Fragmenting Work And Fragmenting Organizations: The Contract Of Employment And The Scope Of Labour Regulation, Judy Fudge Oct 2006

Fragmenting Work And Fragmenting Organizations: The Contract Of Employment And The Scope Of Labour Regulation, Judy Fudge

Osgoode Hall Law Journal

This article diagnoses the conceptual and normative crisis of the scope of labour protection as resulting from the conception of employment as a personal and bilateral contract between an employee and a unitary employer that is characterized by the employee's subordination. It argues that the related fragmentation of organizations and fragmentation of work reveals the extent of the problem with this legal conceptualization of employment. The article offers an approach to reconceptualizing the scope of labour protection that is based on an understanding of personal work arrangements and enterprises as activities. It justifies this approach in terms of the goals …

Institutional Oversight Of Clinical Trials And The Drug Approval Process, Paul B. Miller Oct 2006

Institutional Oversight Of Clinical Trials And The Drug Approval Process, Paul B. Miller

Osgoode Hall Law Journal

The institutional and federal bodies responsible for regulatory review and oversight of clinical trials in Canada serve distinct yet complementary functions in ensuring that clinical trials provide scientifically rigorous and ethically sound evaluation of new therapeutic products. To date, academics and reformers alike have discussed reform priorities for federal and institutional review in isolation, as if their guiding purposes are distinct. This article identifies the overlapping objectives of federal and institutional review, argues for the importance of coordination of institutional and federal oversight structures, and identifies potential points of coordination.

Department of Sociology: Faculty Publications

Problem — Various demographic and familial risk factors have been linked to runaway behavior. To date, there has not been a systematic investigation of the impact of size of community on runaway behavior. This study will compare runaways from smaller cities and rural areas to their urban counterparts.

Methods — A convenience sample of 602 adolescents was interviewed between 1995 and August of 1996 in Missouri, Iowa, Nebraska, and Kansas, USA. Multiple regression was used to examine the association between gender, neglect, sexual abuse, physical abuse, geographic and family structure change, and community size of first runaway to predict age …

The Use Of Task Based Mood-Induction Procedures To Generate High Quality Emotional Assets, Brian Vaughan, Charlie Cullen, Spyros Kousidis, Yi Wang, Ciaran Mcdonnell, Dermot Campbell

Conference papers

Detecting emotion in speech is important in advancing human-computer interaction, especially in the area of speech synthesis. This poster details experimental procedures based on Mood Induction Procedure 4, using performance related tasks to engender natural emotional responses in participants. These tasks are aided or hindered by the researcher to illicit the desired emotional response. These responses will then be recorded and their emotional content graded to form the basis of an emotional speech corpus. This corpus will then be used to develop a rule-set for basic emotional dimensions in speech.

Grey Suit Or Brown Carhartt: Narrative Transition, Relocation, And Reorientation In The Lives Of Corporate Refugees, Brian Hoey Oct 2006

Grey Suit Or Brown Carhartt: Narrative Transition, Relocation, And Reorientation In The Lives Of Corporate Refugees, Brian Hoey

Sociology and Anthropology Faculty Research

This article examines relocation stories of people who leave behind corporate work culture, relocate from metropolitan areas to small towns and rural places, and attempt to reorient themselves to work and family obligations. Decisions to start over take place within the context of moral questions about what makes a life worth living and what does not through a process in which geography has a bearing. For these migrants, a choice about where to live is also one about how to live. Choices of how to live one's life are made of more than simple economics, they are also moral. The …

Viz: A Visual Analysis Suite For Explaining Local Search Behavior, Steven Halim, Roland H. C. Yap, Hoong Chuin Lau

Research Collection School Of Computing and Information Systems

NP-hard combinatorial optimization problems are common in real life. Due to their intractability, local search algorithms are often used to solve such problems. Since these algorithms are heuristic-based, it is hard to understand how to improve or tune them. We propose an interactive visualization tool, VIZ, meant for understanding the behavior of local search. VIZ uses animation of abstract search trajectories with other visualizations which are also animated in a VCR-like fashion to graphically playback the algorithm behavior. It combines generic visualizations applicable on arbitrary algorithms with algorithm and problem specific visualizations. We use a variety of techniques such as …

Allocution And The Purposes Of Victim Participation Under The Cvra, Richard A. Bierschbach Oct 2006

Allocution And The Purposes Of Victim Participation Under The Cvra, Richard A. Bierschbach

Articles

The article examines the interpretive challenges surrounding Section 3771(a)(4) of the Crime Victims' Rights Act (CVRA) of 2004, which grants victims the right to be "reasonably heard" in certain court proceedings. The CVRA aims to integrate victims into the criminal justice system, but its ambiguous language has led to conflicting court interpretations, particularly regarding whether victims have an absolute right to speak at sentencing. The article explores the legislative intent, purposes behind the provision, and the effectiveness of victim participation mechanisms, ultimately advocating for clearer policy guidance to address these ambiguities.

