Between Rights And Contract: Arbitration Agreements And Non-Compete Covenants As A Hybrid Form Of Employment Law, Cynthia Estlund Jan 2006

Between Rights And Contract: Arbitration Agreements And Non-Compete Covenants As A Hybrid Form Of Employment Law, Cynthia Estlund

Faculty Articles

The employment relationship is governed largely by contract, but with a heavy overlay of “rights”: minimum terms and individual rights that are established by external law and are typically nonwaivable. But some terms of employment are governed neither by ordinary contract nor by ordinary rights, nor even by ordinary waivable rights. Both of the two most controversial contractual instruments in employment law today—non-compete covenants and mandatory arbitration agreements—take the form of written contracts; both waive important employee rights (the right to compete postemployment, the right to litigate future claims); and both are subject to substantive criteria of validity that are …

Monroe Freedman's Solution To The Criminal Defense Lawyer's Trilemma Is Wrong As A Matter Of Policy And Constitutional Law, Stephen Gillers Jan 2006

Monroe Freedman's Solution To The Criminal Defense Lawyer's Trilemma Is Wrong As A Matter Of Policy And Constitutional Law, Stephen Gillers

Faculty Articles

Monroe Freedman has argued, most recently in the third edition of Understanding Lawyers’ Ethics, co-authored with Abbe Smith, that criminal defense lawyers have a “trilemma” because the rules of their profession give them potentially contradictory instructions. First, competence requires lawyers to seek all information that can aid a client’s matter. Second, lawyers have a duty of confidentiality that generally forbids them to use a client’s information except for the client’s benefit. Third, lawyers have a duty of candor to the court that may require them to reveal a client’s confidential information in order to prevent or correct fraud on the …

Safety And Security, Jeremy Waldron Jan 2006

Safety And Security, Jeremy Waldron

Faculty Articles

When people talk, as they often do, about a trade-off between security and liberty-when they say (as many people said after September 11, 2001) that we need to adjust the balance between security and civil liberties -what do they mean by security? Talk of a liberty-security balance has become so common that many view it as just an ambient feature of our political environment: "[I]t has become a part of the drinking water in this country that there has been a tradeoff of liberty for security, . . . that we have had to encroach upon civil liberty and trade …

What Light If Any Does The Google Print Dispute Shed On Intellectual Property Law?, Richard A. Epstein Jan 2006

What Light If Any Does The Google Print Dispute Shed On Intellectual Property Law?, Richard A. Epstein

Faculty Articles

In looking at this topic, I originally thought that I would focus largely on the question of fair use to sort out the Google dispute, given its centrality to the present litigation. That defense may determine whether the company succeeds or fails in litigation, an issue which I think is really very much open to doubt. But on reflection fair use is only one of a cluster of related issues that the Google project raises. The first issue asks whether or not the various opt-out programs that Google creates are sufficient to create consent to the project, which would obviate …

Our Ignorance About Intelligence, Richard A. Epstein Jan 2006

Our Ignorance About Intelligence, Richard A. Epstein

Faculty Articles

In a short introduction, I shall not even attempt to hint at my views on this cluster of issues, which are on most issues very much a work-in-progress. As a committed defender of limited government in the classical liberal tradition, there are many areas of human life in which I would like to keep the government at bay. I see little or no reason for state regulation of employment contracts for example, and I cautiously accept only limited forms of land planning. But neither of those strategies works here, for try as one might, intelligence is a legitimate government function—assuming …

An Empirical Study Of The Multifactor Tests For Trademark Infringement, Barton C. Beebe Jan 2006

An Empirical Study Of The Multifactor Tests For Trademark Infringement, Barton C. Beebe

Faculty Articles

The thirteen circuits' thirteen different multifactor tests for the likelihood of consumer confusion have long played a role of central importance in American trademark litigation, yet they have received little academic attention and no empirical analysis. Courts, commentators, and practitioners have all the while speculated about which factors, if any, drive the outcome of the tests, how the factors interact, and, most importantly, whether the circuits' different tests, given the same facts, would yield different outcomes. With a view to the settling of these questions and ultimately to the reform of the multifactor tests, this Article sets forth the results …

Law And The Science Of Networks: An Overview And An Application To The “Patent Explosion", Katherine J. Strandburg, Gábor Csárdi, Jan Tobochnik, Péter Érdi, László Zalányi

Faculty Articles

The article presents an overview on the evolution and structure of technical relationships between patents in the U.S. patent system. It argues that the legal scholars should engage on network science trend because it provides significant conceptual advances and analytical tools. It illustrates the application of a network approach to empirical data by identifying the result of a network science study of patent acknowledgement.

