Common methods to identify yeast cells containing the prion form of the Sup35 translation termination factor, [PSI+], involve a nonsense suppressor phenotype. Decreased function of Sup35p in [PSI+] cells leads to readthrough of certain nonsense mutations in a few auxotrophic markers, for example, ade1-14. This readthrough results in growth on adenine deficient media. While this powerful tool has dramatically facilitated the study of [PSI+], it is limited to a narrow range of laboratory strains and cannot easily be used to screen for cells that have lost the [PSI+ …

The Press Clause of the First Amendment should be understood to require the government to permit coverage of war. Up to now, the Supreme Court has ascribed little independent significance to the Press Clause. It has protected the press under the Speech Clause when possible, and denied press claims that would require reading the Press Clause as creating rights not guaranteed to all speakers. Logistical and security concerns, however, make it impossible to give all speakers the access necessary to cover war. In all wars, the military tries to suppress news coverage that might undermine public support for the war. …

Is Cost-Benefit Analysis Neutral, David M. Driesen

Cost-benefit analysis (CBA) owes much of its appeal to its image as a neutral principle for deciding upon the appropriate stringency of environmental, health, and safety regulation. This Article examines whether CBA is neutral in effect-i.e. whether it sometimes makes regulations more stringent or regularly leads to weaker environmental, health, and safety protection. Using a representative data set from recent Office of Management and Budget (OMB) reviews, an examination of OMB prompt letters, and a literature review, this Article shows that CBA has almost always proven anti-environmental in practice. Toward A New Horizontal Federalism: Interstate Water Management In The Great Lakes Region, Noah D. Hall

This article presents a new model for environmental policy, called cooperative horizontal federalism. The cooperative horizontal federalism approach utilizes a constitutional mechanism for states to bind themselves to common substantive and procedural environmental protection standards, implemented individually with regional resources and enforcement. Here, the concept of the cooperative horizontal federalism model is illustrated through the recently proposed Great Lakes-St. Lawrence River Basin Water Resources Compact. Under this proposed compact, the eight Great Lakes states would cooperatively manage the world's largest freshwater resource under common minimum standards, which are then incorporated into state law and implemented individually. The Roadless Rule That Never Was: Why Roadless Areas Should Be Protected Through National Forest Planning Instead Ofagency Rulemaking, Heather S. Ferdriksen

The 2001 Roadless Rule would have barred construction of new roads on 58.5 million acres of national forest land. Within months of its inception, however, a barrage of legal challenges and reversal of policy under the Bush Administration precluded its implementation. Regardless of its ecological merits, the backlash against the Roadless Rule suggests that agency rulemaking may not be the best way to achieve roadless area protection. This comment argues that the traditional process, forest planning under the National Forest Management Act of 1976 ("NFMA "), offers a preferable alternative to agency rulemaking in this context. The Shrinking Scope Of Judicial Review In Norton V. Southern Utah Wilderness Alliance, Justin C. Konrad

In Norton v. Southern Utah Wilderness Alliance, the U.S. Supreme Court issued its first decision definitively construing § 706(1) of the Administrative Procedure Act ("APA"). This section ostensibly provides for review of agency action "unlawfully withheld or unreasonably delayed." However, the Court's opinion narrowly construed section 706(1) so as to allow review only for discrete agency actions that are legally required. As a result, the Court held that Bureau of Land Management compliance with a Federal Land Management and Policy Act ("FLPMA") provision mandating management of certain public lands so as to prevent impairment of their wilderness characteristics was not …

Race, Gender, Region And Death Sentencing In Colorado, 1980-1999, Stephanie Hindson, Hillary Potter, Michael L. Radelet

This paper examines the administration of the death penalty in Colorado. We first identify all cases (n=21) in which defendants were sentenced to death in Colorado, 1972-2005, and all cases (n=10) in which the death penalty was sought, 1980-1999. We then compare the race and gender of all homicide victims with the race and gender of victims in the 110 death penalty cases. Overall, we find that the death penalty is most likely to be sought for homicides with white female victims, and that the probability of death being sought is 4.2 times higher for those who kill whites than …

Shopping Badly: Cognitive Biases, Communications, And The Fallacy Of The Marketplace Of Ideas, Derek E. Bambauer

