The Construction Of Pregnant Drug-Using Women As Criminal Perpetrators, Nancy D. Campbell Jan 2006

The Construction Of Pregnant Drug-Using Women As Criminal Perpetrators, Nancy D. Campbell

Fordham Urban Law Journal

Despite clear lack of intent to harm those whom they carry, drug-using pregnant women have been constructed de facto criminal perpetrators. However, drug use falls short of being prima facie evidence of intent to harm, particularly in social circumstances where drug-using economics are endemic. The cases in this article signal the limits of tolerance and the increasingly conditional nature of public welfare provision by raising the specter of a generation of urban mothers - and grandmothers - unable to care for their kids. These cases also reflect the policy-making role into which hospitals and the courts have stepped in the …

The Unbearable Lightness Of Regulatory Costs, Frank Ackerman Jan 2006

The Unbearable Lightness Of Regulatory Costs, Frank Ackerman

Fordham Urban Law Journal

The Article counters the presumption that increased environmental regulation necessarily decreases economic prosperity. It analyzes the European chemical regulatory structure and deduces that any costs imposed on the consumer are minimal, and more cost effective than watered-down American regulations covering the same subject matter with approximately the same cost imposed on the consumer-taxpayer. It argues the Office of Management and Budget and regulated industries have consistently overestimated the costs of environmental regulation and promoted the theory that environmental regulation causes factories and jobs to move offshore. It concludes that deregulation may not spur growth.

Spotlight On Inclusion: What Research And Practice Is Telling The Field, Emily C. Bouck Ph.D.

Electronic Journal for Inclusive Education

Inclusive education needs continued exploration, as current research is ambiguous. This paper presents data across three related studies regarding inclusive education for secondary students with high incidence disabilities. One study represents a survey of curriculum and instructional environments for secondary students with mild mental impairment and learning disabilities, another presents data that explored interactions across inclusive and pull-out educational settings between students with mild mental impairment and their peers and adults, and the final study explored education in pull-out educational settings for students with cross-categorical disabilities. Overall the studies revealed that inclusive education is not a clear solution and must …

Assessment Of The Technology Of Genetic Modification In Light Of Its Socio-Economic Implications, Valentina Lootens Jan 2006

Assessment Of The Technology Of Genetic Modification In Light Of Its Socio-Economic Implications, Valentina Lootens

Masters Culminating Experiences (1993-2011)

Since Watson and Crick discovered the “double helix” in 1953, the arguments about the benefits and danger of genetic modification remain largely unanswered, particularly in the relation to food supply. Today, genetic modification or genetic engineering are global issues. Governments, scientific organizations, corporations, research institutions, and scholars hotly dispute the advantages and disadvantages of GM technology. However, unfortunately, the population at large is left in darkness about this new technology and its consequences for human health, environment and society. Moreover, genetic engineering creates a special problem: unlike many new technologies it is irreversible. Once introduced into the food chain, GM …

A Duty Everlasting: The Perils Of Applying Traditional Doctrines Of Spoliation To Electronic Discovery, Michael R. Nelson, Mark H. Rosenberg

Richmond Journal of Law & Technology

Amendments to the Federal Rules of Civil Procedure regarding electronic discovery are expected to take effect on December 1, 2006. These amendments are designed to alleviate the burden, expense and uncertainty that has resulted from the application of traditional discovery principles in the electronic age. These principles worked well in an era where discovery was primarily limited to the production of paper documentation, but have proved unworkable when applied to the discovery of electronic data, particularly in the “corporate world,” where even the most routine business discussions are captured in electronic format.5

Recurrent Neural Network Based Predictions Of Elephant Migration In A South African Game Reserve, Parviz Palangpour, Ganesh K. Venayagamoorthy, Kevin Duffy Jan 2006

Recurrent Neural Network Based Predictions Of Elephant Migration In A South African Game Reserve, Parviz Palangpour, Ganesh K. Venayagamoorthy, Kevin Duffy

Electrical and Computer Engineering Faculty Research & Creative Works

A large portion of South Africa''s elephant population can be found on small wildlife reserves. When confined to enclosed reserves the elephant densities are much higher than observed in the wild. The large nutritional demands and destructive foraging behavior of elephants threaten rare species of vegetation. If conservation management is to protect threatened species of vegetation, knowing how long elephants will stay in one area of the reserve as well as which area they will move to next is essential. The goal of this study is to train a recurrent neural network (RNN) to continuously predict an elephant herd''s next …

Homocystinemia And Stroke In Vegetarians, Mohammed A. Saadah, Mona C. Thakre, Loai M. Saadah, Mahmoud E. Nazzal Jan 2006

Homocystinemia And Stroke In Vegetarians, Mohammed A. Saadah, Mona C. Thakre, Loai M. Saadah, Mahmoud E. Nazzal

Neurosciences

Homocysteine is a sulfurated amino acid with a central role in the metabolism of thiol compounds. Homocystinemia is a recognized independent potentially remediable risk factor for vascular disease. It is associated with both macro and micro vascular ischemic stroke. It can often be normalized by polyvitamin therapy. This inexpensive and well-tolerated treatment is considered effective in decreasing the incidence of stroke. We report 2 young strict vegetarians with no known vascular risk factors. The first suffered a left middle cerebral artery infarct, and the second multiple bilateral small cerebral infarctions. Extensive investigations showed moderately elevated homocysteine and low serum B12 …