Understanding Clinical Culture: Organizational Communication In The Clinical Practicum, S-A Welch Oct 2006

Understanding Clinical Culture: Organizational Communication In The Clinical Practicum, S-A Welch

Internet Journal of Allied Health Sciences and Practice

In recent years, health practitioner educators and researchers have devoted an increasing amount of attention to the improvement of communication in the clinical setting. One aspect of communication--organizational communication--occupies relatively little space in practitioner education and research. Yet, contemporary clinical practice relies heavily upon organizational structures to facilitate the coordination of care. Understandably, overcrowded practitioner curricula may not accommodate the addition of explicit pedagogical material related to organizational communication. However, clinical instructors can help students understand and integrate into the organization of the clinical setting by introducing basic concepts of organizational communication. This can be through comments and questions during …

Purpose: As the second of two papers addressing challenges in applying best evidence to physiotherapy practice (see volume 4 number 3), the purpose of this paper is to explore health and clinical reasoning models that can facilitate evidence-based practice. Summary of Key Points: The challenge and importance of using skilled clinical reasoning in applying research evidence and managing patients that fall outside the available evidence are discussed. The importance of a holistic understanding of health and illness is emphasised and three models of health and disability are considered and the concept of “hypothesis categories” is proposed to assist therapists to …

How Does A Child With Sensory Processing Problems Play?, Jeryl D. Benson, Meghana N. Nicka, Perri Stern Oct 2006

How Does A Child With Sensory Processing Problems Play?, Jeryl D. Benson, Meghana N. Nicka, Perri Stern

Internet Journal of Allied Health Sciences and Practice

The occupation of play during one’s childhood years serves as a foundation for the development of future occupations in an individual’s life. By understanding a child’s extant play skills and deficits, one may then provide the necessary interventions needed to promote development and successful growth into new occupations. The purpose of this paper was to understand how a child with sensory processing deficits plays in a naturalistic environment. The findings revealed an interplay between the child’s underlying sensory processing deficits and his play skills and behaviors. Increased understanding of how a child with sensory processing deficits plays will provide information …

Ethnographic Study Of Buddhist Education, Based On Burgess' Social Science Method At An American University And A Private Buddhist Organization, Wan-Ming Lu

Graduate Student Dissertations, Theses, Capstones, and Portfolios

The literature shows that there are many studies about Buddhism in the United States and religion on college campuses, but few studies specifically about Buddhism in American universities. The purpose of this study is to explore how American college students approach and learn about Buddhism. A qualitative research study of clinical ethnography was applied to conduct this study at the Florida International University (FIU) and Florida Buddhist Association (FBA). FBA was chosen to compare with FIU so that the features of Buddhist education at FIU would be clearer.

Eight students and four teachers (instructors) were interviewed at FIU; and two …

Child Pornography In Canada And The United States: The Myth Of Right Answers, Travis Johnson Oct 2006

Child Pornography In Canada And The United States: The Myth Of Right Answers, Travis Johnson

Dalhousie Law Journal

Child pornography is an increasing worldwide concern and is one of the most active fronts in the ongoing battle between freedom of expression and public safety and morality. In 2005, the child pornography provisions of the Canadian Criminal Code were amended in response to the controversial decision of the Supreme Court in R. v. Sharpe. Similar legislative response has occurred in the United States following the U.S. Supreme Court decision inAshcroft v. Free Speech Coalition. A comparative examination of the legislative and judicial treatments of the issue of child pornography in these countries reveals that despite reaching differing rights-balancing positions, …

Building On Strong Foundations: Rethinking Legal Education With A View To Improving Curricular Quality, Veronica Henderson Oct 2006

Building On Strong Foundations: Rethinking Legal Education With A View To Improving Curricular Quality, Veronica Henderson

Dalhousie Law Journal

Recent increases in law school tuition provide an occasion for criticalreflection on precisely what law students are being offered in their formal education. The aim of this article is to help catalyze discussion of what quality legal education entails. It begins by outlining the current underpinnings of Canadian legal education, especially the foundation of issue identification. Newer developments in legal education are also canvassed.A foundational critique is then applied to elucidate the main weakness of thepresent curricular structure: students are graduating with a flat understanding of the law Employing Dr Oliver Sacks's critique of medical education as a starting point, …

Power As A Factor In Lawyers' Ethical Deliberation, Susan Carle Oct 2006

Power As A Factor In Lawyers' Ethical Deliberation, Susan Carle

Scholarly Articles in Law Reviews & Journals

A fundamental disagreement among legal ethics scholars concerns the difference between client-centered and justice-centered approaches to lawyers' ethical obligations. Advocates of client-centered approaches put lawyers' duty to the client first. Justice-centered theorists critique the elevation of the client's interests over other important concerns lawyers affect through the work they do on behalf of clients. Scholars who adopt justice-centered approaches argue that lawyers' ethical obligations should be analyzed with a paramount focus on achieving justice. Legal ethicists often view these two approaches as inconsistent with each other, but I argue in this Article that they are not necessarily so. Building on …
