Tough Talk From The Supreme Court On Free Speech: The Illusory Per Se Rule In Garcetti As Further Evidence Of Connick’S Unworkable Employee/Citizen Speech Partition, Sonya K. Bice Sep 2006

Tough Talk From The Supreme Court On Free Speech: The Illusory Per Se Rule In Garcetti As Further Evidence Of Connick’S Unworkable Employee/Citizen Speech Partition, Sonya K. Bice

ExpressO

Garcetti v. Ceballos was intended to clear up an area of First Amendment law so murky that it was the source not only of circuit splits but also of intra-circuit splits—panels from within the same circuit had arrived at opposite results in nearly identical cases. As it turned out, the Supreme Court itself was as splintered as the circuits. Of all the previously argued cases that remained undecided during the Court’s transition involving Justice O’Connor’s retirement and Justice Alito’s confirmation, Garcetti was the only one for which the Court ordered a second argument. This suggested to some that without a …

Privatizing Eminent Domain: The Delegation Of A Very Public Power To Private, Non-Profit And Charitable Corporations, Asmara Tekle Johnson Sep 2006

Privatizing Eminent Domain: The Delegation Of A Very Public Power To Private, Non-Profit And Charitable Corporations, Asmara Tekle Johnson

ExpressO

In an age of privatization of many governmental functions such as health care, prison management, and warfare, this Article poses the question as to whether eminent domain should be among them. Unlike other privatized functions, eminent domain is a traditionally governmental and highly coercive power, akin to the government’s power to tax, to arrest individuals, and to license. It is, therefore, a very public power.

In particular, the delegation of this very public power to private, non-profit and charitable corporations has escaped the scrutiny that for-profit private actors have attracted in the wake of the U.S. Supreme Court’s decision in …

Unwarranted Fears Mask The Benefits Of Network Diversity: An Argument Against Mandating Network Neutrality, Elvis Stumbergs Sep 2006

Unwarranted Fears Mask The Benefits Of Network Diversity: An Argument Against Mandating Network Neutrality, Elvis Stumbergs

ExpressO

The rapid development of the Internet has necessitated an update to Federal telecommunications laws. Recent Congressional efforts to enact such an update, however, have spawned a fiery debate over a somewhat nebulous concept: network neutrality. The debate concerns the way that Internet access providers handle the data traffic being sent over their networks. These providers would like the option to offer some of their customers, web site hosting companies and similar entities, additional services that would essentially result in these customers’ content loading faster, more reliably, or more securely than others not receiving such priority treatment. Yet, this proposed “diversity” …

A Defense Of Structural Injunctive Remedies In South African Law, Danielle E. Hirsch Sep 2006

A Defense Of Structural Injunctive Remedies In South African Law, Danielle E. Hirsch

ExpressO

This Article argues that the use of structural injunction remedies by South African courts is appropriate, and, in light of demonstrated government inaction, often necessary in order to give meaning to the protection of socio-economic rights, which is mandated by their Constitution. The Article draws upon numerous United States judicial decisions where structural injunctions have been successfully implemented to address systemic institutional inaction and violations of the equal protection and due process clauses of the United States Constitution. In numerous instances, the South African government has not acted to effectively give meaning to the socio-economic rights which were broadly declared …

Got Rights? Not If You’Re A Sex Offender In The Seventh Circuit, Sheila T. Caplis Sep 2006

Got Rights? Not If You’Re A Sex Offender In The Seventh Circuit, Sheila T. Caplis

Seventh Circuit Review

Sex offender legislation has grown exponentially over the past decade and in conjunction the courts have demonstrated an unwillingness to find such legislation unconstitutional. Civil commitment, public registration, and residency restrictions have uniformly been upheld. However, how far can the courts continue this trend without stripping away the fundamental rights and interests of sex offenders. This issue is explored in light of a piece of legislation directed at banning a specific sex offender from the city parks.

Hooking The Crook: The Seventh Circuit Justifies The Suspicionless Search Of A Probationer, Meira Greenberg Sep 2006

Hooking The Crook: The Seventh Circuit Justifies The Suspicionless Search Of A Probationer, Meira Greenberg

Seventh Circuit Review

A plea bargain allows an individual, accused of a crime, an opportunity to reduce their sentence by bargaining with the prosecution. Although such agreements often stipulate that the accused waive certain constitutional rights, the conditions attached to a bargained-for-probation sentence are not beyond judicial review. Normally, courts examine the constitutionality of the probationary condition, but in United States v. Barnett, the Seventh Circuit summarily upheld the suspicionless search of a probationer upon the consent/contract theory. This Comment contends that the consent/contract theory employed by the Seventh Circuit improperly hooks the crook by upholding unreasonable probationary conditions that violate the …

Suggested Research Agenda For The Railroad Industry, Barton Jennings Sep 2006

Suggested Research Agenda For The Railroad Industry, Barton Jennings

Journal of Transportation Management

The railroad industry is experiencing a worldwide resurgence. International trade is booming as populations continue to grow and transportation infrastructures are nearing capacity. In the United States, the industry is being pressured to provide more services, while at the same time traffic levels are skyrocketing on a network that is much smaller than it was just fifty years ago. Additionally, security and safety issues are challenging the industry, as well as the regulatory agencies associated with railroading. To help with these problems, the industry is calling for more academic involvement through new degree programs and research initiatives. This paper reviews …