Estimation Of Incident Photosynthetically Active Radiation From Moderate Resolution Imaging Spectrometer Data, Shunlin Liang, Tao Zheng, Ronggao Liu, Hongliang Fang, Si-Chee Tsay, Steven W. Running Jan 2006

Estimation Of Incident Photosynthetically Active Radiation From Moderate Resolution Imaging Spectrometer Data, Shunlin Liang, Tao Zheng, Ronggao Liu, Hongliang Fang, Si-Chee Tsay, Steven W. Running

Ecosystem and Conservation Sciences Faculty Publications

Incident photosynthetically active radiation (PAR) is a key variable needed by almost all terrestrial ecosystem models. Unfortunately, the current incident PAR products estimated from remotely sensed data at spatial and temporal resolutions are not sufficient for carbon cycle modeling and various applications. In this study, the authors develop a new method based on the look-up table approach for estimating instantaneous incident PAR from the polar-orbiting Moderate Resolution Imaging Spectrometer (MODIS) data. Since the top-of-atmosphere (TOA) radiance depends on both surface reflectance and atmospheric properties that largely determine the incident PAR, our first step is to estimate surface reflectance. The approach …

Sensitivity Of Moderate Resolution Imaging Spectroradiometer (Modis) Terrestrial Primary Production To The Accuracy Of Meteorological Reanalyses, Maosheng Zhao, Steven W. Running, Ramakrishna R. Nemani Jan 2006

Sensitivity Of Moderate Resolution Imaging Spectroradiometer (Modis) Terrestrial Primary Production To The Accuracy Of Meteorological Reanalyses, Maosheng Zhao, Steven W. Running, Ramakrishna R. Nemani

Ecosystem and Conservation Sciences Faculty Publications

The Moderate Resolution Imaging Spectroradiometer (MODIS) on board NASA's satellites, Terra and Aqua, dramatically improves our ability to accurately and continuously monitor the terrestrial biosphere. MODIS information is used to estimate global terrestrial primary production weekly and annually in near-real time at a 1-km resolution. MODIS terrestrial primary production requires daily gridded assimilation meteorological data as inputs, and the accuracy of the existing meteorological reanalysis data sets show marked differences both spatially and temporally. This study compares surface meteorological data sets from three well-documented global reanalyses, NASA Data Assimilation Office (DAO), European Centre for Medium-Range Weather Forecasts (ECMWF) (ERA-40) and …

Air Exchange Rate In A Horse Trailer During Road Transport, Joseph L. Purswell, Richard S. Gates, Laurie M. Lawrence, Jamey D. Jacob, Timothy S. Stombaugh, Robert J. Coleman

Biosystems and Agricultural Engineering Faculty Publications

Horses traveling by road commonly experience heat stress conditions and poor air quality, which may be caused by insufficient ventilation; however, there are few estimates of air exchange in a horse trailer during transport. Air exchange rate was measured at ten locations within a four-horse trailer (internal volume 18.5 m3) using tracer gas decay measurement to assess the adequacy of ventilation. Three vehicle speeds (13, 48, and 97 km h-1) and three window configurations (all windows and roof vents closed, all windows open, all windows open and roof vents open forward) were tested with and without …

Descriptive Study Of The Planning, Implementation, And Outcome Of A Parent School Involvement Program, Carol Mack

PCOM Psychology Dissertations

Research verifies a positive impact on academic achievement based upon parental involvement with children's educational needs and school programs. It takes a sense of partnership between parents and schools to achieve positive educational outcomes for children. The purpose of this study is to evaluate the development, implementation and outcome of a Parent School Involvement Project involving parent-training workshops. While no statistically significant relationship could be found between improvement in student homework completion rates and parent attendance at school-sponsored parent training workshops, parents, faculty, and administration were united in their belief that the program was a positive and promising approach to …

Causing Death For Compassionate Reasons In American Law, Richard Kay Jan 2006

Causing Death For Compassionate Reasons In American Law, Richard Kay

Faculty Articles and Papers

This essay, a revised version of the United States report on Euthanasia to be presented at the XVII International Congress of Comparative Law, surveys the state of the law, both decisional and statutory, on the permissibility of compassionately motivated actions to terminate human life. It deals with a range of legal categories: suicide, attempted suicide, euthanasia, assisted suicide and the termination of life-sustaining treatment. It highlights the deeply ambivalent attitudes held toward these actions in contemporary America and how this ambivalence has resulted in obscure and artificial distinctions.

The Role Of Expectancies In Binge Eating Behavior, Jessica Larose Jan 2006

The Role Of Expectancies In Binge Eating Behavior, Jessica Larose

Electronic Theses and Dissertations

The central aim of the present study was to examine the role of expectancies in binge eating behavior. Two distinct statistical techniques were used to accomplish this goal. First, regression analyses were conducted using variables previously identified in the literature, as well as eating expectancies as measured by the Eating Expectancy Inventory (EEI). For both females and males, regression equations including expectancies accounted for a substantial portion of the variance in binge eating behavior. Second, memory modeling techniques were used to model the probable organization of eating expectancies. Memory modeling of hypothetical expectancy networks has lead to successful interventions in …
