This question of merger is one of the most perplexing that courts face in the criminal sentencing process. This article not only explores that question but proposes specific new methods a court may use to resolve this question in a way consonant with the Constitution and the intent of the legislature.

The article takes as its starting point a brilliant analysis of the Double Jeopardy doctrine set out by Professor Ann Poulin of Villanova Law School in an article entitled Double Jeopardy and Multiple Punishment: Cutting the Gordian Knot, 77 U. The stashR package (a Set of Tools for Administering SHared Repositories) for R implements a simple key-value style database where character string keys are associated with data values. The key-value databases can be either stored locally on the user's computer or accessed remotely via the Internet. Methods specific to the stashR package allow users to share data repositories or access previously created remote data repositories. This essay reviews Excusing Crime, by Jeremy Horder, Reader in Criminal Law and Tutor in Law at Worcester College, Oxford. It describes Horder’s project, which is to build a complex taxonomy of criminal law excuse practices and to use that account of “why things are as they are” to argue, on the basis of his version of liberal theory, against “the restricted range” of excuses in the UK and elsewhere. Spatial Variation In The Chemical Composition Of Natal Otholiths From A Reef Fish In The Galápagos Islands, Benjamin I. Ruttenberg, Robert R. Warner

Over the past decade, researchers have used variation in the chemical composition of fish otoliths (earstones) to address a number of ecological questions, such as stock assessment and assessing rates of movement of individuals among habitats or life-history stages. However, these methods have yet to be applied successfully to the study of larval connectivity, a major unanswered question in marine ecology. Accomplishing this task requires a reference collection of pre-pelagic natal otoliths and accurate measurement of the chemical signatures of otoliths cores of recruits. New Hampshire boasts the nation's lowest percentage of people living in poverty and maintains strong rankings in other quality-of-life measures. But 48,000 New Hampshire families with low incomes struggle to make ends meet, this issue brief finds. The brief identifies characteristics that heighten families' risk of a lower income and documents recent trends in the economic status of low-income families in the state.

In 2006, as in most years, the New York courts have decided a broad range of land use issues. This article summarizes the impacts of several of these important decisions. Specifically, this article covers the following land use topics: affordable housing, statute of limitations, res judicata, standing to sue, enforcement of injunctions, takings law, vested rights, property annexation, religious land uses, New York’s State Environmental Quality Review Act (SEQRA), and judicial review of local board actions.

ABSTRACT
Migrant farm workers--a high percentage of which are Hispanic--are an extremely disadvantaged population that experiences several barriers, including language, nutrition, transportation, and access to health services. This population also suffers from numerous diseases (obesity, diabetes, and heart disease) and experiences various hazards associated with risky work, such as pesticide exposure. This study included data collection on basic health and nutrition barriers to identify areas where programs and policies can be modified to better serve migrant farm workers. Using a statistically rigorous analysis method, we place limits on the existence of an isotropic stochastic gravitational wave background using pulsar timing observations. We consider backgrounds whose characteristic strain spectra may be described as a power-law dependence with frequency. Such backgrounds include an astrophysical background produced by coalescing supermassive black-hole binary systems and cosmological backgrounds due to relic gravitational waves and cosmic strings. Using the best available data, we obtain an upper limit on the energy density per unit logarithmic frequency interval of ΩgSMBH[1/(8 yr)}h2 ≤ 1.9 × 10-8 for an astrophysical background that is 5 times more stringent than …

A new sensor, the Advanced Electro-Optical System (AEOS) Spectral Imaging Sensor (ASIS) has been developed at the Maui Space Surveillance Complex (MSSC). ASIS is capable of collecting resolved imagery of space objects in 10's-100's of spectral bands while using an adaptive optics system. However, the stringent requirements of collecting ground-based images requires a sensor that induces spectral blurring. Post-processing algorithms to remove this blurring are required to fully exploit these spectral images. This research focuses on developing the reconstruction algorithms, based on proven estimation theories, required to spectrally deblur the images collected from ASIS.
