'Tis A Gift To Be Simple: A Model Reform Of The Federal Sentencing Guidelines, Frank O. Bowman Iii

Faculty Publications

This essay introducing the June 2006 edition of the Federal Sentencing Reporter (Vol. 18, No. 5) describes two important contributions to the movement for real reform of the federal sentencing system. First, Professor Bowman summarizes the recommendations of the Constitution Project Sentencing Initiative (CPSI) report on federal sentencing. The CPSI report, reproduced in this Issue, cautions against any over-hasty legislative response to the Supreme Court's decision in United States v. Booker, suggests some near-term improvements to the existing federal sentencing system, and then sets out a framework for a reformed and markedly simplified federal sentencing regime. Second, Professor Bowman describes …

Personality Influences On Marital Satisfaction: An Examination Of Actor, Partner, And Interaction Effects, Mahnaz Rehmatullah Charania Jul 2006

Personality Influences On Marital Satisfaction: An Examination Of Actor, Partner, And Interaction Effects, Mahnaz Rehmatullah Charania

Psychology Dissertations - Archive

The current research was designed to examine the associations between married partners' personalities and their marital satisfaction. The major goal of this research was to examine the unique predictive validity of 13 personality traits in an omnibus model in which the effects of all 13 traits were tested simultaneously. The data were analyzed using the Actor-Partner Interdependence Model (APIM), which enabled me to examine the effect of each personality variable (1) as a function of each participant's own trait score (an actor effect), (2) as a function of each participant's partner's trait score (a partner effect), and (3) as a …

Open ended questions regarding equipment usage, follow up and trends are also discussed. Finally prediction equations are shared resulting from statistical analysis.

Recognition Beyond Struggle: On A Liberatory Account Of Hegelian Recognition, Michael Monahan Jul 2006

Recognition Beyond Struggle: On A Liberatory Account Of Hegelian Recognition, Michael Monahan

Philosophy Faculty Research and Publications

The article discusses the concept of Hegelian recognition. The four central tenets of the agonistic interpretation of Hegelian recognition are discussed. First, recognition requires participants to occupy one of the two roles such as recognizer and recognizee. Moreover, it asserts that recognition is a relation of asymmetry. The article addresses the concept of pure recognition. In this concept, the agent is able to exist as a self-conscious agent for another self-conscious agent. Furthermore, the uses and abuses of recognition are also addressed.

A Therapeutic Collaboration: The Bibliotherapy Education Project At Oregon State University, P. S. Mcmillen

Library Faculty Research

Bibliotherapy has been defined many ways and is known by many other names such as biblioguidance, literatherapy, reading therapy, bibliocounseling, bibliopsychology, book matching and literapeutics. Most simply, if one goes back to the Greek roots of the word, it means helping through books. It has been used with all ages, with almost every imaginable issue or problem, and at all levels of intervention by teachers, counselors, librarians, social workers, nurses, psychologists and physicians. Developmental bibliotherapy, for example, can be used in the classroom where the goal may be to facilitate normal developmental passages or to educate about attitudes, feelings and …

Law Quadrangle (formerly Law Quad Notes)

The following essay is excerpted from an article published at 32 Ohion Northern University Law Review 287 (2006) and appears here with permission. The complete article expresses the author's skepticism about the meaning of many of the findings reported by proponents of the "humanizing legal education" initiative, and in detail dissects the research methods and conclusions of studies done by G. Andrew H. Benjamin et al in 1986 and by Keenon M. Sheldon and Lawrence S. Krieger in 2004. In the last 20 years much has been written about the deleterious effect that law school has on the mental well-being …

Collegiality And The Academic Library, Michael Lorenzen Jul 2006

Collegiality And The Academic Library, Michael Lorenzen

E-JASL: Electronic Journal of Academic and Special Librarianship (1999-2009, Volumes 1-10)

Abstract

This paper examines the concept of collegiality and how it can be applied to academic libraries. This includes a definition of what collegiality is, a review of the library literature which describes how other writers have seen this issue, and a discussion of how collegiality can be applied in libraries. This includes an examination of how faculty in a library and faculty on other parts of campus work differently which makes collegiality more important in the library. It also looks at why collegiality is important in academic libraries where librarians work hand-in-hand with support staff and student employees.

Breaking Perceptions Of "Old Boys' Networks": Women Leaders Learning To Make The Most Of Mentoring Relationships, Linda Searby, Jenny Tripses Jul 2006

Breaking Perceptions Of "Old Boys' Networks": Women Leaders Learning To Make The Most Of Mentoring Relationships, Linda Searby, Jenny Tripses

Journal of Women in Educational Leadership

Women often perceive a disadvantage over similarly qualified males in professional advancement because they are not part of the "old boys' network." Based upon the assumption that women and minorities struggle to gain access into educational administration positions due to lack of professional networks and mentors, this phenomenological qualitative study sought to understand, from the protege perspective, how women develop the capacity to enter into mentoring relationships. Subjects in the study were 14 women participants in a mentoring conference sponsored by a statewide women's administrative organization. Conclusions from the study address ambivalence experienced by proteges in seeking out a mentor …

