Taiwan's Wto Membership And Its International Implications, Steve Charnovitz Jan 2006

Taiwan's Wto Membership And Its International Implications, Steve Charnovitz

GW Law Faculty Publications & Other Works

In contrast to other international organizations, the World Trade Organization does not require its members to be states. This constitutional feature has allowed Taiwan to join the WTO alongside China. As a result, the WTO is now the only major international organization in which Taiwan can participate as a full member. This article explores some implications of this unique situation for Taiwan, for the WTO, and for international law. The article contends that Taiwan's membership in the WTO is not itself a bilateral treaty with China and does not itself change the legal relationship between Taiwan and China. What Taiwan's …

The Sarbanes-Oxley Act: Legal Implications And Research Opportunities, Lawrence A. Cunningham, Stephen Kwaku Asare, Arnold Wright

GW Law Faculty Publications & Other Works

Congress passed the Sarbanes Oxley Act to restore investor confidence, which had been deflated by massive business and audit failures, epitomized by the demise of the Enron Corporation and Arthur Anderson LLP. The Act altered the roles and responsibilities of auditors, corporate officers, audit committee members, as well as other participants in the financial reporting process. We evaluate the potential legal implications of some of the Act's major provisions and anticipate participants' likely responses. Our evaluation suggests that these provisions will significantly change behavior, increase compliance costs and alter the legal landscape. We also identify promising avenues for future research …

Public Law Values In A Privatized World, Laura T. Dickinson Jan 2006

Public Law Values In A Privatized World, Laura T. Dickinson

GW Law Faculty Publications & Other Works

Although domestic administrative law scholars have long debated privatization within the US, this debate has not confronted the growing phenomenon of privatization in the international realm or its impact on the values embodied in public international law. Yet, with both nation-states and international organizations increasingly privatizing foreign affairs functions, privatization is now as significant a phenomenon internationally as it is domestically. For example, states are turning to private actors to perform core military, foreign aid, and diplomatic functions. Military privatization entered the popular consciousness in 2004, when private contractors working for the US government abused detainees at Abu Ghraib prison …

Tracer-Test Design For Losing Stream–Aquifer Systems, Malcolm S. Field Jan 2006

Tracer-Test Design For Losing Stream–Aquifer Systems, Malcolm S. Field

International Journal of Speleology

Hydrological tracer testing is an effective way for assessing the significance and extent of leakage through the bed of an influent (losing and sinking) stream. In karstic terranes, leakage from losing and sinking streams typically resurge at downstream springs, but flow may be intercepted by production wells. Although sinking streams that disappear into swallow holes and caves are relatively easy to trace, developing a tracer test design for a losing stream that allows slow percolation through its bed is complicated by the lack of basic knowledge regarding leakage rate, leakage locations along its length, and temporal variability. To overcome these …

Emerging Policy And Practice Issues (2005), Steven L. Schooner, Christopher R. Yukins Jan 2006

Emerging Policy And Practice Issues (2005), Steven L. Schooner, Christopher R. Yukins

GW Law Faculty Publications & Other Works

This paper, presented at the West Government Contracts Year in Review Conference (covering 2005), attempts to identify the key trends and issues for 2006 in U.S. federal procurement. In an effort to make sense of the current reforms, the paper focuses upon what seems to be the common imperative underlying the various initiatives: the need to bring order to a procurement function as it devolves away from the Government user - what some might call the "devolution" or "outsourcing" of the contracting function. The paper also addresses emerging issues including, among others, the death of competitive sourcing; the acquisition workforce …

Post-Katrina Reconstruction Liability: Exposing The Inferior Risk-Bearer, Steven L. Schooner, Erin Siuda-Pfeffer Jan 2006

Post-Katrina Reconstruction Liability: Exposing The Inferior Risk-Bearer, Steven L. Schooner, Erin Siuda-Pfeffer

GW Law Faculty Publications & Other Works

This Article describes the doctrinal, functional, and moral flaws inherent in the Gulf Coast Recovery Act (GCRA), a United States Senate bill that would provide liability protection to government contractors engaged in disaster relief work in the areas devastated by Hurricane Katrina, as well as in future disaster areas. First, the Article discusses the history of the government contractor defense and finds that the protection provided by the GCRA is quite unlike the traditional government contractor defense. This Article further argues that this doctrinal departure cannot be justified on grounds of efficiency or fairness, as the GCRA allocates risk away …

Constitutional Obstacles To Regulating Violence In The Media, Catherine J. Ross Jan 2006

Constitutional Obstacles To Regulating Violence In The Media, Catherine J. Ross

GW Law Faculty Publications & Other Works

This chapter examines whether speech containing violent imagery that is made available to children can be subjected to government regulation that will survive constitutional scrutiny. The first section of this chapter reviews the general limits that the First Amendment places on the government’s power to regulate speech. The second section arguees that violent speech may not be regulated based on its content because “violence” is not one of the limited legal categories constituting “unprotected” speech, such as obscenity.