Welfare, Cash Grants, And Marginal Rates, Daniel N. Shaviro Jan 2006

Welfare, Cash Grants, And Marginal Rates, Daniel N. Shaviro

Faculty Articles

Marginal rates are frequently analyzed based solely on taxes, without regard to benefit phase-outs that have exactly the same incentive and distributional effects as increasing positive taxes. This myopia reflects the notion, rooted in our current fiscal language, that taxes and spending are fundamentally different. In fact, however, the difference is purely one of labeling. Among the ill consequences of this confusion between substance and labels is the political unfeasibility of demogrant or negative income tax proposals. These proposals often are criticized for seemingly providing universal and unconditional cash grants. In fact, however, cash grants can be just as conditional …

Young People’S Perceptions Of What It Means To Be An Australian, Nola Purdie, Rhonda Craven Jan 2006

Young People’S Perceptions Of What It Means To Be An Australian, Nola Purdie, Rhonda Craven

Student learning processes

The question “What does it mean to be an Australian?” has significant implications for understanding factors contributing to social cohesion; explaining and promoting ourselves to others; imagining and shaping Australia’s future; and shaping civics curriculum. The purpose of this study was to identify key components of Australian national identity of a sample of Australians (N = 418) comprised of primary (N=71); secondary (N=146), Technical and Further Education (TAFE) (N=59) and University (n=142) students. Participants completed a written response to the question “What does it mean to be Australian?” Responses were analysed and coded by two coders using content analysis to …

Modernist Success In A Postmodern Failure: Jackson Pollock And Abstract Expressionism, The Avant-Garde And The Ascension Of Late Capitalism, Art After 1945, Russell Gullette

Honors Theses

It is hard to imagine the magnitude of the events at the end of World War II. The thought produced in the face of a myriad of deaths is almost unfeasible sixty years after the fact, but the energy was integral to the changing social landscape. Because of the country's prominence in and fortitude after the war, the U.S. was left responsible for reshaping and rejuvenating the international landscape that was destroyed by the years of brutal fighting and vile contestation. The American establishment was granted a major opportunity to establish itself amongst the global leaders. Such a grand responsibility …

Impact Of Gender And Ethnic Composition Of South African Boards Of Directors On Intellectual Capital Performance, Jean-Luc Wolfgang Mitchell Van Der Zahn Jan 2006

Impact Of Gender And Ethnic Composition Of South African Boards Of Directors On Intellectual Capital Performance, Jean-Luc Wolfgang Mitchell Van Der Zahn

Research Collection School Of Accountancy

This study examines the association between the gender and ethnic composition of boards of directors and firm performance in a transitional nation. In contrast to prior research that largely focuses on firm performance within a financial context, this study concentrates on intellectual capital performance. Using data collected from 84 South African, empirical results indicate a positive association between the percentage of female and non-white directors on the board and a firm’s intellectual capital performance. Additional analysis shows the designation of female directors as an insider has a negative effect of intellectual capital performance. Designation of female and non-white directors as …

Sight-Reading Versus Repertoire Performance On The Piano: A Case Study Using High-Speed Motion Analysis, Brenda Wristen, Sharon Evans, Nikolaos Stergiou Jan 2006

Sight-Reading Versus Repertoire Performance On The Piano: A Case Study Using High-Speed Motion Analysis, Brenda Wristen, Sharon Evans, Nikolaos Stergiou

Journal Articles

The purpose of the study was to examine whether differences exist in the motions employed by pianists when they are sight-reading versus performing repertoire and determine whether these differences could be quantified using high speed motion capture technology. A secondary question of interest was whether or not an improvement in the efficiency of motion could be observed between two sight-reading trials of the same musical excerpt. This case study employed a six digital infrared camera system (Motion Analysis, Inc.) to capture the motion of pianists playing two trials of a repertoire piece and two trials of a sight-reading excerpt. Angular …
