Compensation Representatives: A Prudent Solution To Excessive Ceo Pay, Lawton W. Hawkins Aug 2006

Compensation Representatives: A Prudent Solution To Excessive Ceo Pay, Lawton W. Hawkins

ExpressO

Currently, CEO pay is determined by a company’s board of directors, subject to limited shareholder approval in certain circumstances. However, as Lucian Bebchuk and Jesse Fried have demonstrated, boards of directors and CEOs do not necessarily engage in real arms length bargaining over CEO pay. Instead, CEOs may exert managerial power to extract economic rents above and beyond what they could have obtained in an arms length negotiation. To address the problem, Bebchuk and Fried have proposed that large shareholders be allowed to nominate candidates for the board, and that companies be required to pay the expenses for any proxy …

Light From The Trees: The Story Of Minors Oposa And The Russian Forest Cases , Oliver Austin Houck Aug 2006

Light From The Trees: The Story Of Minors Oposa And The Russian Forest Cases , Oliver Austin Houck

ExpressO

This article describes two lawsuits in the late twentieth century that changed their countries in ways from which there will be no return. One took place in the Philippines, emerging from the reign of Fernando Marcos, and the other in Russia, following a near century of communist rule. They have two things in common. They declared the rights of their citizens to challenge, and reverse, government decisions. And they were about the environment, more particularly, trees. What we learn is that notions of environmental protection, citizen enforcement and judicial review have traveled the world and that, in differing legal systems, …

Domestic Violence Physical And Emotional In The Male Gay Community, Lee A. Rhodes Aug 2006

Domestic Violence Physical And Emotional In The Male Gay Community, Lee A. Rhodes

Regis University Student Publications (comprehensive collection)

Domestic violence partner abuse both physical and emotional occurs in male same sex relationships at the same rate as in heterosexual relationships. The National Coalition of Anti-Violence programs conducted a 10-year study in 10 United States cities, which documented violence at a rate between 25-33% in same sex relationships. A 1991 study found that 46% of the women responding had experienced two or more incidents of physical violence in their relationships (Coleman, 1991). The Survivor Project in Portland, Oregon, is currently conducting a study of gay, lesbian, bisexual and transgender people regarding domestic violence. Domestic violence can begin as emotional …

Forgotten Racial Equality: Implicit Bias, Decision-Making And Misremembering, Justin D. Levinson Aug 2006

Forgotten Racial Equality: Implicit Bias, Decision-Making And Misremembering, Justin D. Levinson

ExpressO

This Article argues that judges and jurors unknowingly propagate racism through their legal decisions because they misremember case facts in implicitly biased ways. Such an argument bridges discourse in implicit social cognition, memory studies, and legal decision-making. Social cognition research indicates that implicit racial biases are automatic, pervasive, and often operate without conscious awareness. Memory studies demonstrate that memory errors are meaningful and systematic, and are often facilitated by stereotypes. Decision-making theory teaches that memory errors can not only affect the results of individual decision-making processes, but also that group deliberations are unlikely to resolve these errors. The author argues …

Impotence Of Being Earnest: Status Of The United Nations Standard Minimum Rules For The Treatment Of Prisoners In Europe And The United States, Sara A. Rodriguez Aug 2006

Impotence Of Being Earnest: Status Of The United Nations Standard Minimum Rules For The Treatment Of Prisoners In Europe And The United States, Sara A. Rodriguez

ExpressO

The Standard Minimum Rules for the Treatment of Prisoners were approved with the most earnest of good intentions at the First United Nations Crime Congress in 1955, in an attempt to establish “what is generally accepted as being good principle and practice in the treatment of prisoners and the management of institutions.” In spite of their noble purpose, implementation of these rules has been somewhat of a disappointment. Europe has adopted the Standard Minimum Rules wholesale. The United States, by contrast, has declined to adopt a set of standards patterned after the Standard Minimum Rules, relying instead on pre-existing correctional …

From Healing The Whole Person: An Argument For Therapeutic Touch As A Complement To Traditional Medical Practice, Marlene B. Huff, Kimberly K. Mcclanahan, Hatim A. Omar Aug 2006

From Healing The Whole Person: An Argument For Therapeutic Touch As A Complement To Traditional Medical Practice, Marlene B. Huff, Kimberly K. Mcclanahan, Hatim A. Omar

Pediatrics Faculty Publications

The growing popularity and use of therapeutic touch (TT) is an issue that has generated controversy and concern within the medical community. While anecdotal and traditional scientific evidence suggest that TT would be an advantageous addition for clinics and hospitals to include in their armamentarium of complementary interventions within the realm of traditional medicine, TT has not become widely available in the U.S. One reason for the lack of availability may be the dearth of conclusive scientific support for TT's efficacy and, therefore, its inclusion in clinic and hospital treatment planning would give it the appearance of legitimate practice, which …

The Expression Of Emotions, Hweawon Chung Aug 2006

The Expression Of Emotions, Hweawon Chung

Theses

Throughout history, humans have been interested in the relationship between the mind and emotion. I am interested in the way in which people transmit their unique feelings to others. These sculptures represent my perspective of this phenomenon. Often people will communicate with their faces instead of their voices. Facial expression is the way to convey one’s true sentiments. Through my work, I try to recreate the moment in which one’s inner thoughts are expressed. In my personal experience, the speaking of a foreign or non-native language often causes misunderstanding. To address this problem, I try to read the face of …

Who Decides?: A Critical Look At Procedural Discretion, Robert G. Bone Aug 2006

Who Decides?: A Critical Look At Procedural Discretion, Robert G. Bone

ExpressO

Federal civil procedure today relies extensively on trial judge discretion to manage litigation, promote settlements, and otherwise tailor process to individual cases. Even those rules with decisional standards leave trial judges considerable interpretive freedom to make case-specific determinations. This Article criticizes these choices and recommends stricter rules. Many judges and procedure scholars applaud the discretionary approach, and the Advisory Committee seems content to draft vague rules that implement it. The assumption seems to be that trial judges have the expertise and experience to do a good job of tailoring procedures to the needs of particular cases. The assumption is wrong, …

Clouds, Cameras, And Computers: The First Amendment And Networked Public Places, Timothy Zick Aug 2006

Clouds, Cameras, And Computers: The First Amendment And Networked Public Places, Timothy Zick

ExpressO

Public places are becoming highly networked environments. Municipalities are draping wireless clouds and meshes over vast public spaces, facilitating always-on internet connectivity. Surveillance cameras are now a pervasive presence in many public places. The people who gather in public and use public spaces are wearing and carrying ever more sophisticated computing devices. An integrated grid of networked connectivity is being built into traditional bricks-and-mortar public places. This Article examines the First Amendment implications of the progression toward networked public places. Wireless clouds will raise substantial property, public forum, and privacy issues. The networking of public places will also challenge traditional …
