Carbon Dioxide And The Clean Air Act, Eric Schwartz
Carbon Dioxide And The Clean Air Act, Eric Schwartz
Cardozo Public Law, Policy & Ethics Journal
The EPA's authority to regulate CO2 under the Clean Air Act is supported by the statute's broad definition of "air pollutant" and judicial interpretations, including the Supreme Court's decision in Massachusetts v. EPA. The agency's initial reluctance to regulate CO2 was based on policy considerations, not legal limitations, and the Chevron doctrine requires courts to defer to the EPA's interpretation when Congress's intent is unclear. The ruling in Massachusetts v. EPA established that states have standing to challenge the EPA's failure to regulate CO2, emphasizing the importance of federal authority in addressing climate change. This decision has significant implications …
Civil Commitment Of Sexually Violent Predators: The Search For A Limiting Principle, Aman Ahluwalia
Civil Commitment Of Sexually Violent Predators: The Search For A Limiting Principle, Aman Ahluwalia
Cardozo Public Law, Policy & Ethics Journal
The article challenges the legal and empirical justifications for civil commitment of sexually violent predators, arguing that current standards, such as mental abnormality and lack of control, are overly broad and lack robust empirical support. It contends that recidivism rates for sex offenders are not significantly higher than those of other offenders, undermining the rationale for civil commitment. The analysis advocates for a more nuanced approach to incapacitation, emphasizing criminal law solutions over medicalized commitments.
Media Influence And The Modern American Democracy: Why The First Amendment Compels Regulation Of Media Ownership, Sean Michael Mcguire
Media Influence And The Modern American Democracy: Why The First Amendment Compels Regulation Of Media Ownership, Sean Michael Mcguire
Cardozo Public Law, Policy & Ethics Journal
The article argues that the First Amendment necessitates government regulation of media ownership to safeguard democracy. It posits that while the First Amendment initially protected against government interference, evolving societal and technological changes require active regulation to ensure a diverse "marketplace of ideas." The author contends that without such regulation, media consolidation leads to a decline in viewpoint diversity, diminished content quality, and undue corporate influence, undermining democratic discourse.

Influences Of Watershed Urban Development On Habitat Heterogeneity And Native Fish Diversity In A Ridge And Valley Stream In Southeastern Tennessee, Nicholas B. Cookson
Influences Of Watershed Urban Development On Habitat Heterogeneity And Native Fish Diversity In A Ridge And Valley Stream In Southeastern Tennessee, Nicholas B. Cookson
Masters Theses and Doctoral Dissertations
The present study examined relationships of landscape features with instream environmental conditions and fish assemblage attributes in a third-order Ridge and Valley stream in the Chattanooga, Tennessee area. Stream water quality, habitat, and fish assemblages were sampled in May-June 2005 at seven sites (drainage areas <17 km2) in the Mountain Creek system (Tennessee River drainage). Watershed urban land use (predominantly residential) ranged from 1.62 % to 18.97 % and housing density from 49 housing units/km2 to 72 housing units/km2. Natural riparian land cover at the sites ranged from 26.9 % to 53.1 %. A total of22 species offish and 3,686 individuals was found at the seven sites. Native species richness per drainage area ranged from 0.12 species/km2 to 1.15 species/km2 at the individual sites. Species evenness ranged from 0.56 to 0.79. Index of biotic integrity ratings varied from poor to good. Watershed urban land use was negatively correlated with species richness, species evenness, variation in stream shape, and variation in current velocity. Housing density in the watershed was positively correlated with sediment depth and negatively correlated with species richness, substrate diversity, and variation in stream shape. Riparian natural cover was positively correlated with variation in current velocity. Results of this study emphasize the negative influence of watershed residential land use on stream habitat heterogeneity and native fish diversity.

