Objections In Conscience To Medical Procedures: Does Religion Make A Difference Lecture?, Kent Greenawalt Jan 2006

Objections In Conscience To Medical Procedures: Does Religion Make A Difference Lecture?, Kent Greenawalt

Faculty Scholarship

How should the government res pond if people refuse standard medical treatment? What should the government do if people refuse medical treatment for their children, and what autonomy should teenagers be given in making such choices? Is religion a proper basis for refusing such medical treatment? Furthermore, should medical practitioners have a privilege not to render services that they object to in conscience? This article analyzes such questions and proposes that the most sensible answers depend on context. Legislatures should sometimes create no exemptions, should sometimes create exemptions based on nonreligious criteria, and should sometimes use criteria framed in terms …

The New Biopolitics: Autonomy, Demography, And Nationhood, Jedediah S. Purdy Jan 2006

The New Biopolitics: Autonomy, Demography, And Nationhood, Jedediah S. Purdy

Faculty Scholarship

Political thinkers have long worried that freedom might be selfundermining, tending to erode the liberal rights and democratic politics that form its foundations. The argument has ancient and modern versions, versions of the political left and of the right. No doubt the only adequate answer is the sum of the answers to many particular questions: whether and when popular elections undermine liberal rights, how free markets enhance or undermine democracy, and so forth. In this article, I address an emerging problem in a central area of contemporary freedom: reproductive autonomy. I ask whether reproductive autonomy can undermine the political conditions …

Simon Says Take Three Steps Backwards: The National Conference Of Commissioners On Uniform State Laws Recommendations On Child Representation, Jane M. Spinak

Faculty Scholarship

In considering whether I wanted to submit a response to this conference, I turned back to the Fordham Law Review's Proceedings of the Conference on Ethical Issues in the Legal Representation of Children, now referred to by this conference's participants as Fordham. While the entire volume helped me to formulate this response, I want to begin by acknowledging Linda Elrod's and Ann Haralambie's two responses in Fordham as essential to my decision. In a few short pages they encapsulated the essential message of Fordham: that by the end of the last century, the practice of lawyers for children was to …

Perceptions Of School Performance Measures: A Study Of Principals In The United States And Head Teachers In The United Kingdom Using Q Methodology, Rene Velez

UNF Graduate Theses and Dissertations

Performance measures have been used throughout the business sector as a means to assess productivity, allocate resources, and increase profitability. More recently, they have been utilized to answer increasing calls for accountability in public education. Legislation has been passed in both the United Kingdom and the United States that implements performance measures as a means to measure student achievement and assess school performance. This study, conducted both in the United States and the United Kingdom, examined the perceptions of 15 primary and 15 elementary school leaders with regard to the transnational issue of school performance measures.

Q methodology was used …

M&A Update: Will The Rebound Stumble?, Carol M. Sanchez, Stephen R. Goldberg Jan 2006

M&A Update: Will The Rebound Stumble?, Carol M. Sanchez, Stephen R. Goldberg

Peer Reviewed Articles

After a multi-year lull, merger and acquisition activity has started again to pick up speed. In 2004, the value of global M&A activity grew 40% to just under $2 trillion, compared to $833 billion in 2003. This is the first time the market has seen such growth since 1998 when it increased 80% from 1997. M&A activity in the post-millennium years weakened because investors were jittery after the dot.com bust and September 11 attacks in the United States. By 2005, it seemed that much of that fear had abated, as M&A activity was strong through June. There were more large …

Contrary to most heme proteins, ferrous cytochrome c does not bind ligands such as cyanide and CO. In order to quantify this observation, the redox potential of the ferric/ferrous cytochrome c–cyanide redox couple was determined for the first time by cyclic voltammetry. Its E0′ was −240 mV versus SHE, equivalent to −23.2 kJ/mol. The entropy of reaction for the reduction of the cyanide complex was also determined. From a thermodynamic cycle that included this new value for the cyt c cyanide complex E0′, the binding constant of cyanide to the reduced protein was estimated to …

Religion In The Workplace: New Perspectives And Laws, Marie Mckendall Jan 2006

Religion In The Workplace: New Perspectives And Laws, Marie Mckendall

Seidman Business Review

Title VII of the Civil Rights Act has for 41 years been the law that governs religious discrimination in the workplace. For some Michigan employers, that may be about to change. On November 2, the Michigan House of Representatives passed Bill 972, known as the Conscientious Objector Policy Act. The bill will now go to the Senate, where is it also expected to pass. It is not known whether the governor will sign the bill.

Health Savings Accounts: A New Approach To Control Rising Health Insurance Premiums, Jeff S. Rubleski Jan 2006

Health Savings Accounts: A New Approach To Control Rising Health Insurance Premiums, Jeff S. Rubleski

Seidman Business Review

Health Savings Accounts (HSAs) are a hot topic in the employee benefits arena, as employers of all sizes look for ways to control the relentless rise of health insurance costs. HSAs fall under the category of “Consumer-Directed” healthcare plans, which are designed to involve the consumer more in the financing and decision-making process related to the use of healthcare services. Figure 1 shows the average increase in health insurance premiums, workers’ earnings, and overall inflation from 1988 through 2005. In recent years, health insurance premiums have exceeded the rise in workers’ earnings and overall inflation by a wide margin.

