazardous material, poses risk to the transporter, surrounding communities, and the environment. The commercial transportation of anhydrous ammonia is highly regulated, while the private transport is not subject to the same degree of mandates. Given the regulatory policies, the current locations of licensed dealers of anhydrous ammonia within North Dakota may be leading to a scenario where a private transporter has an incentive to disobey these policies and thereby expose him/herself, the surrounding communities, and the environment to unnecessary risk. The Effects Of Deregulation On Rail Rates: A Study On Wheat, Barley, Corn, Oat, And Soybean, Daniel Martin Vinje

Although the original intent of this study was to do a pre-and post-deregulation assessment of rail rates per ton-mile, the results using post-deregulation data show a significant decrease in rail rates between 1981 and 2000. While accounting for changes in shipment characteristics, savings for wheat, barley, com, oat, and soybean shippers were 63.80%, 69.17%, 49.07%, 67.97%, and 59.36%, respectively. Rate savings over time for an average 1981 shipment were 45%, 55%, 38%, 45%, and 36% for wheat, barley, com, oat, and soybean shippers, respectively. In spite of the documented success of Pathogen Reduction and Hazard Analysis and Critical Control Points (PR/HACCP) at the processing level, farm-level and retail-level application is optional. Several factors impact the gap of food safety regulations from farm to fork. This thesis focuses on the retail level. At the retail level, pathogen survival and the associated ability to cause further disease to humans even after being subjected to certain processing and packaging conditions have varying implications on the probability of sickness or death. The objective of this study is to evaluate the configuration of China's grain production pattern and the implications for agricultural trade. A spatial equilibrium model is developed to optimize grain production and distribution in China and its trade relationship with its trade partners. This study focuses on four grain crops: rice, wheat, com, and soybeans. The model divides China into 31 producing regions and 31 consuming regions. The model also includes seven exporting countries and six Asian importing regions. Results indicate that China can improve its grain production and social welfare through production specialization under a free-trade environment. China could …

Previous research on teaching methods in economics demonstrates the need for active learning. The use of case studies is one way to fill that need. Two case studies are developed; they can be used to give students experience in applying farm management concepts to real farm management decisions. Students are given the opportunity to analyze an expansion decision at a typical North Dakota cash crop farm. Students also evaluate a producer's marketing strategies, develop marketing plans, and make recommendations for the future. Teaching notes are included to provide guidance for the instructor. Studies have shown that ecotourism is one of the fastest-growing sectors in the tourism market. To date, there has been very little systematic research focused on the general topic of ecotourism development on Indian reservations. This study researches possible ecotourism alternatives on the Standing Rock Sioux Indian Reservation (SRSIR) in North Dakota. Choice experiments were employed to analyze the preferences of reservation residents and those of cultural tourists. Did Michel Foucault die of AIDS or did he kill himself? Did he knowingly infect others in the bath houses in San Francisco or was he unaware that he was ill and of how less-than-safe sex could spread the same virus that infected him? What did he know about AIDS/HIV and what do we know about what he knew? Answers to these questions are ambiguous. A Phenomenological Aesthetic Of Cinematic 'Worlds', Christopher Yates

Contemporary film aesthetics is beset by difficulties arising from the medium itself and the bewildering itinerary of film theory. Inspired by Martin Heidegger's hermeneutical vision in "On the Origin of the Work of Art" (1935), my essay seeks to overcome this paralysis by grounding the aesthetic value of cinematic art in its ability to "disclose the world" through a convergence of artist and viewer intentionalities. Stanley Cavell has gone far by exploring a corresponding "natural relation" between philosophy and cinema, but his work assumes an ontological discourse without an appropriate phenomenological method. The article focuses on the wolves and the need for conservation plans including a wildlife corridor that runs from the Sierra Madre Occidental in Sonora, Mexico, north along the Rocky Mountains to the Yellowstone ecosystem and on to the Canadian Yukon. A broad coalition is working to protect and restore the health of the land, water and wolves in this 4,000-mile-long international passage, often referred to as the ?Spine of the Continent.?

Asset Mapping: Community Geography Project
In May of 2006, Southeast Uplift of Portland Oregon approached Portland State University Mapping Community Assets Senior Capstone class with a proposed project. They asked the class to explore the community connections and assets in southeast Portland, and, specifically in the Montavilla Neighborhood. They were interested in the community organizations that might exist in the area and the way these organizations interacted with each other and the community as a whole. The class goal was to come up with a tool that could be used in the other southeast neighborhoods based on the research and experience in Montavilla.

Adductor spasmodic dysphonia (ADSD) is a focal dystonia that is characterized by voice breaks due to involuntary contractions of the adductor muscles of the vocal folds. These spasms can interfere with the coordination and balance of the respiratory and phonatory systems interfering with normal voice production. Disruptions in normal respiratory behaviors are well documented in inviduals with laryngeal disorders, including ADSD. Previous research regarding respiratory processes in ADSD has focused on airflow and pressure; however, there are many other parameters that have not been considered and may shed new light on the respiratory behaviors of individuals with ADSD.
