After Basic Mindfulness Mediation: External Mindfulness, Emotional Truthfulness, And Lie Detection In Dispute Resolution, Clark Freshman
After Basic Mindfulness Mediation: External Mindfulness, Emotional Truthfulness, And Lie Detection In Dispute Resolution, Clark Freshman
Journal of Dispute Resolution
Some years ago, our mutual friend, Carrie Menkel-Meadow, suggested Len Riskin and I talk about our shared interest in mindfulness meditation and negotiation. At the time, I had students sit quietly, eyes closed, get in touch with what was going on before a negotiation, write it out, and then crumple up the paper. It was a primitive form of meditation and journaling and, as I look back through research, not a very sound theoretical or empirically-supported way to help.' Eventually, mindfulness meditation and practices helped move me from my very primitive attempts at mindfulness to a very rich practice that …
Courts Have The Final Say: Does The Doctrine Of Manifest Disregard Promote Lawful Arbitral Awards Or Disguise Unlawful Judicial Review, Lindsay Biesterfeld
Courts Have The Final Say: Does The Doctrine Of Manifest Disregard Promote Lawful Arbitral Awards Or Disguise Unlawful Judicial Review, Lindsay Biesterfeld
Journal of Dispute Resolution
In exchange for a speedy, economical dispute resolution process, parties that submit to binding arbitration assume the risk that an arbitrator might misapply the law. United States Supreme Court precedent and federal law favor agreements to arbitrate by limiting judicial review of arbitral awards and requiring courts to "rigorously enforce arbitration agreements." These judicial constraints support the arbitral goals of efficiency and finality by reducing the risk that arbitral awards will be vacated on appeal. To balance the risk that arbitrators may abuse this standard of review, courts have supplemented restricted judicial review with a doctrine that allows an arbitral …

Endoscopic Sphincterotomy With Or Without Cholecystectomy For Choledocholithiasis In High Risk Surgical Patients: A Decision Analysis, Ali Siddiqui, Pradnya Mitroo, Thomas E. Kowalski, David Loren
Department of Medicine Faculty Papers
Background
Laparoscopic cholecystectomy (LC) is recommended for patients with choledocholithiasis after ERCP with sphincterotomy (ES) and stone extraction.
Aim: We designed a decision model to address whether ES alone versus ES followed by LC (ES + LC) is the optimal treatment in high-risk patients with choledocholithiasis.
Methods:
Our cohort were patients with obstructive jaundice who have undergone an ES with biliary clearance. Recurrent biliary complications over a 2-year period stratified by gallbladder status (in/out) and age-stratified surgical complication rates were obtained from the literature. Failure of therapy was defined as either recurrent symptoms or death attributed to biliary complications.

Fuzzy Cognitive Maps For Engineering And Technology Management: What Works In Practice?, Antonie J. Jetter
Fuzzy Cognitive Maps For Engineering And Technology Management: What Works In Practice?, Antonie J. Jetter
Engineering and Technology Management Faculty Publications and Presentations
Due to a lack of available data, many early planning decisions in engineering and technology management have to be based on experts' opinions and their qualitative statements about evolving technologies, markets and general business environments. Several authors have suggested the use of fuzzy cognitive maps (FCMs) to analytically support these decisions with simulation models that can cope with qualitative information. However, only little practice experience is documented. Based on multiple case studies and an extensive literature review, the paper reviews the state-of-the-art of FCM-practice and introduces a six-step guideline for practitioners and researchers who wish to apply FCMs to real-world …

In order to cause the disease anthrax, Bacillus anthracis requires two plasmids, pX01 and pX02, which carry toxin and capsule genes, respectively, that are used as genetic targets in the laboratory detection of the bacterium. Clinical, forensic, and environmental samples that test positive by PCR protocols established by the Centers for Disease Control and Prevention for B. anthracis are considered to be potentially B. anthracis until confirmed by culture and a secondary battery of tests. We report the presence of 10 genes (acpA, capA, capB, capC, capR, capD, IS1627, ORF 48, ORF 61, and repA) and the sequence for the …

Challenges In Applying Best Evidence To Physiotherapy, Mark Jones, Karen Grimmer, Ian Edwards, Joy Higgs, Franziska Trede
Internet Journal of Allied Health Sciences and Practice
Purpose: As the first of two papers addressing challenges in applying best evidence to physiotherapy practice, this paper highlights the role of qualitative research and challenges researchers face in producing sound evidence for practice.Summary of Key Points: The challenge of what constitutes acceptable evidence to inform evidence-based practice is addressed in this paper with critique of the current over-reliance on quantitative methodologies that excludes a substantial body of valuable qualitative evidence to support sound practice. The current trend of relying on questionnaires to obtain psychosocial data is challenged on the basis of limitations of research design. Challenges to researchers from …