The third section examines the government’s burden to demonstrate that violent speech harms children before it can regulate such speech, and concludes …

A Case Study In Comparative Procurement Law: Assessing Uncitral's Lessons For U.S. Procurement, Christopher R. Yukins

GW Law Faculty Publications & Other Works

The United Nations Commission on International Trade Law (UNCITRAL) has commissioned a working group, with delegations from many industrialized and developing nations, to reform and update the UNCITRAL Model Law on Procurement of Goods, Construction and Services. The working group is currently reviewing reforms on a number of fronts. This essay focuses on three areas of reform in particular - electronic communications, electronic reverse auctions, and unrealistically low bidding - to gauge whether lessons from the UNCITRAL debate may be useful for reform in the U.S. procurement system. As the essay reflects, the international debate surrounding UNCITRAL reform does in …

A Study Of Factors Influencing The Occurrence Of Algae Bloom (Hab) Along The Abu Dhabi Coast, Uae., Buthaina Salem Saeed Al Qubaisi

Theses

During last few years, the frequency of Harmful Algal Bloom (HAB) has increased worldwide. The occurrence of HAB in the Gulf region has only recently been recorded in the United Arab Emirates (UAE). Specifically, these occurrences have not been thoroughly investigated. This phenomena, was found to be associated with the increase in nutrient load, depletion of oxygen and a significant decrease in fish populations that is caused by a bloom of a certain phytoplankton species, results in economic and social problems. Therefore, the Environment Agency-Abu Dhabi (EAD) has decided to conduct a study on different aspects of this phenomenon of …

A Study Of New Jersey's Assessment And Accountability System For Students With Disabilities And Its Impact On Special Education Services, Julie Moul Gardner Jan 2006

A Study Of New Jersey's Assessment And Accountability System For Students With Disabilities And Its Impact On Special Education Services, Julie Moul Gardner

Seton Hall University Dissertations and Theses (ETDs)

Use of high stakes assessment for special needs students is a key element in the current educational reform movement. State assessment systems use these tests to determine and report school accountability scores, distribute school funding, and assess school rewards and sanctions. The impact of including these students' test score on the district accountability reports has not yet been determined. Directors of special services, the primary individuals for supervising or coordinating district special education programs, have an extensive understanding of administrative and functional knowledge of special education services and are therefore able to provide insight concerning the impact of accountability on …

The Importance Of Icons For Corporate Identity For Start-Up Companies, Jillian K. Dunn Jan 2006

The Importance Of Icons For Corporate Identity For Start-Up Companies, Jillian K. Dunn

Seton Hall University Dissertations and Theses (ETDs)

The objective of this research project is to look at the importance of icons, more specifically logos, for corporate identity in start-up companies, and why these logos are such a significant factor in the marketing of a company to its consumers. A logo's main purpose is to "project the company's intended image" (First Town Company Unlimited, 2000, p.1) and if properly completed then the logo becomes a significant part of the consumer/producer relationship. "The corporate identity dates back to Ancient Greece" and "hundreds of years later, it [ still] remains the vital aspect of any organization's identity; Logos offer a …

Seton Hall University Dissertations and Theses (ETDs)

The objective of this research project is to create a communication guide for the project manager responsible for implementing a student information system on a college or university campus. The implementation of a student information system may be among the most difficult challenges that are faced in higher education due to the sensitivity of the data involved, the number of employees that will be involved in the project and the potential impact on the entire campus community. Most implementations take far greater than twelve months to complete and have been known to last for several years causing a substantial strain …

A Validation Study Of The Administrator Data Use Survey, Francis Nicholas Sheboy Jan 2006

A Validation Study Of The Administrator Data Use Survey, Francis Nicholas Sheboy

Seton Hall University Dissertations and Theses (ETDs)

The purpose of this study was to create an original instrument, the Administrator Data Use Survey (ADUS), to assess practicing school administrators' perceptions of the importance of data to school improvement, the importance of data to their position, and the degree to which they feel their graduate preparation in educational administration adequately prepared them for the data use demands of their position. Validation panels were used to assess construct, content, criterion, and face validity of the ADUS. In addition, factor analysis was utilized for construct validation. The ADUS was sent to a random sampling of practicing administrators from New York …

Buffy Never Goes In Alone: The Rhetorical Construction Of Feminism In Buffy And The Vampire Slayer's Final Season, Susan M. Payne-Mulliken, Valerie R. Renegar Jan 2006

Buffy Never Goes In Alone: The Rhetorical Construction Of Feminism In Buffy And The Vampire Slayer's Final Season, Susan M. Payne-Mulliken, Valerie R. Renegar

Iowa Journal of Communication

This essay is a rhetorical criticism of the final season of Buffy the Vampire Slayer (BtVS) and examines how metaphor is used to rhetorically construct feminist concepts. The essay specifically analyzes the metaphoric construction of the patriarchy and the feminist concept of sisterhood in the final season of BtVS. A thorough analysis reveals that the above ideas, represented via metaphor, are frequent and crucial components of the final season's plot. By using metaphor as a way to shape reality, BtVS communicates feminist ideals to its audience, thereby contributing to their overall perception of the movement.

