This Article provides a survey of death penalty case law in Georgia from June 1, 2005 through May 31, 2006. The cases include those that the Georgia Supreme Court heard on interim appeal, direct appeal, and on review of habeas corpus decisions. Two recent decisions of the United States Supreme Court are also included because of their relevance to Georgia death penalty law. While there have been recent significant statutory changes affecting capital litigation in Georgia, those changes are beyond the purview of this Article and therefore will not be discussed. There was minimal legislation during the 2006 term of the Georgia General Assembly that impacted workers' compensation. In fact, most of the legislative changes could be characterized as general housekeeping measures. For example, Official Code of Georgia Annotated ("O.C.G.A.") section 34-9-104 was changed to make its wording consistent with that found in other sections of the Workers' Compensation Act. The mandate that the employee shall receive notice from the employer was changed to provide that the employer shall send notice to the employee. The time limit for submitting mileage expenses was clarified as running one year from the date that …

Despite thoughtful attempts by Douglas Davies to situate death at the center of the Mormon “culture of salvation,” the exploration of death in early Mormonism has been somewhat limited to date, particularly as it relates to the Smith family and the earliest years of Mormonism. Family caregivers, the "second victims" or hidden patients in dementia care, are at risk for social isolation, stress, depression, and mortality. Telephone-based support (telesupport groups) represents a practical, low-burden, low-cost source of emotional support. The present study evaluated the feasibility and effectiveness of professionally led telephone-based support groups for female family caregivers of community-dwelling dementia patients. Recruited through various community sources, 103 female caregivers were randomized to the telesupport group treatment or a control condition. Effects on caregiver burden, depression, and personal gains were evaluated at 6 months, the main end point. Older caregivers (≥65) in telesupport reported lower depression …

Lipid droplet proteins of the PAT (perilipin, adipophilin, and TIP47) family regulate cellular neutral lipid stores. We have studied a new member of this family, PAT-1, and found that it is expressed in highly oxidative tissues. We refer to this protein as "OXPAT." Physiologic lipid loading of mouse liver by fasting enriches OXPAT in the lipid droplet tissue fraction. OXPAT resides on lipid droplets with the PAT protein adipophilin in primary cardiomyocytes. Ectopic expression of OXPAT promotes fatty acid-induced triacylglycerol accumulation, long-chain fatty acid oxidation, and mRNAs associated with oxidative metabolism. Hand grip strength measurement is a recognized part of hand function assessment. The standard measurement using the Jamar dynamometer and comparing these results to the recommended normal values suggested by the manufacturers of the Jamar was questioned as these values were based on Western population. A study comparing a novel method of predicting grip strength using our software was conducted on 25 normal subjects using the LIDO kinetic workset (Group A and B ). Signed General Releases May Be Worth Less Than Employers Expected: Circuits Split On Whether Former Employee Can Sign Release, Reap Its Benefit, And Sue For Fmla Claim Anyway, Muniza Bawaney

A circuit split has recently developed regarding the correct interpretation of 29 C.F.R. § 825.220(d), a regulation issued pursuant to the Family and Medical Leave Act of 1993, which states in pertinent part, "Employees cannot waive, nor may employers induce employees to waive, their rights under FMLA." The Fifth Circuit correctly concluded that 29 C.F.R. § 825.220(d) bars only the prospective waiver of substantive rights under the FMLA and does not reach the post-dispute release or settlement of FMLA claims. It is this gene expression rather than genome itself that is responsible for most of the reactions taking place within a cell. Sleep is a vital, highly organized process regulated by complex systems of neuronal networks and neurotransmitters. Sleep plays an important role in the regulation of central nervous system and body physiologic functions. Sleep architecture changes with age and is easily susceptible to external and internal disruption. Reduction or disruption of sleep can affect numerous functions varying from thermoregulation to learning and memory during the waking state.

The present study examined whether adult women in therapy who have been physically abused express anger differently than their counterparts who have been sexually abused, and whether they are aware that they express anger in noticeable ways. The first hypothesis stated that physically abused women express anger directly and physically, whereas sexually abused women express anger indirectly, avoiding direct confrontation. The second hypothesis proposed that they are not aware how much they express their anger outwardly. Participants were female clients at a local counseling agency, with issues stemming from physical and/or sexual abuse. They voluntarily completed the Aggression Questionnaire (AQ) …

An investigation on student nurses' expectation on mentors was probed into the roles and functions of mentor in nursing education. All student nurses in nursing school filled out the questionnaire, and there were 173 available samples. In general, these students were in great need of a mentor. Results indicate that more than 60% of the students want their mentors to offer counseling related to school work, adjustment of living, scholarship application, students' activities, personal and confidential communication, social skills, emotional support, intimacy skills and preparation for future employment. 國家倫理委員會(national ethics committee)在歐美先進國家之設置與發展已有相當之時日,近年來部分亞洲國家亦開始積極投入,本文回顧各國國家倫理委員會之發展現況,包括美國、英國、德國、荷蘭、法國、丹麥、瑞典、芬蘭、日本、新加坡、南韓,並綜合各國之發展經驗,分析國家倫理委員會之運作模式、功能任務、研討議題等,最後簡介我國已設立之相關委員會。相較之下,我國國家倫理委員會之發展尚屬起步階段,宜吸取先進國家之發展經驗、規劃出適合我國發展之策略,以面對時代之挑戰。

台北榮民總醫院臨床技術訓練中心(以下簡稱本中心)於2003年2月19日正式開幕運作,至今已逾3年。在籌備、啟用,以及持續運作的幾個階段中經歷了不少障礙與困難,從而獲得一些經驗和心得,特記述於本文與同好分享。在本中心規劃籌建的過程中,首先要預估未來需要的課程,據以尋找空間、規劃間隔、廣徵人才及購買設備等,都必須具有充分的前瞻性,由於當時國內醫學教育機構尚未有可供參考的典範,故曾派員到英國利物浦大學參訪,並以其臨床技術資源中心作為設計藍圖。在人員編制方面,本中心自始即編列三位全職且在急救加護護理具有多年經驗的護理師,負責行政策劃、參與教學及課程研發等任務,確保「永續經營」的方針。空間應用則是採用多功能、人性化及便於變通的原則,以達到「地盡其利」的目標。在作業規範中對於場地及設施的使用、管理及維護均訂定詳細的規範,以期能提供「溫馨友善的學習環境」。由於本中心人員身兼行政、教學及研發等多重任務,故人員在職訓練亦成為本中心營運及發展計畫的主要部分。除人員須不斷學習之外,本中心執行之各項課程亦有持續改進的機制。
