Environmental Planning In Sub-Saharan Africa: Environmental Impact Assessment At The Crossroads, John O. Kakonge

Yale School of the Environment Publications Series

This paper argues that sub-Saharan African countries are at a crossroads in terms of fully adapting and benefiting from the Environmental Impact Assessment (EIA) process. It identifies a variety of issues that have hindered full utilization of the EIA process. These include limited public participation; lack of national expertise and experience in EIA; unreliable and inadequate data; limited impact coverage; defective environmental legislation; and weak enforcement. The paper concludes by highlighting various measures required to address these constraints and to reinforce the EIA process more generally. Key measures include expanding “ownership” of EIA; ensuring compliance with international agreements; improving funding …

Identifiability And Uncertainty Analysis Of Bio-Irrigation Rates, Johan H. Andersson, Jack J. Middelburg, Karline Soetaert Jan 2006

Identifiability And Uncertainty Analysis Of Bio-Irrigation Rates, Johan H. Andersson, Jack J. Middelburg, Karline Soetaert

Journal of Marine Research

Bio-irrigation is often quantified through incubations where an inert tracer is added to the overlying water of a core or a benthic chamber, and subsequently following the tracer distribution in either the overlying water or the porewater. The interpretation is based on fitting data with a model containing several unknown parameters such as the enhancement over molecular diffusion or non-local exchange. In this paper, we test under what conditions the results obtained through this fitting are robust. We first use identifiability analysis to investigate the minimum data requirements for two types of sediments, representative for deep-sea and shallow-water settings. We …

Cluster Analysis For Physical Oceanographic Data And Oceanographic Surveys In Turkish Seas, Derya Birant, Alp Kut Jan 2006

Cluster Analysis For Physical Oceanographic Data And Oceanographic Surveys In Turkish Seas, Derya Birant, Alp Kut

Journal of Marine Research

Cluster analysis is a useful data mining method to obtain detailed information on the physical state of the ocean. The primary objective of this study is the development of a new spatio-temporal density-based algorithm for clustering physical oceanographic data. This study extends the regular spatial cluster analysis to deal with spatial data at different epochs. It also presents the sensitivity of the new algorithm to different parameter settings. The purpose of the sensitivity analysis presented in this paper is to identify the response of the algorithm to variations in input parameter values and boundary conditions. In order to demonstrate the …

Magnetic And Transport Properties Of Nimnal Thin Films, Andriy Vovk, Minghui Yu, Leszek Malkinski, Charles O'Connor, Zhenjun Wang, Eden Durant, Jinke Tang, Vladimir Golub

Physics Faculty Publications

The magnetic and transport properties of Ni2MnAl thin films prepared using pulse laser deposition were investigated. It was shown that the films are granular and multiphase. Contrary to the data reported earlier we observe nonmonotonic temperature dependence of resistance with minimum in the vicinity of 100 K for the films deposited on substrates held at 773 K and negative magnetoresistance (MR) values of about 2.5% at 5 K and 1.6% at RT in magnetic field of 50 kOe. These values of MR are the highest reported up to date for Ni2MnAl films. Large negative MR in …

Modeling And Characterizations Of New Notions In Life Testing With Statistical Applications, Mohammad Sepehrifar Jan 2006

Modeling And Characterizations Of New Notions In Life Testing With Statistical Applications, Mohammad Sepehrifar

Electronic Theses and Dissertations

Knowing the class to which a life distribution belongs gives us an idea about the aging of the device or system the life distribution represents, and enables us to compare the aging properties of different systems. This research intends to establish several new nonparametric classes of life distributions defined by the concept of inactivity time of a unit with a guaranteed minimum life length. These classes play an important role in the study of reliability theory, survival analysis, maintenance policies, economics, actuarial sciences and many other applied areas.

Cognitive Errors, Individual Differences, And Paternalism, Jeffrey J. Rachlinski Jan 2006

Cognitive Errors, Individual Differences, And Paternalism, Jeffrey J. Rachlinski

University of Chicago Law Review

Legal scholars commonly argue that the widespread presence of cognitive errors in judgment justifies legal intervention to save people from predictable mistakes. Such arguments often fail to account for individual variation in the commission of such errors even though individual variation is probably common. If predictable groups of people avoid making the errors that others commit, then law should account for such differences because those who avoid errors will not benefit from paternalistic interventions and indeed may be harmed by them. The research on individual variation suggests three parameters that might distinguish people who can avoid error: cognitive ability, experience …

