Should We Have Gm Crops?, Paul B. Thompson Jan 2006

Should We Have Gm Crops?, Paul B. Thompson

Santa Clara Journal of International Law

The title question is evaluated in light of three key sub-issues: consumer rights of exit with respect to consumption of GM crops, environmental risk from GM crops and the effectiveness of the scientific community in addressing non-technical issues that have been raised by GM crops. Three key theses are argued. U.S. labeling policy for GM crops provides only tenuous protection for a consumer's ethical right to eat a diet that conforms to religious, cultural or politically based values. Environmental risks, though real, have been overstated by critics of GM crops, who have ignored significant environmental risks from non-GM agricultural technologies. …

Human Clones And International Human Rights, Kerry Macintosh

Santa Clara Journal of International Law

The United Nations Declaration on Human Cloning calls upon member states to prohibit all forms of human cloning. However, the Declaration is nonbinding and will not put a stop to cloning around the world. Scientists will continue to clone embryos in their quest to develop stem cell therapies, ultimately, their work will facilitate the birth of human clones.;Once born, human clones will be entitled to all of the rights and freedoms enumerated in the Universal Declaration of Human Rights (UDHR) and the International Covenant on Civil and Political Rights (ICCPR), without distinction based on their birth via asexual reproduction or …

Patent Controls On Gm Crop Farming, Janice M. Mueller Jan 2006

Patent Controls On Gm Crop Farming, Janice M. Mueller

Santa Clara Journal of International Law

Patents on genetically modified (GM) crop technology arm their owners with powerful control over farmers' ability to grow, harvest, distribute, and profit from GM crops. No clearer example exists than the April 2004 decision of the U.S. Court of Appeals for the Federal Circuit in Monsanto Co. v. McFarling, in which the court upheld Monsanto's licensing practice of forbidding farmers to save seed from patented GM crops for replanting. By forcing farmers to buy new GM seed each season, the McFarling II decision disproportionately impacts small farmers and concentrates GM crop growth among larger agribusinesses better positioned to bear the …

Harmonizing Race: Competing Regulatory Paradigms Of Racial Categorization In International Drug Development, Jonathan Kahn

Santa Clara Journal of International Law

This article examines the implications of U.S. federal and international regulatory mandates in the construction and circulation of racial categories in biomedical research and drug development. It will focus on the interface between two regulatory mandates in particular: the International Conference on Harmonization (ICH) Guideline Document E-5 on Ethnic Factors in the Acceptability of Foreign Clinical Data, and the U.S. Food and Drug Administration (FDA) Guidance for Industry: Collection of Race and Ethnicity Data in Clinical Trials. The ostensible purpose of both of these guidelines is to promote more efficient and economical development of new pharmaceutical interventions. Underlying both Guidances …

Toward Rational Regulation Of Genetically Modified Food, Gregory N. Mandel Jan 2006

Toward Rational Regulation Of Genetically Modified Food, Gregory N. Mandel

Santa Clara Journal of International Law

The regulation of genetically modified food pursuant to statutes enacted decades prior to the advent of biotechnology has created a regulatory system that unnecessarily exposes society and the environment to adverse risks of biotechnology and introduces numerous inefficiencies into the regulatory system. These risks and inefficiencies include gaps in regulation, duplicative and inconsistent regulation, unnecessary regulatory expense, agencies acting outside their areas of expertise, and unnecessary increases in the cost of and delay in the development and commercialization of new biotechnology products. This Article details how to achieve a comprehensive, efficient, and scientifically rigorous regulatory system for genetically modified food. …

Asking The Tiger For His Skin: Rights Activism In China, Eva Pils Jan 2006

Asking The Tiger For His Skin: Rights Activism In China, Eva Pils

Fordham International Law Journal

Based on a discussion of consequentialist, pragmatist, and deontological forms of reasoning as applied in debates about Chinese rights-defending, this Article makes two related observations. First, some Chinese rights defenders assess actions merely by whether they will promote institutional reform. They may reject courses of action because they would consider themselves responsible for their bad consequences, such as official reprisals. Their attitude puts them in danger of blinding themselves to the limits of legal reform in China's current constitutional and political structure. Second, according to the more radical view also described here, the case for speaking out against certain wrongs …
