Democracy And Tort Reform In The U.S.A., Christopher J. Roederer
Democracy And Tort Reform In The U.S.A., Christopher J. Roederer
ExpressO
Democracy in the United States of America is in decline. In much the same way that progressive tort reform was made possible by democratic gains since the 1950s, the current tort retrenchment has been made possible by our democratic losses since the 1980s. Just as tort reform in the 1960s and 1970s helped consolidate and protect our democratic gains, the tort “reforms” from the 1980s to the present have helped further consolidate and protect our rising plutocracy. After a brief introduction setting the stage in broad stroke for the argument that follows, part II draws on recent literature in the …
Airlaunch’S Quickreach™ Small Launch Vehicle: Operationally Responsive Access To Space, Debra Facktor Lepore, Joseph Padavano
Airlaunch’S Quickreach™ Small Launch Vehicle: Operationally Responsive Access To Space, Debra Facktor Lepore, Joseph Padavano
Small Satellite Conference
AirLaunch LLC is developing the QuickReach™ booster under the DARPA/Air Force Falcon small launch vehicle program. Valued at $17.8 million for a one-year effort, the Falcon Phase 2B contract activity enables AirLaunch and its team of subcontractors to continue developing the QuickReach™ small satellite booster. The Falcon program goal is to develop a vehicle that can launch 1,000 pounds to Low Earth Orbit for less than $5 million with only 24 hours notice. AirLaunch’s design achieves responsiveness by carrying its QuickReach™ booster to altitude inside the cargo bay of an unmodified C-17A or other large cargo aircraft. In 2005, Team …
Financial Accounting And Corporate Behavior, David I. Walker
Financial Accounting And Corporate Behavior, David I. Walker
ExpressO
The power of financial accounting to shape corporate behavior is underappreciated. Positive accounting theory teaches that even cosmetic changes in reported earnings can affect share value, not because market participants are unable to see through such changes to the underlying fundamentals, but because of implicit or explicit contracts that are based on reported earnings and transaction costs. However, agency theory suggests that accounting choices and corporate responses to accounting standard changes will not necessarily be those that maximize share value. For a number of reasons, including the fact that executive compensation often is tied to reported earnings, managerial preferences for …
Would Banning Firearms Reduce Murder And Suicide? A Review Of International Evidence, Gary A. Mauser, Don B. Kates
Would Banning Firearms Reduce Murder And Suicide? A Review Of International Evidence, Gary A. Mauser, Don B. Kates
ExpressO
The world abounds in instruments with which people can kill each other. Is the widespread availability of one of these instruments, firearms, a crucial determinant of the incidence of murder? Or do patterns of murder and/or violent crime reflect basic socio-economic and/or cultural factors to which the mere availability of one particular form of weaponry is irrelevant?
This article examines a broad range of international data that bear on two distinct but interrelated questions: first, whether widespread firearm access is an important contributing factor in murder and/or suicide, and second, whether the introduction of laws that restrict general access to …
Sherman's March (In)To The Sea, Andrew S. Oldham
Sherman's March (In)To The Sea, Andrew S. Oldham
ExpressO
This Article argues that the Sherman Act is unconstitutional. At the very least, scholars and jurists must not take for granted Congress's ability to statutorily deputize the federal courts with common-lawmaking powers. The federal antitrust statute—which has been described as the Magna Carta of free enterprise—raises serious constitutional questions that have heretofore gone unexplored and unanswered. Specifically, it is difficult (if not impossible) to reconcile the Sherman Act with the separation of powers, the nondelegation doctrine, and the Supremacy Clause.
Implications Of Internet Protocol On Leo Micro-Satellite Communication Links, Keith Nicewarner
Implications Of Internet Protocol On Leo Micro-Satellite Communication Links, Keith Nicewarner
Small Satellite Conference
Internet Protocol (IP) enables a session-based communication paradigm that is transaction-oriented rather than data stream-centric. This is a paradigm that is prevalent in ground systems (and arguably a significant factor in the success of the Internet), but is uncommon in space systems – even ones that have used IP. IP allows multiple, simultaneous, independent sessions over the same channel. This allows software that uses the space link to be written in a more modular and easily testable manner. It also allows commercial IP-based technology to be used independently of the application-specific software. For instance, a telnet session to the spacecraft …
India: Grassroots Hiv/Aids Activism Growing, Manju Parikh
India: Grassroots Hiv/Aids Activism Growing, Manju Parikh
Political Science Faculty Publications
In the last ten years, we have seen frequent news reports on the spread of the HIV/AIDS virus in the Indian subcontinent, each one stressing the dire economic and social consequences if urgent attention is not paid to the problem. Although the Indian government has responded by adopting many policies and by establishing an organization — the National Aids Control Organization (NACO) — to deal specifically with HIV awareness, treatment for HIV infected individuals, and prevention of further spread of HIV/AIDS, many critics do not find these measures adequate.
The campaign to create awareness and check the spread of AIDS …