Survey Says ... A Critical Analysis Of The New Title Ix Policy And A Proposal For Reform, Erin E. Buzuvis Jan 2006

Survey Says ... A Critical Analysis Of The New Title Ix Policy And A Proposal For Reform, Erin E. Buzuvis

Faculty Scholarship

More than thirty years have passed since Congress enacted Title IX, the statute prohibiting sex discrimination by schools, colleges, and universities that receive federal funding. In that time, Congress has confirmed -and reconfirmed- the statute's application to college athletic programs, and the Supreme Court has strengthened the statute's enforcement by construing a private right of action for both injunctive relief and, in certain cases, money damages. Bolstered by these measures, Title IX is duly credited for increasing the number of athletic opportunities for women and girls. But at the college level, female athletes still have far fewer opportunities to participate …

Maldi-Tof Baseline Drift Removal Using Stochastic Bernstein Approximation, Joseph Kolibal, Daniel Howard Jan 2006

Maldi-Tof Baseline Drift Removal Using Stochastic Bernstein Approximation, Joseph Kolibal, Daniel Howard

Faculty Publications

Stochastic Bernstein (SB) approximation can tackle the problem of baseline drift correction of instrumentation data. This is demonstrated for spectral data: matrix-assisted laser desorption/ionization time-of-flight mass spectrometry (MALDI-TOF) data. Two SB schemes for removing the baseline drift are presented: iterative and direct. Following an explanation of the origin of the MALDI-TOF baseline drift that sheds light on the inherent difficulty of its removal by chemical means, SB baseline drift removal is illustrated for both proteomics and genomics MALDI-TOF data sets. SB is an elegant signal processing method to obtain a numerically straightforward baseline shift removal method as it includes a …

A Simplified Introduction To Legal Argument, Lee E. Teitelbaum, Wayne Mccormack Jan 2006

A Simplified Introduction To Legal Argument, Lee E. Teitelbaum, Wayne Mccormack

Utah Law Review

Constitutional law, therefore, makes frequent explicit use of techniques that are more often implicit in most areas of law. The basic process of reasoning, however, remains the same. And the debate over positivism, the degree to which judges can and should make new law, is really the same; it just has more vigor in constitutional law because of the visibility of its operation.

The Role Of Rules In Antitrust Analysis, John J. Flynn Jan 2006

The Role Of Rules In Antitrust Analysis, John J. Flynn

Utah Law Review

The analysis of antitrust issues is captured from time to time by rigid rules comprised of fixed concepts that are deductively applied to pre-ordained facts in disputes deemed subject to the antitrust laws. The rules are characterized by narrow assumptions of what will be permitted to be facts, by concepts that are fixed in concrete by rigid definitions, and by unstated normative assumptions underlying the rules and concepts. Calcification of concepts sets in and mumpsimus becomes the distinguishing characteristic of defenders of the periodic status quo generated by the antitrust less fashionable at one time or another. The mechanical jurisprudence …

Articulating Trade-Offs: The Political Economy Of State Action Immunity, Hillary Greene Jan 2006

Articulating Trade-Offs: The Political Economy Of State Action Immunity, Hillary Greene

Utah Law Review

Antitrust uses economic analysis to assess various trade-offs involving efficiency. Even assuming that a competition matter implicates purely economic matters it can be exceedingly difficult to determine and measure all the relevant factors, assign them proper weights, decide on the appropriate time frames, assess the pertinent interactions, and conduct the trade-off calculations. Not surprisingly, different members of the antitrust community often take vastly differing positions regarding the economic consequences of a particular antitrust doctrine as well as the significance of those consequences. When potentially anticompetitive conduct occurs in the context of state regulation, the challenge to achieving a sensible accommodation …

The Americans With Disabilities Act And How It Affects Post-Secondary Education, Annette Louise Beck Jan 2006

The Americans With Disabilities Act And How It Affects Post-Secondary Education, Annette Louise Beck

Graduate Research Papers

The Americans with Disabilities Act and how it affects post-secondary education is what this literature review addresses. The Americans with Disabilities Act of 1990 (ADA) prohibits discrimination against someone with a disability in places of employment and public places. In 1973, the United States Congress passed Section 504 and The Individuals with Disabilities Education Act (IDEA) was passed in 1990. Both helped solidify regulations regarding discrimination by any entity that receives federal funding including educational institutions. The law requires employers or schools to make a change or adjustment in a work or educational setting, program, or job that makes it …
