Dr. Kyle Hoagland, Water Center Director in the Institute of Agriculture and Natural Resources at the University of Nebraska-Lincoln, and I are particularly pleased to be asked to talk with you today about water, a key concern in our state and in our world. New water regulations affecting Nebraska's agricultural producers, numerous legislative discussions, and stories of neighbors contesting water use by neighbors have been in the news and on our minds. Bird-aircraft collisions (bird-strikes) cause serious safety hazards to aircraft, costing civilian aviation at least $496 million annually in the U.S. Non-lethal bird-frightening devices, such as propane exploders, are commonly used to deter birds from airport environments. We conducted a study during August - October 2004 to determine the efficacy of propane exploders utilized with and without concurrent lethal reinforcement activities for altering bird behavior at John F. Kennedy International Airport in Queens, New York. Two groups of 8 propane exploders each were deployed on the airfield. Based on an extended growth model, this thesis further explores the joint dynamics between external debt and growth. The model explicitly expresses this growth dynamic mechanism incorporating external debt as an important explanatory variable with risk premium and other related structural factors. The interactions between external debt and growth are interpreted as directly and mainly through the channel of capital accumulation and indirectly through technology change. These constitute the functional form foundation to solve the main concern on the effect of external debt upon growth adjustment path. Reconceptualizing Child Sexual Exploitation As A Bias Crime Under The Protect Act, Tracy Agyemang

The note argues that the PROTECT Act, while expanding legal measures to combat child sexual exploitation, fails to address the crime's root causes and its nature as a form of discrimination. It advocates for reconceptualizing child sexual exploitation as a bias crime, which would enhance legal deterrence, increase penalties, and better acknowledge the psychological trauma experienced by victims. The note emphasizes that recognizing exploitation as a bias crime would address the systemic factors, such as poverty and discrimination, that perpetuate the crime.

Several questions need to be addressed to evaluate whether Tannerella forsythia is to be considered a periodontal pathogen. T. forsythia has been detected in periodontal health and disease, so could it be a pathogen? The species was not detected in many studies despite finding other putative pathogens, so could it be important in pathogenicity? The challenges of working with T. forsythia include its fastidious and anaerobic growth requirements for cultural detection. Thus, studies associating T. forsythia with periodontal and other oral infections have used noncultural approaches (immunoassays and DNA-based assays) in addition to cultural approaches. We feel …

This paper describes a clinical project using a self-reported pain diary for the assessment of chronic pain in the communicative, cognitively-intact nursing home resident. There are estimates of chronic pain among nursing home residents that range from 4 – 83%. The goal of this clinical project was to evaluate a chronic pain diary in relation to its effectiveness and efficiency in accurately assessing pain among nursing home residents. Assessment has been identified as a major barrier in the control of chronic pain, and the self-report is accepted as the most reliable measure of a person’s pain. The self-reported pain diary’s …

Recently, the legal and academic communities have been studying the phenomenon of the "vanishing trial." The phenomenon is an observation of the fact that the American court system is experiencing a trend of shrinking trial dockets. At least one scholar has partially attributed the decline in trials to the value placed upon settlement rather than adjudication within our justice system. Those competing values have spawned a debate regarding the secrecy and confidentiality characteristic of settlements versus public access to information in civil litigation. This article is a thought experiment, or maybe a nightmare, about the intersection of freedom of contract and the trials that have not vanished. Could contracting parties effectively agree in advance of a dispute that any litigation of the case will comply with certain rules? Would such an agreement be enforced even in a contract of adhesion? If so, parties with sufficient bargaining leverage could design away many of the characteristics of litigation that they find unappealing without the need to resort to private processes. Phillips v. Congelton (In re White Mountain Mining Co.), presents a heightened version of the conflict between the general policy favoring enforcement of arbitration agreements and the policy favoring resolution of bankruptcy-related claims in the bankruptcy court proceedings as the case involves a dispute over the enforcement of an international agreement to arbitrate a claim that is a "core" bankruptcy proceeding. In Phillips, the Fourth Circuit analyzed the underlying purposes of both the bankruptcy code and the federal arbitration statutes, and resolved the conflicting purposes of the two by giving greater deference to the policy favoring resolution of bankruptcy-related claims …

Nonplanar surfaces are often encountered in engineering structures. In aerospace structures, periodically corrugated boundaries are formed by friction-stir-welding. In civil engineering structures, rebars used in reinforced concrete beams and slabs have periodic surface. Periodic structures are also being used to create desired acoustic band gaps. For health monitoring of these structures, a good understanding of the elastic wave propagation through such periodic structures is necessary. The ultrasonicwave propagation in sinusoidally corrugated waveguides is studied in this paper. Periodically corrugated waveguides are gaining popularity in the field of vibration control and for designing structures with desired acoustic band gaps. Currently only numerical method (Boundary Element Method or Finite Element Method) based packages (e.g., PZFlex) are in principle capable of modeling ultrasonic fields in complex structures with rapid change of curvatures at the interfaces and boundaries but no analyses have been reported. The note examines the effectiveness of large-scale sex discrimination class actions, particularly through the lens of Dukes v. WalMart, in driving systemic change in corporate workplace practices. While these actions often succeed in compensating victims, they frequently fail to address the root causes of discrimination, leaving broader systemic issues unresolved. The analysis highlights the tension between procedural requirements and the need for meaningful reform, suggesting that such lawsuits can prompt some positive changes but often fall short of achieving lasting impact.

This Note discusses the advantages and drawbacks of mandating participation in mediation in medical malpractice disputes. Part II of this Note reviews the extent of the current medical malpractice crisis. Part III examines litigation as the traditional means of resolving medical malpractice disputes and suggests that litigation's weaknesses eclipse any of its strengths. Part IV evaluates the lingering challenges to arbitration, accounting for its ineffectiveness in resolving medical malpractice disputes. Part V analyzes why mediation may be the better alternative to both litigation and arbitration in resolving such disputes, and how its hurdles can be best surmounted by mandatory mediation. …

Estrogenic Activity In The Environment: Municipal Wastewater Effluent, River, Ponds, And Wetlands, Nancy W. Shappell

Estrogenic activity of regional water samples was evaluated. Samples obtained from wetlands and ponds involved in various agricultural land uses, from three river sites over four seasons, and from municipal wastewater effluent held in storage lagoons were evaluated. The estrogen- responsive cell line MCF-7 BOS was used in the E-screen assay to determine 17β-estradiol equivalents (E2 Eq) of water samples extracted by solid-phase extraction. Estrogenic activity in surrounding wetlands and ponds from different land uses was not different, with 10-12 M E2 Eq (0.3 ppt). Estrogenic activity of Red River samples was within the same range as wetland–pond …