The model of the "marketplace of ideas" governs critical decisions in American jurisprudence on regulating communications. This theory holds that, over time, we collectively process ideas and information to separate truth from falsehood. State intervention is therefore unnecessary and undesirable, for it may prevent us from discovering inelegant but useful ideas. However, research in cognitive psychology and behavioral economics shows that we operate with significant, persistent perceptual biases that undercut this model's assumptions. The marketplace model errs in describing how we interact with information; accordingly, it cannot reliably assess when regulation is desirable. We should discard the marketplace of ideas …

Title IX has played a crucial role in changing our nation's treatment of women in education, leading to awareness about the harms of sexual harassment on both female and male students. However, in one area, Title IX jurisprudence draws a line between protected students and students who are not protected from sexual harassment. That line is determined by whether the harassment facing the student is because of perceived sexual orientation or perceived failure to adhere to gender stereotypes. Les entreprises qui utilisent des chariots élévateurs pour charger et décharger des camions aux quais de transbordement connaissent bien le principal danger associé à ce type d’activité, soit que le chariot tombe du quai si le camion s'en éloigne subitement. Cet éloignement peut être causé par plusieurs événements. Le départ inopiné du camion est l'exemple le plus souvent cité et se produit lorsque le camion quitte le quai avant la fin du transbordement. Lors des interventions sur les lieux d’un incendie, les pompiers sont soumis à des astreintes physiques et physiologiques importantes (Baker et coll., 2000 ; Cloutier et Champoux, 2000 ; Ftaiti et coll., 2001 ; Griefahn et coll., 2003). Le travail des pompiers est souvent très exigeant pour le système cardiorespiratoire, car il implique des efforts physiques importants dans des conditions où la chaleur ambiante est très élevée. Cette recherche propose l’investigation des effets d’une intervention en counseling sur la réadaptation de travailleurs accidentés à risque de chronicité. À la suite d’une recension de la littérature pertinente portant sur les facteurs biopsychosociaux et la chronicité, les enjeux de l’intervention en réadaptation sont analysés. Soixante-deux travailleurs accidentés à risque de chronicité sont assignés au hasard à 19 conseillers regroupés en deux catégories, soit formés ou non formés au counseling de réadaptation et intervenant selon deux modalités, soit sur une base hebdomadaire ou selon les pratiques habituelles de la Commission de la santé et de la sécurité du travail (CSST). …

Problématique de santé et sécurité du travail

L’amiantose et la silicose sont les pneumoconioses les plus fréquentes au Québec et sont souvent associées à une détérioration progressive de la fonction pulmonaire. Cependant, il est difficile de prédire qui, parmi les travailleurs, développera ces conditions ou, s’ils en sont atteints, quelle sera leur évolution clinique.

Objectifs

  1. Évaluer le rôle de l’expectoration induite (EI), une technique non-invasive d’analyse des sécrétions bronchiques, en comparaison avec le lavage bronchoalvéolaire (LBA) dans l’évaluation de la sévérité de pneumoconioses.

Les produits à base d’acrylates sont très utilisés dans plusieurs secteurs d’activité économique à cause de leur propriété adhésive. Par contre, leur utilisation peut causer une sensibilisation allergique dont les manifestations cutanées ont été décrites dès les années 40. Ces produits sont considérés, depuis une quinzaine d’années, comme responsables de rhinoconjonctivite et d’asthme professionnels. Certains cas ont déjà été diagnostiqués au Québec. Des tests de provocation bronchique faits de façon réaliste ont parfois été utilisés.

Notre étude porte sur le programme Principes de déplacement sécuritaire des bénéficiaires (PDSB) régulier, développé par l’Association pour la santé et la sécurité du travail du secteur affaires sociales (ASSTSAS). Le PDSB est une intervention complexe, composée du programme de formation PDSB, dispensé par un formateur accrédité par l’ASSTSAS au personnel soignant de son établissement, de formation d’agents de suivi PDSB, et d’activités de prévention menées par les formateurs dans leur centre hospitalier respectif. Les isocyanates sont grandement utilisés dans la formulation de la peinture automobile afin de former des polymères de polyuréthanes. Lors d’une dégradation thermique, ces systèmes polymériques peuvent régénérer une partie des isocyanates qui sont des agents sensibilisants puissants conduisant à l’asthme professionnel. Dans les ateliers de réparation de carrosseries, l’utilisation d’un procédé abrasif sur des peintures de polyuréthanes peut générer suffisamment de chaleur pour occasionner la libération d’isocyanates dans l’air ambiant.
