Integrating Youth Into Community Development: Implications For Policy Planning And Program Evaluation, Rosemary V. Barnett, M A. Brennan Sep 2006

Integrating Youth Into Community Development: Implications For Policy Planning And Program Evaluation, Rosemary V. Barnett, M A. Brennan

Journal of Youth Development

As non-profits, volunteer groups, and nongovernmental organizations take on increasingly larger roles in contributing to local well-being, the active collaboration between youth and adults is vital to the long- term success of community development efforts. Similarly, as service activities become standardized components of high-school programs, youth are empowered to becoming long-term contributors to local development efforts. Through this process youth engage in shared citizenship, leading to greater investment in their communities. This research was based on the premise that youth, acting as central parts of the community development process, have the capacity to improve local well-being. It reflects input from …

Standardized Tests, Erroneous Scores, And Tort Liability, Vincent R. Johnson Sep 2006

Standardized Tests, Erroneous Scores, And Tort Liability, Vincent R. Johnson

ExpressO

Recently, there has been a vast expansion of standardized testing and of related scoring errors. For example, in October 2005, the College Board mis-scored 5,000 SAT exams. Most scores were too low by 50 to 100 points, but in some cases the deficiency was over 400 points. This is the first law review article to examine the issue of whether mis-scoring of standardized tests is actionable until traditional tort theories. The article assesses the viability of claims for fraud, negligent misrepresentation, defamation, false-light invasion of privacy, tortious interference, and injurious falsehood.

Information Privacy As A Function Of Facial Recognition Technology And Wearable Computers, Woodrow Barfield Sep 2006

Information Privacy As A Function Of Facial Recognition Technology And Wearable Computers, Woodrow Barfield

ExpressO

As technological advances are made in the design of smart sensors, the issue of privacy in public places, first discussed by Warren and Brandeis in 1890, becomes an important topic for law and policy. This paper examines issues of privacy that are impacted when an individual’s image is recorded by a video-based wearable computer, analyzed using facial recognition software, and uploaded to the internet. While the Constitutional basis of search and seizure law for individual’s placed under video surveillance is reviewed, a particular focus of the paper is on a less investigated but emerging area of concern, the video recording …

The Relation Between Punitive And Compensatory Awards: Combining Extreme Data With The Mass Of Awards, Theodore Eisenberg, Valerie P. Hans, Martin T. Wells

Cornell Law Faculty Publications

This article assesses the relation between punitive and compensatory damages by combining two data sets of extreme awards with state court data from the National Center for State Courts (NCSC) for 1992, 1996, and 2001. One data set of extreme awards consists of punitive damages awards in excess of $100 million from 1985 through 2003, gathered by Hersch and Viscusi (H-V); the other includes the National Law Journal's (NLJ) annual reports of the 100 largest trial verdicts from 2001 to 2004. The integration of these data sets provides the most comprehensive picture of punitive damages in American civil trials to …

Supporting Social And Cognitive Growth Among Disadvantaged Middle-Grades Students In Tasc After-School Projects, Christina A. Russell, Elizabeth R. Reisner Sep 2006

Supporting Social And Cognitive Growth Among Disadvantaged Middle-Grades Students In Tasc After-School Projects, Christina A. Russell, Elizabeth R. Reisner

Journal of Youth Development

The field of after-school programming remains rife with unanswered questions. What constitutes quality in after-school programs? Are after-school opportunities valuable for participants regardless of their quality? Are differences in quality associated with differences in participant benefit? This sub-study of the longitudinal evaluation of The After-School Corporation (TASC) looks at how after-school opportunities with varying features affect urban middle-grades (6-8) adolescents who live in impoverished circumstances. Supported by the William T. Grant Foundation, the study explores the associations between after-school project features and the social and cognitive outcomes of disadvantaged middle-grades participants in TASC programs. The study relies on data collected …

Re-Thinking Securities Regulation: A Comparative Study Of Asx, Nyse, And Sgx , Benedict Sheehy Sep 2006

Re-Thinking Securities Regulation: A Comparative Study Of Asx, Nyse, And Sgx , Benedict Sheehy

ExpressO

This article approaches the issue of securities regulation starting with an examination of the nature and role of markets and financial markets. It next outlines the various arguments for and against regulation, and then looks at approaches taken by markets and their regulators. The approaches are government regulation, self-regulation and co-regulation, and the structural changes via demutualization and corporate governance. With this background, it turns to examine how these approaches have played out in the markets themselves. The article surveys the regulatory aspects of the ASX, NYSE and the SGX, and reviews the regulatory and financial performance of the markets. …

Qualitative And Quantitative Assessments Of Thriving And Contribution In Early Adolescence: Findings From The 4-H Study Of Positive Youth Development, Amy Eva Alberts, Elise Didenti Christiansen, Paul Chase, Sophie Naudeau Sep 2006

Qualitative And Quantitative Assessments Of Thriving And Contribution In Early Adolescence: Findings From The 4-H Study Of Positive Youth Development, Amy Eva Alberts, Elise Didenti Christiansen, Paul Chase, Sophie Naudeau

Journal of Youth Development

Research and practice in youth development converge in an interest in positive development, or thriving. They converge also in seeking to promote among youth an orientation to act in support of their own and others’ well-being through contributions to self, family, and community. Based on the results of both qualitative (open and axial coding of parents’ and students’ answers to several open-ended questions) and quantitative analyses of data from Wave 2 (Sixth Grade; 2003-2004) of the 4-H Study of Positive Youth Development (PYD), we found that adolescents and parents define a thriving youth in different ways and, as well, that …

The Use And Misuse Of Disclosure As A Regulatory System, Paula J. Dalley Sep 2006

The Use And Misuse Of Disclosure As A Regulatory System, Paula J. Dalley

ExpressO

Over the past several decades, legislators and regulators have increasingly turned to disclosure schemes, rather than substantive regulation, to accomplish regulatory goals. Most of these schemes are either expressly or impliedly based on the disclosure-based regulatory system established by the securities acts, which is primarily intended to provide information to traders in an established market and thereby to enhance the operation of the market. A secondary purpose of the securities acts is to alter the behavior of firms and individuals through the operation of the market. Other disclosure schemes usually have similar purposes, but they rarely operate in a market …
