Antidiscrimination Law In The Administrative State, Julie C. Suk

The article argues that antidiscrimination law in the U.S. should shift its focus from corrective justice, which addresses individual wrongs, to distributive justice, which aims to eradicate systemic inequalities and promote equal opportunities. This shift would require enhancing the role of administrative agencies, such as the EEOC, to enforce antidiscrimination laws more effectively through proactive regulation and rulemaking. The article draws on the British model, where administrative agencies have stronger enforcement powers, to suggest reforms for the EEOC.

The goals of this project were to assess the viability of avoiding water use and of “cascading” water uses, i.e. using outlet water from one process in another activity, possibly with some purification, including the upgrading of the final effluent stream for internal reuse. Water use has been inventoried at FMC Biopolymer, Cork. Avoidance and reduction measures were identified that could reduce water consumption from 49m /hr to 19 m /hr (a reduction in excess of 60%), with an annual saving in excess of €350,000. Earlier this year, Justice Sandra Day O’Connor retired from the Supreme Court of the United States after 25 years of service. It would be difficult to overstate the impact that Justice O’Connor has had on the interpretation of the Constitution during her tenure on the Court. This review presents current research on the use of far-red to near-infrared (NIR) light treatment in various in vitro and in vivo models. Low-intensity light therapy, commonly referred to as “photobiomodulation,” uses light in the far-red to near-infrared region of the spectrum (630–1000 nm) and modulates numerous cellular functions. Positive effects of NIR–light-emitting diode (LED) light treatment include acceleration of wound healing, improved recovery from ischemic injury of the heart, and attenuated degeneration of injured optic nerves by improving mitochondrial energy metabolism and production. Engendering Student Empathy For Disabled Clients With Urinary Incontinence Through Experiential Learning, Karen A. Karlowicz, Kay L. Palmer

As part of a rehabilitation clinical course for senior baccalaureate nursing students, a disability-incontinence experiential learning activity is required. The assignment is intended to familiarize students with some of the challenges encountered by a client with mobility problems, including continence management issues using disposable undergarments. Wearing the undergarments dry and wet while being confined to a wheelchair provides insight and promotes empathy for patients with bladder control problems.

Recently, the Boston College Law Review published a symposium issue containing twelve articles on federal income taxation issues pertaining to rates, progressivity, and budget processes. These articles are well written, copiously researched, and representative of contemporary legal scholarship. For the most part, these articles variously support the idea that our federal taxation system is insufficiently progressive. Often this body of work attributes deleterious social effects to insufficient progressivity caused by tax cuts legislated in 2001 and 2003. Buscando Ambiente: Hegemony And Subaltern Tactics Of Survival In Puerto Rico’S Land Distribution Program, Ismael Garcia-Colon

A land distribution program in the community of Parcelas Gándaras in Cidra, Puerto Rico, transformed the lives of formerly landless workers. Examination of the working conditions and social relations of workers before the program (1890s–1945) and their economic strategies, migration, and networks after becoming small landholders (1945–1960s) shows how they used their land to accommodate their practices of everyday life and their tactics of survival. Local ruling groups became hegemonic through the establishment of land distribution communities. On The Applicability Of The Silica Mdl Proceeding To Asbestos Litigation, Lester Brickman

The article argues that the findings from the silica multidistrict litigation (MDL), presided over by U.S. District Court Judge Janis Jack, have significant implications for understanding the fraudulent practices in asbestos litigation. The author contends that both silica and asbestos litigations share a common "entrepreneurial model" where a small group of doctors and screening companies generate specious claims for financial gain, often without proper medical oversight. Judge Jack's findings in the silica MDL, which revealed widespread fraud and manipulation of medical diagnoses, corroborate the author's long-standing critique of asbestos litigation practices.

From the time when Congress passed and the President enacted the Trafficking Victims Protection Act of 2000 ("TVPA"), this innovative law has changed the contours of the U.S. legal landscape.I Given even more teeth by the subsequent passage of the Trafficking Victims Protection Reauthorization Act of 2003 ("TVPRA"), the law provides unprecedented tools for U.S. governmental agencies and non-governmental organizations ("NGOs") to combat trafficking in persons, both within the U.S. and abroad.
