Candidate Quality And Voter Response In U.S. House Elections, Walter J. Stone, Nathan J. Hadley, Rolfe D. Peterson, Cherie D. Maestas, L. Sandy Maisel
Candidate Quality And Voter Response In U.S. House Elections, Walter J. Stone, Nathan J. Hadley, Rolfe D. Peterson, Cherie D. Maestas, L. Sandy Maisel
Working Papers in Economics
We propose and test the implications of a two-dimensional concept of candidate quality in U.S. House elections. Strategic quality is composed of the skills and resources necessary to wage an effective campaign; personal quality is composed of the characteristics most ordinary citizens value in their leaders and representatives, such as personal integrity and dedication to public service. We employ district informants in studies of the 1998 and 2002 congressional elections to measure these qualities in candidates, and we merge mass survey data with the district informant indicators to assess constituents’ awareness and evaluation of House candidates, and voting choice. We …

Book Review (Reviewing Petros C. Mavroidis & Alan O. Sykes, The Wto And International Trade Law: Dispute Settlement (2005)), Sungjoon Cho
All Faculty Scholarship
Professors Petros Mavroidis and Alan Sykes have produced a dependable compendium on the WTO dispute settlement system. The book consists of six parts corresponding to six critical issues in the field; namely: (1) the function of the WTO dispute settlement system, (2) the standard of review, (3) remedies, (4) participation, (5) unilateral enforcement, and (6) governance. In each part, they carefully selected representative and informative articles which offer readers perspectives that are essential to comprehend this salient and discrete disciplinary area in the study of the WTO. Notwithstanding a few weaknesses, such as limited descriptions of the “dynamic” development of …

The Seventh Circuit Turns A Blind Eye To The Playmate: The Application Of The Probate Exception After Marshall V. Marshall, Gillian Nagler
Seventh Circuit Review
The probate exception to federal jurisdiction prohibits federal courts from hearing cases involving matters related to the probate of wills or administration of estates. Though it has traditionally been applied in the context of diversity, the courts are split on its applicability in federal question cases. The decision of the United States Supreme Court in Marshall v. Marshall clarifies the scope of the exception in the context of bankruptcy proceedings, but what about its application in other federal question cases? In Jones v. Brennan, which involved a claim under 42 U.S.C. § 1983 arising out probate proceedings, the Seventh …

Stuck In Unfriendly Skies: How The Seventh Circuit’S Decision In Summers V. State Street Bank & Trust Company Left United Airlines Employees With Nothing But Hot Air, Jeffrey P. Swatzell
Seventh Circuit Review
In Summers v. State Street Bank & Trust Company, the United States Court of Appeals for the Seventh Circuit was asked whether State Street Bank & Trust Company, a directed trustee of United Airlines’ employee stock ownership plan, acted imprudently by failing to cause the plan to sell its United stock after the company suffered massive financial losses in the aftermath of the September 11, 2001 terrorist attacks. Ultimately, the court found that although State Street, as a directed trustee, was bound by certain fiduciary duties under ERISA, it did not act imprudently by continuing to follow the named …

Fact Books
I am proud to introduce the fifteenth annual Southwestern Oklahoma State University Fact Book. The Fact Book provides a ready source of information to answer frequently asked questions about the University and its operations. Unless otherwise noted, the information in this Fact Book came from computer-generated reports that are printed following the tenth class day of each fall semester. Because of student fluctuations during the semester, numbers will not match other published enrollment numbers that may be based on enrollment at the end of a semester.

The Effects Of Background Traffic On The End-To-End Delay For Video Streaming Applications Over Ieee 802.11b Wlan Networks, Nicola Cranley, Mark Davis
Conference papers
The bursty nature of video streaming applications is due to the frame-based structure of video and this has an important impact on the resource requirements of the WLAN, affecting its ability to provide Quality of Service (QoS) particularly under heavily loaded conditions. In this paper we analyse this bursty behaviour in depth. We show how each video frame is queued at the AP causing the packet delay to vary in a sawtooth manner that is related to the frame rate, the number of packets per video frame, and the packet size. We infer the maximum background traffic load that can …

Smart Growth
What local leader or public official wants to be faced with an SOS the “same old story” of public discord and confrontation over growth and development in one’s community? That situation has become a problem for efforts to promote smart growth. Investments are needed in the walkable, compact, traditional‐streetscape and mixed use neighborhoods and developments that are more sustainable and healthy than sprawl, for both people and the landscape. Yet attempts at such change all too often end up mired in costly public controversy and stalemate.

Bridging Cultural Policy And Media Policy In The U.S.: Challenges And Opportunities, Philip M. Napoli
Bridging Cultural Policy And Media Policy In The U.S.: Challenges And Opportunities, Philip M. Napoli
McGannon Center Working Paper Series
Cultural policy and media policy have remained largely distinct fields of research, policy-making, and policy advocacy in the United States. As a result, there has been relatively little cross-pollination of research findings, methodological tools, or advocacy resources and expertise. There are, however, significant areas of overlap between these two fields. Unfortunately, these areas of overlap have not been fully explored, nor have the potential benefits for researchers, policy advocates, policy-makers, of identifying, building upon, and strengthening these points of overlap been considered.
This paper provides an analytical overview of the media policy and cultural policy literatures, in an effort to …
The Pragmatic Populism Of Justice Stevens' Free Speech Jurisprudence, Gregory P. Magarian
The Pragmatic Populism Of Justice Stevens' Free Speech Jurisprudence, Gregory P. Magarian
Working Paper Series
In his three decades on the Supreme Court, Justice John Paul Stevens has developed a distinctive approach to the First Amendment. During his tenure, the Court’s majority has crystallized a theory of First Amendment speech protection as an abstract, negative protection of individual autonomy against government interference. In contrast, Justice Stevens’ pragmatic judicial methodology has caused him to place greater emphasis on free speech decisions’ practical consequences, particularly their effectiveness in making democratic debate inclusive as to both participants and subject matter in order to ensure robust, well-informed public discourse. Alone on the present Court, Justice Stevens manifests a deep …
