Imagine that you have returned to your first year of law school. In your legal writing course, you are required to finish the year with an extensive brief analyzing a legal problem. After months in your doctrinal courses dealing with mind-bending legal issues such as liquidated damages, substantive due process, felony murder, personal jurisdiction, and shifting executory interests, you are ready to sink your teeth into a challenging legal writing assignment. You want to show your stuff and prove that your writing is law review caliber. Your assignment starts as follows: Greenacre is a parcel of land bounded on three …

Closing The "Equity Gap" In Startup/Seed Investment For Ict Ventures (Israeli Experience), Jimmy Schwarzkopf Jan 2006

Closing The "Equity Gap" In Startup/Seed Investment For Ict Ventures (Israeli Experience), Jimmy Schwarzkopf

Student Scholarship

In Israel\, an innovative program called Entrepreneur/ Executive in Residency (EIR) was initiated by venture capital firms to increase the probability that ICT startup/seed ventures will be funded. EIR programs help VCs to maintain 6%-10% of their portfolio (measured in invested dollars per year) in ventures in the startup/seed stage. This research\, based on qualitative interviews with Israeli VC executives and entrepreneurs who participate in EIR programs\, promotes understanding about how EIR programs work to increase the perceived confidence coefficient of the VC partners until it overcomes the “equity gap” that exists in assessing startup/seed entrepreneurial deals. Variant types of …

Imagine that you reside in a country not unlike the United States, with a similar cultural, economic, racial and ethnic mix. As in many other countries, the events of September 11, 2001, dramatically changed the lives of the inhabitants of your land. Your country passed a series of Special Laws specifically designed to enhance national security, and has joined the United States in its efforts in Afghanistan and Iraq. Your country's law enforcement and military officials, in several high-profile arrests that captured the attention of the populace, took three suspects into custody who allegedly were involved in terrorist-related activities. While …

The Dot Chromosome Of Drosophila: Insights Into Chromatin States And Their Change Over Evolutionary Time, Nicole Riddle, Sarah C.R. Elgin Jan 2006

The Dot Chromosome Of Drosophila: Insights Into Chromatin States And Their Change Over Evolutionary Time, Nicole Riddle, Sarah C.R. Elgin

Biology Faculty Research

Historically, chromatin has been subdivided into heterochromatin, transcriptionally inactive regions that remain densely packaged throughout the cell cycle, and euchromatin, transcriptionally active regions that take on a diffuse appearance as the cell enters interphase. The banded portion of the small fourth chromosome (dot chromosome) of Drosophila melanogaster is unusual in exhibiting many characteristics of heterochromatic domains, and at the same time maintaining a gene density typical of euchromatin. Similar to genes embedded in pericentric heterochromatin, many of the dot chromosome genes have adapted to a heterochromatic environment. Little is known about the regulation of these genes and less about their …

Opto-Electronic Processes In Srs:Cu Actfel Devices, Dharmashankar Rajagopalan

University of Kentucky Master's Theses

The a. c. thin film electroluminescent (ACTFEL) devices are of scientific interest due to their applications in large area, flat panel displays. Of particular interest to the research community is the mechanism of electron transport and luminance in these devices. Toward this end, a physical model and a mathematical model for SrS:Cu ACTFEL Devices were developed and published earlier by our group. The purpose of this thesis is to obtain a qualitative and quantitative match between experiment and theory. A brief summary of the model can be found here [1]. Effects of variation in drive parameters in experimental steady state …

ISBN 1-876682-56-6

The book grew out of a conference held in August 2001 at the University of Queensland in Brisbane, Australia. It is composed of a collection of thirteen essays that address postcolonialism in education. The Critical Factors Of Coaching Practice Leading To Successful Coaching Outcomes, Margaret K. Marshall Jan 2006

The Critical Factors Of Coaching Practice Leading To Successful Coaching Outcomes, Margaret K. Marshall

Antioch University Dissertations & Theses

The purpose of this study was to identify the critical aspects in coaching outcomes as perceived by experienced coaches in the United States in both business and life coaching settings. Nineteen coaches provided a total of 109 critical incidents that led the client to the coaching process. Six dimensions of coaching emerged from the coding process; personal philosophies of coaching, coach functions, the coaching process, breakdown and success factors, precipitating factors and outcomes of coaching. A model was constructed to depict the relationship of the dimensions to one another. The personal philosophy of the coach influenced every other dimension. The …

The Adventure(S) Of Blackness In Western Culture: An Epistolary Exchange On Old And New Identity Wars, Adrienne D. Davis, Robert S. Chang

Women, Gender & Sexuality Studies Faculty Research

Through a series of letters, Professors Robert Chang and Adrienne Davis examine the politics of positionality in law and literary criticism. They use the scholarly debates and conversations around critical race theory and feminist legal theory as a starting point to formulate some thoughts about Critical Race Feminism ("CRF") and its future. The authors use the epistolary form as a literary device to allow them to collaborate on this project while maintaining their own voices. Thus, the letters are not dated.