Current Status Of Child Sexual Abuse In Chattanooga, Tn As Reflected In Treatment And Legal Systems: A View From The Experts, Julie F. Joy
Masters Theses and Doctoral Dissertations
Child sexual abuse, a horrific and damaging crime against the most vulnerable of human beings, is decried by major religions and cultures around the world. And yet, it is flourishing today in various forms within every major society. Empirical research has been conducted in the areas of treatment and legal issues for victims of child sexual abuse. This research indicates a dichotomy of advocates in treatment systems and skeptics in legal systems that could conflict with each other in providing treatment and justice to abuse victims. This study offers a view of the status of child sexual abuse in one …

Immunological Diagnosis Of Vasculitis, Khalil Abdul-Aziz, Abdul-Aziz Faizal
Immunological Diagnosis Of Vasculitis, Khalil Abdul-Aziz, Abdul-Aziz Faizal
Saudi Medical Journal
Inflammation of blood vessels, or vasculitis, is caused by a heterogenous group of autoimmune conditions with wide spectrum of systemic, and often overlapping, clinical manifestations. Some of these conditions present acutely and result in major organ9s damage and, therefore, require prompt diagnosis and treatment in order to avoid the high morbidity and mortality that otherwise occur. The clinical immunology laboratory plays a vital role in the diagnosis of vasculitis. Moreover, due to the availability of simple tests, with quick turn around time, immunological findings can provide an early picture of the type of vasculitis involved thereby allowing initiation of prompt …

Successful Use Of Non-Invasive Positive Pressure Ventilation In A Complicated Flail Chest, Mariam A. Al-Ansari
Successful Use Of Non-Invasive Positive Pressure Ventilation In A Complicated Flail Chest, Mariam A. Al-Ansari
Saudi Medical Journal
The current advanced trauma life support manual states that patients with significant hypoxia namely, SaO2 <90% on room air as a result of pulmonary contusion should be intubated and ventilated within the first hour of injury. Recently, several researchers have shown improved outcomes when patients with acute respiratory failure are managed with non-invasive positive pressure ventilation NIPPV. Trauma patients may also benefit from this therapy. We report a case of 15-year-old boy with isolated flail chest and pulmonary contusion, who was intubated in the emergency room, and was managed successfully with the NIPPV in the intensive care unit ICU despite, having had aspiration pneumonia early in the course of his stay. After initial stabilization, he failed a spontaneous breathing trial. Due to absence of contraindications to the use of NIPPV, the patient was extubated on day 7 from pressure support ventilation of 15 cmH2O and positive end expiratory pressure of 8 cmH2O to immediate NIPPV use. Three days later after a total of 50 hours of NIPPV use in the ICU the patient was successfully discharged home.

Neoliberalism, Hegemony And Community Imaginings, Boone W. Shear
Neoliberalism, Hegemony And Community Imaginings, Boone W. Shear
Masters Theses
The idea of "community" evokes many long held, positive imaginings. Community implies neighborliness, togetherness, helping each other, tolerance and understanding. Community is set against modem society and is commonly understood to be a solution to the deleterious impacts of capitalism and the state. Although community can be a site of resistance, I am also interested in the ways in which the ideology of community assists in facilitating capitalist inequalities.
The latter part of the twentieth-century saw a significant restructuring of capital in the United States as privatization and deregulation were accompanied by a decline in the welfare state. These efforts …
Examining The Structural Covariates Of Methamphetamine Use: A Social Disorganization Perspective, Justin Smith
Examining The Structural Covariates Of Methamphetamine Use: A Social Disorganization Perspective, Justin Smith
Masters Theses
There have been many anecdotal accounts describing the characteristics of individuals involved in methamphetamine use, trafficking and production. However, prior to the current study there was yet to be a macro-level analysis of methamphetamine use. The extant macro-level literature on drug use has suggested that areas with high levels of social disorganization experience high rates of drug use. It was expected that school-districts with low SES and high rates of ethnic heterogeneity, residential instability and family disruption will experience high rates of methamphetamine use. In addition, it was expected that rural school districts would show higher rates than urban and …

Baylisascaris Procyonis (Nematoda: Ascaridoidea) In Raccoons (Procyon Lotor) From Duval County, Texas, David B. Long, Tyler A. Campbell, Scott E. Henke
United States Department of Agriculture Wildlife Services: Staff Publications
Baylisascaris procyonis, or the raccoon roundworm, primarily utilizes the raccoon as its definitive host, and has been found in >90 species of North American animal intermediate hosts (mostly birds, lagomorphs, and rodents) (Kazacos 2001). In non-raccoon hosts, including humans, larvae of this parasitic nematode can cause severe neurological disease (cerebrospinal nematodiasis) and often damage visceral and ocular tissues (Kazacos 2001). Formerly, B. procyonis was not thought to occur in Texas (Chandler 1942; Schaffer et al. 1981). However, it was recently discovered in raccoons occurring in moist environments of coastal areas (Kerr et al. 1997) and in eastern portions of …
