Padgett V. Donald: Why Not So Special, Victoriya Kulik Mar 2006

Padgett V. Donald: Why Not So Special, Victoriya Kulik

Mercer Law Review

In Padgett v. Donald, the Eleventh Circuit Court of Appeals unanimously held that a state statute, permitting compelled collection of saliva samples from incarcerated felons for DNA profiling, does not violate the federal Constitution's Fourth Amendment, the search and seizure provisions of the state constitution, or the felons' rights to privacy under the federal or state constitutions. The circuits are split whether to apply the special needs analysis or the balancing test to DNA profiling statutes. In this case of first impression for the circuit, the Eleventh Circuit applied the balancing test. This decision is important because it opens …

Economic Regulation In The United States: The Constitutional Framework, Mark C. Christie Mar 2006

Economic Regulation In The United States: The Constitutional Framework, Mark C. Christie

University of Richmond Law Review

The United States of America is well-known (and occasionally well-liked or loathed) as the world's largest free-market capitalist nation. Indeed, many assume that since the United States for more than two centuries has had an economic system based on liberal principles, Adam Smith's "invisible hand" of capitalism must have been embedded in the United States Constitution from the beginning of the American republic. Yet government at all levels in the United States has historically exercised significant regulation of economic and commercial activity-regulation inconsistent with laissez-faire capitalism. The purpose of this article is to consider several questions: (1) what are the …

The Opacity Of Transparency, Mark Fenster Mar 2006

The Opacity Of Transparency, Mark Fenster

UF Law Faculty Publications

The normative concept of transparency, along with the open government laws that purport to create a transparent public system of governance, promises the moon -- a democratic and accountable state above all, and a peaceful, prosperous, and efficient one as well. But transparency, in its role as the theoretical justification for a set of legal commands, frustrates all parties affected by its ambiguities and abstractions. The public's engagement with transparency in practice yields denials of reasonable requests for essential government information, as well as government meetings that occur behind closed doors. Meanwhile, state officials bemoan the significantly impaired decision-making processes …

Police Pursuits: A Comprehensive Look At The Broad Spectrum Of Police Pursuit Liability And Law, Patrick T. O'Connor, William L. Norse Jr.

Mercer Law Review

Law enforcement's need to pursue criminal suspects has existed, in all probability, since the first laws were ever written. From the days of travel by foot, to horse, and now in the age of motorized transportation, however, one thing has become clear: police pursuits can be extremely dangerous. In 2003 there were an estimated 35,000 police pursuits across the United States. Nearly forty percent of those pursuits, or 14,000, resulted in crashes. Of that number at least half resulted in injuries. Additionally, there were 350 pursuit-related fatalities. Of these fatalities, approximately one-third were innocent bystander deaths. A particularly challenging component …

Leaving Homeroom In Handcuffs: Why An Over-Reliance On Law Enforcement To Ensure School Safety Is Detrimental To Children, Jennie Rabinowitz

Cardozo Public Law, Policy & Ethics Journal

The note critiques the increasing reliance on law enforcement and criminal justice systems to address school safety, arguing that such measures are often costly, ineffective, and disproportionately impact minority students. It advocates for alternative strategies, such as early intervention, education, and student empowerment, to prevent violence and create safer school environments. These approaches, the note suggests, not only reduce reliance on punitive measures but also address underlying issues and foster positive student outcomes.

Report Of The Working Group On The Role Of Race, Ethnicity, And Class, Working Group On The Role Of Race, Ethnicity, And Class

Nevada Law Journal

This Working Group considered the role of race, ethnicity, and class (hereinafter "REC") in the attorney-client relationship. Participants recognize that, in American society, children in the child welfare and juvenile justice systems are disproportionately poor and of color while the lawyers for those children and the decision makers are overwhelmingly white and middle class. This racial disparity may affect attorney client communication, perpetuate stereotypes, foster distrust of the legal system and contribute to bad outcomes for the affected children and families. Issues related to REC, which often are ignored both in the attorney client relationship and more generally in the …