Embracing The Imaginary Good Mother: Narratives Of Love And Violence From Women Who Killed Their Children, Barbara Barnett Jan 2006

Embracing The Imaginary Good Mother: Narratives Of Love And Violence From Women Who Killed Their Children, Barbara Barnett

Iowa Journal of Communication

Western culture positions motherhood as a divine calling, and this construct makes the notion that women would harm her children seem baffling and unnatural. This qualitative analysis of news articles seeks to understand maternal violence by analyzing narratives told by women who killed their children. Findings reveal that women who harmed their children portrayed themselves as loving and protective and dismissed their violent actions as accidents or missteps. Women understood society's expectation that mothers be all-loving and all-knowing, and internalized the good mother myth, constructing stories of themselves as caring and nurturing even when their actions were hurtful and destructive.

The Social Construction Of Wife Beating In Political Discourse, Gretchen Arnold Jan 2006

The Social Construction Of Wife Beating In Political Discourse, Gretchen Arnold

Iowa Journal of Communication

The issue of wife beating was a common topic of political discourse in 19th century America. After the turn-of-the-century, however, the issue dropped from public view and resurfaced only when contemporary feminists reframed the problem. My paper explains why this issue disappeared from, and then returned to, the political scene. I use contemporary frame analysis to analyze the specific frames to interpret wife beating that appeared in political discourse and tie them to cultural and institutional developments as well as to the work of specific social movements. in particular, I argue that the moral significance each frame gave -or denied- …

Femtosecond Laser Ablation With Single And Two-Photon Excitation For Mems, Mohamed Abdelfattah Kottb Ahmad Elbandrawy Jan 2006

Femtosecond Laser Ablation With Single And Two-Photon Excitation For Mems, Mohamed Abdelfattah Kottb Ahmad Elbandrawy

Electrical & Computer Engineering Theses & Dissertations

There is an increasing interest in femtosecond laser micromachining of materials because of the femtosecond laser's unique high peak power, ultrashort pulse width, negligible heat conductivity process during the laser pulse, and the minimal heat affected zone, which is in the same order of magnitude of the ablated submicron spot. There are some obstacles in reaching optimal and reliable micromachining parameters. One of these obstacles is the lack of understanding of the nature of the interaction and related physical processes. These processes include amorphization, melting, re-crystallization, nucleated-vaporization, and ablation.

The focus of this Dissertation was to study the laser-matter interaction …

The Depth And Breadth Of Google Scholar: An Empirical Study, Chris F. Neuhaus, Ellen E. Neuhaus, Clint Wrede, Alan Asher

Library Faculty/Staff Publications

The introduction of Google Scholar in November 2004 was accompanied by fanfare, skepticism, and numerous questions about the scope and coverage of this database. Nearly one year after its inception, many of these questions remain unanswered. This study compares the contents of 47 different databases with that of Google Scholar. Included in this investigation are tests for Google Scholar publication date and publication language bias, as well as a study of upload frequency. Tests show Google Scholar’s current strengths to be coverage of science and medical databases, open access databases, and single publisher databases. Current weaknesses include lack of coverage …

The Relationship Between Sexual Behavior And Relational Aggression In College Students, Hiliary Baethke Jan 2006

The Relationship Between Sexual Behavior And Relational Aggression In College Students, Hiliary Baethke

Dissertations and Theses @ UNI

Although the study of relational aggression has been the subject of more research since Crick and Grotpeter (1995) first defined the term, the impact of this form of aggression on college students is still an area that requires more study. Relational aggression is defined as "harming others through purposeful manipulation and damage of their peer relationships" (Crick & Grotpeter, 1995). Current research on relational aggression has established that women are more likely to engage in relational aggression then men (Crick, Bigbee, & Howes, 1996). While research has typically focused on the impact of relational aggression on friendship groups, the impact …

An Anniversary Opportunity: Digitization Of Student Yearbooks, James Lowrey, Matt Blessing

Library Faculty Research and Publications

Anniversary celebrations provide archivists and librarians with many unique opportunities to build public support for their programs. Archivists, in particular, are expected to be a resource for such events. Handled adroitly, anniversary programming can offset the “dusty shelf” stereotype that frustrates many professionals. Moreover, resource allocators planning an anniversary are likely to look to their archives for ideas and special projects, initiatives that may result in additional financial and staffing resources. Describing the positive public relations value of anniversaries, archivist Tim Ericson has gone so far as to suggest “The Archivist's First Law of Outreach”:

Human beings are unable to …

Digitization, Donor Relations, And Undergraduate Instruction, Matt Blessing Jan 2006

Digitization, Donor Relations, And Undergraduate Instruction, Matt Blessing

Library Faculty Research and Publications

Collection development archivists know that building a partnership with a potential donor may take years, occasionally decades. From the perspective of a donor, contributing unique materials to an archival repository – a local historical society, academic archives, or a research library – can be an emotionally complicated process. A donor must have acquired a degree of separation from the material, but also have a deep sense of trust in the repository soliciting the records. Often, the initial contribution to a repository consists of records void of sentimental or financial value. As the relationship between a donor and a repository strengthens, …