The letters pay particular attention to various border crossings: male attempts to engage in feminist literary criticism, white attempts …

The Pragmatic Populism Of Justice Stevens's Free Speech Jurisprudence Symposium: The Jurisprudence Of Justice Stevens: Panel V: First Amendment/Voting Rights, Gregory P. Magarian

Scholarship@WashULaw

In his three decades on the Supreme Court, Justice John Paul Stevens has developed a distinctive approach to the First Amendment. During his tenure, the Court's majority has crystallized a theory of First Amendment speech protection as an abstract, negative protection of individual autonomy against government interference. In contrast, Justice Stevens' pragmatic judicial methodology has caused him to place greater emphasis on free speech decisions' practical consequences, particularly their effectiveness in making democratic debate inclusive as to both participants and subject matter in order to ensure robust, well-informed public discourse. Alone on the present Court, Justice Stevens manifests a deep …

Privacy Law In The New Millennium: A Tribute To Richard C. Turkington, Gregory P. Magarian Jan 2006

Privacy Law In The New Millennium: A Tribute To Richard C. Turkington, Gregory P. Magarian

Scholarship@WashULaw

At least since Louis Brandeis and Samuel Warren's seminal 1890 article "The Right to Privacy,"' the idea of privacy has sparked some of the most significant and contentious debates in American law. Over the past three decades, Richard Turkington focused his formidable intellect on enriching those debates. Dick's untimely passing in 2004 deprived those of us who knew and worked with him of a treasured friend and a brilliant colleague. The broader legal profession lost a visionary. Probably more than any other scholar of his generation, Dick was responsible for expanding and deepening our understanding of the essential, sometimes elusive, …

Market Triumphalism, Electoral Pathologies, And The Abiding Wisdom Of First Amendment Access Rights, Gregory P. Magarian Jan 2006

Market Triumphalism, Electoral Pathologies, And The Abiding Wisdom Of First Amendment Access Rights, Gregory P. Magarian

Scholarship@WashULaw

Forty years ago, Professor Jerome Barron made the classic case that the First Amendment requires not merely protection of speech against government interference but provision of access to the means of mass communication. The Supreme Court in the ensuing decades has largely rejected Barron's approach. In this article, Professor Magarian defends Barron's case for access rights against the two theoretical critiques that have underwritten its doctrinal rejection. The libertarian critique attacks the normative underpinnings of access rights, maintaining that the First Amendment insulates market-driven distributions of expressive opportunities. Professor Magarian demonstrates that politically progressive and conservative libertarian critics of access …

Augmentation Of Reading Across The Curriculum, Student Exploration Of Literature, And Library Collection Development Through The Compilation Of A Comprehensive Annotated Bibliography Of High School Content Area Literature, Patricia J. Erkenbrack

Graduate Research Papers

The most current National Center for Education Statistics data are that average reading scores of American adolescents have been essentially stagnant since 1971, generating concern about the ability of high school graduates to meet the literacy challenges of the twenty-first century. A 1925 study conducted by the National Committee on Reading formulated the concept of literature-based content area reading instruction, in which the substantive involvement of school librarians was seen as crucial for success. No recent research on the integration ofliterature into content areas at the high school level is available, but the effectiveness of such a strategy is implied …

Improving The Rolling Contract, Stephen E. Friedman Jan 2006

Improving The Rolling Contract, Stephen E. Friedman

American University Law Review

This article addresses the increasingly common problem of buyers finding important contract terms inside the box of a newly purchased item instead of learning about them before or during purchase. The failure of courts to develop a satisfactory approach to deciding which contact terms sellers may provide after purchase is of great significance in light of the rapid proliferation of rolling contracts. In this article, Friedman proposes a mechanism that will ensure that sellers have the flexibility to defer presentation of some terms but that will also protect purchasers against the unfair imposition of unexpected and important terms arriving at …

The 2004 Presidential Election: Did Voters Bring Their Pocketbooks To The Polls?, Paul Masi Jan 2006

The 2004 Presidential Election: Did Voters Bring Their Pocketbooks To The Polls?, Paul Masi

Undergraduate Economic Review

In the wake of the 2004 presidential election, supporters of Senator John Kerry’s candidacy searched for explanations of voter behavior. The Kerry campaign succeeded in turning out record numbers of low-income voters. Kerry strategists predicted that these voters would hold incumbent President George W. Bush responsible for a decline in their personal economic well-being. Kerry attempted to facilitate this electoral behavior by offering what he believed to be an economic plan attractive to low-income voters. The pocketbook theory of voting underpinned this strategy. This theory asserts that voters consider the perceived impact which an incumbent has had on their personal …

Point Of Care Healthcare Quality Control For Patients Using Mobile Devices, Owen Lynch Jan 2006

Point Of Care Healthcare Quality Control For Patients Using Mobile Devices, Owen Lynch

Masters

The advances made in the domain of mobile telecommunications over the last decade offer great potential for developments in many areas. One such area that can benefit from mobile communications is telemedicine, which is the provision of medical assistance, in one form or another, to patients who are geographically separated from the healthcare provider. When a person is ill, individual attention from medical professionals is of the utmost importance until they have returned to full health. However, people who suffer with long term and chronic illnesses may need life long care and often must manage their condition at home. Many …