Does A Specialist Parasitoid Adapt To Its Host On A New Host Plant?, A. Roßbach, B. Löhr, S. Vidal
All Peer-Reviewed Publications
The host plant expansion of a diamondback moth, Plutella xylostella (L.) (DBM) strain to snowpea (Pisum sativum L.) raised the question whether a specialist parasitoid Diadegma semiclausum (DS) could be conditioned to locate and parasitize its host on the new host plant. In a specialist parasitoid a behavioural change towards a plant outside the normal host plant range of its host due to developmental experience is not expected. The responsive behaviour, parasitism rates and fitness of three subsequent DS generations were investigated on the snowpea-strain of DBM. After three generations of DS on the pea 62.5% of females chose an …

About half of 2,581 low-income mothers reported reading daily to their children. At 14 months, the odds of reading daily increased by the child being fi rstborn or female. At 24 and 36 months, these odds increased by maternal verbal ability or education and by the child being fi rstborn or of Early Head Start status. White mothers read more than did Hispanic or African American mothers. For English-speaking children, concurrent reading was associated with vocabulary and comprehension at 14 months, and with vocabulary and cognitive development at 24 months. A pattern of daily reading over the 3 data points …

The National Science Education Standards recommend that science be taught using inquiry-based approaches. Inspired by the Dana Alliance for Brain Initiatives, we examined whether undergraduate students could learn how to conduct field research by teaching elementary school children basic neuroscience concepts in interactive workshops. In an inquiry-based learning experience of their own, undergraduate psychology students working under the close supervision of their instructor designed and provided free, interactive, hour-long workshops focusing on brain structure and function, brain damage and disorders, perception and illusions, and drugs and hormones to fifth-graders from diverse backgrounds, and we assessed the effectiveness of the workshops …
The Nature Of Genetic Engineering And The Uses And Potential Abuses Of Biotechnology, Seth J. Matton
The Nature Of Genetic Engineering And The Uses And Potential Abuses Of Biotechnology, Seth J. Matton
Honors Scholar Theses
Over the past decade the topic of genetic engineering has been has been readily debated in the media, but often these debates consist of political rhetoric and fail to offer objective information on the methods and the potential benefits to human health and their environment. In truth, humans have been manipulating the genomes of organisms for thousands of years, and it has been an evolution of scientific knowledge that has led to the more precise methods of genetic engineering. This paper discusses how scientists utilize natural processes to alter the genetic constituents of both prokaryotic and eukaryotic organisms, benefits to …
An Operational Model For Mobile Sensor Cloud Management, Indrajeet Kalyankar
An Operational Model For Mobile Sensor Cloud Management, Indrajeet Kalyankar
Electrical & Computer Engineering Theses & Dissertations
Mobile sensors provide a safe, cost effective method for gathering information in hazardous environments. When the hazardous environment is either unexplored, such as the surface of Mars, or unanticipated, such as the result of chemical contamination, it is desirable for a system to gather information with a minimal amount of outside control (localization, decision control, etc.) and prepositioned sensors. If one takes a look at the number of the sensors deployed on a scale, at the lower end is the sole, multipurpose sensor unit. The upper end deals with hordes of inexpensive, expendable sensors. In the middle, a cluster of …

Coordination Environment: A New Approach To The Sensing Of Lead (Ii) Itself, Kristina Marie Nespechal
Coordination Environment: A New Approach To The Sensing Of Lead (Ii) Itself, Kristina Marie Nespechal
Masters Theses
Lead(II) is a silent poison that has plagued society since 3800 B. C. The average intake of lead in the United States alone is 50 μg per day, which is approximately 100-1000 times greater than that of prehistoric lead levels. Regardless of the banning of lead in paints and gasoline, lead poisoning prevails as a major environmental health risk. Science has the ability to address the concern with this environmental contaminant. The future production of an economical and reliable test kit for lead(II) relies on the luminescence of the heavy metal itself.

First-Year Student Retention And Achievement: The Influence Of Diversity And Background Characteristics, Krystall Dunaway
Psychology Theses & Dissertations
The racial climate of a campus can be either prejudicial or cooperative, and is directly affected by the frequency and profoundness of diverse interactions (Antonio, 2001); the greater the number and meaningfulness of diverse interactions, the more positive the campus climate. When related to Tinto's Student Departure Theory (1993), it is not difficult to deduce that the more comfortable and satisfied a student feels with the diversity climate on campus, the more likely he or she is to feel integrated, thus to maintain his or her student status at that university and also to perform well academically. Conversely, incongruence, or …
