Death Of Procedural Safeguards: Prior Restraint, Due Process And The Elusive First Amendment Value Of Content Neutrality, Edward L. Carter, Brad Clark

In recent years, federal courts eroded the procedural safeguards required for prior restraint licensing schemes established in Freedman v. Maryland. The Supreme Court of the United States stated that the dangers of prior restraint were accounted for by content neutrality. But a close examination of federal courts of appeals opinions since 2002 reveals that erosion of procedural safeguards may threaten speech interests. First, procedural safeguards have not been required, in some cases, even for content-based prior restraints. Second, courts of appeals have held that, in the context of content-neutral prior restraints, the First Amendment no longer requires a time limit …

Diamond Lake is a large natural lake having a surface area of some 3214 acres (1300.7 hectares) and a maximum depth of 52 feet (15.8 meters). It is located within the Umpqua National Forest in the Southern Cascade Mountains of Oregon, at an elevation of over 5000 feet (>1524 meters). Diamond Lake is a high-use waterbody that supports angling, public campgrounds, recreational boating, swimming, and water skiing. The human activity associated with the lake has been a significant contributor to the economy of southern Oregon since the early part of the twentieth century.

In early 2003, the Bush administration proposed and Congress considered two types of highly controversial structural reform to Head Start, the federal program that since 1965 has provided early education and comprehensive health and social services to low-income preschoolers and their families. First, the proposal would begin funding Head Start through federal block grants to the states rather than through direct federal grants to local agencies. Second, the proposal would shift oversight of Head Start at the federal level from the Department of Health and Human Services (HHS) to the Department of Education (ED). Medical waste is produced everywhere that people live and by almost everyone at some point in their lives. Its treatment and disposal implicates the environment, public health, the economy, human dignity, and aesthetics. With the many issues involved, the need for federal regulation of medical waste today is manifest.

This Article examines the problem of medical waste disposal and evaluates the current state-based approach to regulation. This article focuses on the application of European Union unfair contract terms law to retail Internet transactions that U.S. businesses might engage in with European consumers. Mobile applications can enhance self-monitoring by providing real-time feedback and employing persuasive technology. Oviposition Behavior Of Female Anopheles Gambiae In Eestern Kenya Inferred From Microsatellite Markers, Hong Chen, Ulrike Fillinger, Guiyun Yan

Anopheles gambiae females in a relatively isolated hut and all larvae from larval habitats within 100 m of the hut were collected in August 2001 in western Kenya. Among 42 aquatic habitats, 16 had A. gambiae larvae. Two hundred fifty larvae and 58 adults were genotyped using nine microsatellite markers to infer sibling relationship between the larvae and maternity between the females and larvae. The pairwise genetic relatedness of A. gambiae larvae per habitat ranged from -0.4112 to 0.9375, indicating that full siblings, half siblings, and genetically unrelated individuals presented at those habitats with multiple larvae. New Bioassay Method To Assess The Pathogenicity Of Colombian Strains Of Metarhizium Anisopliae (Metsch.) Sorokin And Paecilomyces Sp. (Deuteromycotina: Hyphomycetes) Against The Subterranean Burrower Bug Cyrtomenus Bergi Froeschner (Hemiptera: Cydnidae), Juliana Jaramillo, Christian Borgemeister

Using a new sand bioassay method, the pathogenicity of three Colombian strains of Metarhizium anisopliae (i.e., CIAT 224, 245, and 230) and one strain of Paecilomyces sp. (CIAT 308) were tested against fourth instars of the subterranean burrower bug Cyrtomenus bergi Froeschner (Hem.: Cydnidae) in the laboratory. The proposed bioassay simulates the habitat of C. bergi and at the same time enables the evaluation of a large number of insects in a short period of time and under controlled conditions. All tested fungal species/strains were pathogenic against C. bergi. However, only low levels of mortality were obtained, and never exceeded …

The study was initiated to investigate the potential of locally isolated Bacillus thuringiensis (Bt) isolates for the control of the larger grain borer (LGB) (Prostephanus truncatus), a major storage pest of maize and cassava in Kenya. Samples of soil, grain and dead insects were collected from various maize growing areas in Kenya and screened for the presence of Bt. The isolates were tested for toxic activity against P. truncatus in the laboratory. Bacillus thuringiensis var. tenebrio (Btt), toxic to the Colorado Potato Beetle (CPB) was included in the bioassays as a Standard control reference. Bt precipitate obtained from broth was …
