Through The Looking Glass: Judicial Deference To Academic Decision-Making, Douglas K. Rush
Richmond Journal of Law and the Public Interest
This paper will review the statutory mandates of Section 504 and the ADA and examine the extent to which courts are willing to defer to institutional decisions concerning program modifications to accommodate learning disabled students. Courts have long recognized that academic decision-makers are entitled to deference, especially when their decisions concern issues related to educational programs. Courts must be vigilant, however, to properly weigh their role as the enforcers of Congressional legislation against the judicial policy of deference to academic decisions. Article 32 of the United Nations Convention on the Rights of the Child ("UN Convention") states that parties to the convention must "recognize the right of the child to be protected from economic exploitation and from performing any work that is likely to be hazardous or to interfere with the child's education, or to be harmful to the child's health or physical, mental, spiritual, moral or social development." A report from the U.S. General Accounting Office recently exposed 463 federal employees with degrees from schools believed to be "diploma mills" - sham schools that sell college degrees to individuals who complete little or no academic work to earn them. This report, along with other investigative work, confirmed the claims of diploma mill operators: their "graduates" have well-paying jobs in all levels of both the public and private sectors, and employers have subsidized the purchase of fake degrees via tuition reimbursement programs. Once thought to be primarily an issue of concern for university fraternities and sororities, hazing has emerged as a disturbing trend with an increase in the number of incidents involving high school student athletes. High school coaches, athletic administrators, and teachers must understand that initiation rites of sport teams can sometimes spiral out of control with grave legal and financial consequences for student athletes and school officials. Body Weight Penalties In The Physical Fitness Tests Of The Army, Air Force, And Navy, Paul M. Vanderburgh, Todd A. Crowder
Health and Sport Science Faculty Publications
Recent research has empirically documented a consistent penalty against heavier service members for events identical or similar to those in the physical fitness tests of the Army, Air Force, and Navy. These penalties, not related to body fatness, are based on biological scaling models and have a physiologic basis. Using hypothetical cases, we quantified the penalties for males, 60 vs. 90 kg body weight, and females, 45 vs. 75 kg, to be 15-20% for the fitness tests of these three services. Such penalties alone can adversely impact awards and promotions for heavier service members. To deal equitably with these penalties …

How To Conduct A Coverage Exercise: A Rapid Assessment Tool For Programs And Services, Carey Meyers, Solene Lardoux
Poverty, Gender, and Youth
A coverage exercise (CE) is a simple, low-cost, rapid assessment tool that can be used to profile who is reached by a given service or group of service providers or organizations with a common clientele operating within a particular geographic area. This tool was developed by the Population Council to assist programs servicing youth, but it can be used for other beneficiaries as well. A CE collects data on a variety of characteristics including gender, schooling status, living arrangements, work status, and marital status of those benefiting from a program or service. It also enables program staff and managers to …