How Economically Literate Are You?, Amber Brown Jan 2006

How Economically Literate Are You?, Amber Brown

Seidman Business Review

How much do Americans know about economics? Recent surveys point out that the answer to this question is “not nearly enough.” Results have illustrated gaps in understanding of even the most basic of economics principles. The lack of understanding isn’t limited to the general public; even current and former economics students have done poorly answering questions that check their general knowledge.

Analysis Of Kinase Effects On Viral Replication Of The Papillomavirus, Joshua R. Raynes Jan 2006

Analysis Of Kinase Effects On Viral Replication Of The Papillomavirus, Joshua R. Raynes

UNF Graduate Theses and Dissertations

Papillomaviruses are a genera of small tumor viruses in the Papovaviridae family, whose lifecycle and replication ability is directed by epithelial differentiation. During latency, papillomavirus DNA replication occurs synchronously with the host cell's replication by the activation of the El protein. To elucidate the effects upon viral replication, this study utilized chemical inhibition of several kinases predicted to phosphorylate, and subsequently modify the activity of, the papillomavirus' E1 protein. The amount of DNA replicated was observed via autoradiography following DNA extraction and southern blotting of BPV-transformed C127 cells. Sample extracts from cells exposed to specific chemical inhibitors of PKC, CDK, …

Fairness In The Air: California's Air Pollution Hearing Boards, Kenneth A. Manaster Jan 2006

Fairness In The Air: California's Air Pollution Hearing Boards, Kenneth A. Manaster

Faculty Publications

This article is an update of my earlier article, "Administrative Adjudication of Air Pollution Disputes: The Work of Air Pollution Control District Hearing Boards in California." Because basic features of the law governing California's air pollution hearing boards have remained in place over the years, the original article reportedly continues to be useful for lawyers and others. Nonetheless, some important aspects of the law have changed, and so have many of the practices hearing boards follow. Furthermore, in many parts of the state, hearing boards now often face cases of far greater technical and legal complexity, and environmental and economic …

Nesting Like Birds, Teaching Like Spiders: Emerging Visions In U.S. Higher Education For Biocultural Sustainability And Ecological Literacy Education, Ariana Marta Francesca Kramer Jan 2006

Nesting Like Birds, Teaching Like Spiders: Emerging Visions In U.S. Higher Education For Biocultural Sustainability And Ecological Literacy Education, Ariana Marta Francesca Kramer

Dissertations and Theses

Sustainability education is a growing field still being defined. It draws from environmental education, but includes social justice and economic equity alongside environmental health. International efforts to define the parameters of sustainability education at the university level have called for interdisciplinary approaches that emphasize culture. However, in the United States most programs concerned with sustainability follow in the footsteps of environmental studies with a focus on science and public policy.

Seven interdisciplinary master's programs in sustainability education were reviewed as potential models for how the larger university system might approach teaching for sustainability. Document analysis was used to compare program …

Law, Politics, And The Appointments Process, Bradley W. Joondeph Jan 2006

Law, Politics, And The Appointments Process, Bradley W. Joondeph

Faculty Publications

In recent years, many commentators have called for the "depoliticization" of the judicial appointments process, arguing that politics and ideology have wrongly displaced objective merit in the selection of federal judges. In their book, Advice and Consent: The Politics of Judicial Appointments, Lee Epstein and Jeffrey Segal demonstrate why such prescriptions are misguided. Epstein and Segal are political scientists, not law professors, and thus have no normative stake in protecting constitutional law from politics, the preoccupation of many constitutional theorists. Instead, their aim is purely positive: to explain how the appointments process has actually functioned over the course of the …

Using International Law To Enhance Democracy, David Sloss Jan 2006

Using International Law To Enhance Democracy, David Sloss

Faculty Publications

This article analyzes the domestic application of international human rights law from the standpoint of John Hart Ely's political process theory. The article contends that an Elysian theory favors direct application of international human rights treaties, rather than indirect application of international law as an aid to constitutional interpretation, because direct application keeps the channels of political participation open. Moreover, there are certain areas of substantive law, such as capital punishment, where the Supreme Court functions as the primary lawmaker in the United States. From an Elysian viewpoint, in areas of law like capital punishment, where Congress takes a back …

This Article revisits a recent shift in standard form sovereign bond contracts to promote collective action among creditors. Major press outlets welcomed the shift as a milestone in fighting financial crises that threatened the global economy. Officials said it was a triumph of market forces. We turned to it for insights into contract change and crisis management. This article is based on our work in the sovereign debt community, including over 100 interviews with investors, lawyers, economists, and government officials. Despite the publicity surrounding contract reform, in private few participants described the substantive change as an effective response to financial …