Healing From Within: The Wellness Team Concept, Violet Burnham
Healing From Within: The Wellness Team Concept, Violet Burnham
Psychology
This project was created to chronicle one community's effort to stem the tide of alcohol abuse and address issues of trauma that had plagued the community for many years despite services provided by the State. It is the story of a group of people who came together despite differences to form a team of service providers that would begin a journey of healing for themselves and the community. The results are coming slowly, but indicate less drinking, less tolerance for any form of abuse, and a healthier lifestyle. Although the journey has not ended, there are many more indicators showing …
Systematic Search For Background Seismicity Rate Changes And Correlation At Alaskan Volcanoes, Kelly Ray Kore
Systematic Search For Background Seismicity Rate Changes And Correlation At Alaskan Volcanoes, Kelly Ray Kore
Geosciences
Recent studies have noted a correlation between large earthquakes and localized seismicity rate changes, particularly those associated with volcanic systems. Few studies have been performed to determine if the background seismicity contains meaningful rate changes in the absence of large earthquakes. The Alaska Volcano Observatory (AVO) seismicity catalog is analyzed for background seismicity rate changes at the monitored volcanoes throughout the Aleutian Arc. The primary analysis was to identify statistically significant seismicity rate changes at the eighteen individual volcanic regions. Eleven volcanic regions had statistically significant background seismicity rate changes. Of particular interest are time periods when several volcanic regions …

Permafrost And Wildlife Influences On Stream Nutrient Dynamics And Metabolism In Boreal Forest Watersheds Of Interior Alaska, Emma F. Betts
Permafrost And Wildlife Influences On Stream Nutrient Dynamics And Metabolism In Boreal Forest Watersheds Of Interior Alaska, Emma F. Betts
Biological Sciences
In the boreal forest of interior Alaska, both permafrost and wildfire impact stream solute concentrations, but their effect on stream function is unknown. This research focused on the effects of wildfire and permafrost on stream nutrient dynamics and metabolism in the Caribou Poker Creeks Research Watershed (CPCRW) in interior Alaska. Wildfire impact on chemistry was determined through comparison of pre- and post-fire stream chemistry in a control and a burned watershed. We predicted that increased nutrient and decreased dissolved organic carbon (DOC) delivery to streams after fire would stimulate gross primary productivity (GPP) and reduce ecosystem respiration in burned watersheds. …
Portable Odor Detection Device For Quality Inspection Of Alaska Pink Salmon (Oncorhynchus Gorbuscha), Jiraporn Chantarachoti
Portable Odor Detection Device For Quality Inspection Of Alaska Pink Salmon (Oncorhynchus Gorbuscha), Jiraporn Chantarachoti
Fisheries
This study investigated the ability of a portable hand-held electronic nose (EN) to detect spoilage of whole and canned Alaska pink salmon (Oncorhynchus gorbuscha) using ethanol as a spoilage indicator for canned salmon. Fish held in seawater (14°C) and in slush ice (1°C) were sampled and canned at various intervals of time up to 3 and 16 days of storage, respectively. The EN measured volatile compounds emanating from the gill and belly cavity of whole fish, in conjunction with sensory and microbial analyses. The EN and sensory evaluations were conducted on the canned products. In addition, static headspace gas chromatography …

Strict Liability And The Liberal Justice Theory Of Torts, Alan Calnan
Strict Liability And The Liberal Justice Theory Of Torts, Alan Calnan
ExpressO
Ask a group of tort scholars to explain the relationship between fault and strict liability and the responses are likely to be sharply split. An economist might reply that strict liability—assigned on the basis of efficiency—should be the rule and fault, if it is to apply at all, but a reluctant and occasional exception. A moralist, however, would likely give the opposite opinion—that fault, defined as deontological culpability, should be the rule and strict liability the exception.
Ironically, both economists and moralists often base their views on liberal principles. Economists rely on the political dimension of liberalism, arguing that government …

Single Event Effects (See) Mitigation Of Reconfigurable Fpgas, David Czajkowski, Manish Pagey, Murat Goksel, David Bozek
Small Satellite Conference
This paper discusses the application of Space Micro‘s Time-Triple Modular Redundancy (TTMR™) and Hardened-Core (H-Core™) technologies for mitigation of Single Event Effects in Xilinx Virtex-II field programmable gate arrays (FPGA). TTMR is the application of time and spatial redundancy for mitigating Single Event Upsets (SEU). H-Core is an auxiliary rad-hard chip used for mitigating Single Event Functional Interrupts (SEFI). These technologies have been proven to perform in proton radiation environments and are presently the driving force behind our powerful rad-hard computers built from COTS processors. These same technologies with a few modifications have been applied to mitigate SEUs, configuration upsets, …
Fpga Based Attitude Control System Architecture For Increased Performance, Georg Grillmayer, Marc Hirth, Felix Huber, Viola Wolter
Fpga Based Attitude Control System Architecture For Increased Performance, Georg Grillmayer, Marc Hirth, Felix Huber, Viola Wolter
Small Satellite Conference
For micro-satellites the required attitude accuracy, agility and autonomy along with desired parallel processing of payload images in real-time needs to be achieved within limited power and computational resources. Providing fast, parallel execution while still small in hardware size and modest in power consumption field programmable gate array (FPGA) based on-board computers (OBC) have the potential to highly increase system performance. The Flying Laptop is a micro-satellite currently under development at the Institute of Space Systems, Universität Stuttgart. The attitude control system together with the on-board navigation system is implemented as hardware in an FPGA. The architecture including the sensors, …

The Right To Roam, Jerry L. Anderson
The Right To Roam, Jerry L. Anderson
ExpressO
In 2000, Britain enacted a “right to roam” in the Countryside and Rights of Way Act (CRoW). At first glance, CRoW appears to be a dramatic curtailment of the landowner’s traditional right to exclude: it opens up all private land classified as “mountain, moor, heath, or down” to the public for hiking and picnicking. Yet, when viewed in the light of history, CRoW may be seen as partially restoring to the commoner rights lost during the enclosure period, when the commons system ended. CRoW also represents a return to a functional rather than spatial form of land ownership, allowing more …