The Law Of Implicit Bias, Cass R. Sunstein, Christine Jolls Jul 2006

The Law Of Implicit Bias, Cass R. Sunstein, Christine Jolls

Articles

Considerable attention has been given to the Implicit Association Test (IA T), which finds that most people have an implicit and unconscious bias against members of traditionally disadvantaged groups. Implicit bias poses a special challenge for antidiscrimination law because it suggests the possibility that people are treating others differently even when they are unaware that they are doing so. Some aspects of current law operate, whether intentionally or not, as controls on implicit bias; it is possible to imagine other efforts in that vein. An underlying suggestion is that implicit bias might be controlled through a general strategy of "debiasing …

Deinstitutionalization: The Consequences For The Primary Caregiver, Jennifer R. Pettit

Sociology & Anthropology Theses - Archive

This study examines the psychological well-being of the primary caregiver of a mentally-challenged individual. In this research, the primary caregiver is the person who has responsibility for the care of a mentally-challenged individual. The three main questions examined in this research are: Will caregiver's socioeconomic status be associated with the reported stress level of the caregiver? Will the use of formal supports to the caregiver be associated with lower levels of caregiver stress? Will the use of informal supports be associated with lower levels of caregiver stress? The study involved a quantative approach to examine 90 primary caregivers who live …

Employment Discrimination, Peter Reed Corbin, John E. Duvall Jul 2006

Employment Discrimination, Peter Reed Corbin, John E. Duvall

Mercer Law Review

The 2005 survey period saw a continuation of the diminished number of published decisions by the Eleventh Circuit Court of Appeals in the area of employment discrimination. However, it is interesting to note that the Eleventh Circuit also handed down at least 141 unpublished opinions in employment discrimination cases. Accordingly, while this trend may mean that the topic of employment discrimination is still very much alive and well within the Eleventh Circuit, it may also indicate that there are fewer unsettled questions of law in this area. However, this does not mean that the 2005 survey period was insignificant

Gonzales V. Raich: Has New Federalism Gone Up In Smoke?, Laura W. Harper Jul 2006

Gonzales V. Raich: Has New Federalism Gone Up In Smoke?, Laura W. Harper

Mercer Law Review

In Gonzales v. Raich, the United States Supreme Court broke with recent federalist trends by holding that Congress did not exceed its Commerce Clause power in prohibiting the local growth and use of marijuana, which was legal under California state law. While the Court asserted that this case did not break with recent precedent restricting Congress's Commerce Clause power, this decision reaffirms expansive congressional power and creates uncertainty about whether federalist principles limit congressional power.

Exploring The Discourses Of Small Enterprise Proprietors, Brendan O'Rourke, Martyn Pitt

Conference papers

Over the last three decades the discourses of strategy and enterprise have developed significantly in the context of large corporate organizations and increasingly within and for the public sector. The discourses of strategy and enterprise have developed in relationship with each other and are generative of various attributes and dilemmas for the identity of the strategist/entrepreneur. This study looks at how these important discourses are deployed by small enterprise proprietors in periodical publishing in Ireland as they construct their business identities with one of the authors. Interview data from one proprietor is subjected to a discourse analysis drawing particularly on …

The Prediction Of Career Decision-Making Self-Efficacy From Black And White Racial Identity Attitudes, Jennifer K. Montgomery Jul 2006

The Prediction Of Career Decision-Making Self-Efficacy From Black And White Racial Identity Attitudes, Jennifer K. Montgomery

Doctoral Dissertations

Racial identity has been related to a variety of interpersonal, psychological, behavioral, environmental, and cognitive factors. Although Black racial identity is often researched in relation to career development, there are few studies examining the relationship between career development and White racial identity. Additionally, review of the career development studies that focused on Black racial identity reveals that they have failed to consider the role of social cognitive factors, instead using traditional career models that were created from the standpoint of middleclass non-minorities. The focus of this study was to examine the distinct relationship between Black and White racial identity and …

Sleep Quality Of College Students And Its Relationship To Coping Styles And Well-Being, Cathy Alison Word Jul 2006

Sleep Quality Of College Students And Its Relationship To Coping Styles And Well-Being, Cathy Alison Word

Doctoral Dissertations

College students suffer from more sleep disturbances than the general population. Sleep difficulties in college students can lead to lower levels of performance, memory, and cognitive ability, as well as increased levels of anxiety and decreased levels of well-being. Sleep quality is known to impact individuals' physical and psychological health, which are indicators of well-being. Sleep also appears to influence individuals' choices of coping strategies. Sleep quality is also highly correlated with college students' emotional response to stress. The relationships between and among sleep quality, well-being, and coping style have not been fully examined. The purpose of this study was …

Effective Teaching Practices For Students With And Without Learning Difficulties: Constructivism As A Legitimate Theory Of Learning And Of Teaching?, Ken Rowe Jul 2006

Effective Teaching Practices For Students With And Without Learning Difficulties: Constructivism As A Legitimate Theory Of Learning And Of Teaching?, Ken Rowe

Student learning processes

Much of what is commonly claimed as ‘effective teaching practice’ and implemented during the early and middle years of schooling in Australian schools, for either mainstream students or for those experiencing learning difficulties, is not grounded in findings from evidencebased research. Of particular concern is that despite a lack of supporting evidence for its utility, the prevailing educational philosophy of constructivism (a theory of self-directed learning rather than a theory of teaching) continues to have marked influences on shaping teachers’ interpretations of how they should teach – aided and abetted by the content emphasis given during pre-service teacher education, as …
