Global Compact: A Critique Of The U.N.'S "Public-Private" Partnership For Promoting Corporate Citizenship, Surya Deva
Global Compact: A Critique Of The U.N.'S "Public-Private" Partnership For Promoting Corporate Citizenship, Surya Deva
Syracuse Journal of International Law and Commerce
this article aims to critically evaluate the evolution of, and the progress made by, the Global Compact in making participant corporations "embrace, support and enact" the ten Compact principles. Part I offers insights into the evolution of the Global Compact by critically reviewing the major milestones reached in the last seven years - from the backing of U .N. General Assembly resolutions to the integrity measures, the Shanghai Declaration, the principles for responsible investment, and the new governance framework. Part II elaborates the argument why the Global Compact is still too compact to be termed global in the true sense. …

Inter-Industry Gender Wage Gaps By Knowledge Intensity: Discrimination And Technology In Korea, William C. Horrace, Beyza P. Ural, Jin Hwa Jung
Inter-Industry Gender Wage Gaps By Knowledge Intensity: Discrimination And Technology In Korea, William C. Horrace, Beyza P. Ural, Jin Hwa Jung
Center for Policy Research
A new gender wage gap decomposition methodology is introduced that does not suffer from the identification problem caused by unobserved non-discriminatory wage structure. The methodology is used to measure the relative size of Korean gender wage gaps from 1994 to 2000 across industries, differentiated by industrial knowledge intensity, where knowledge intensity is the extent to which industries produce or employ high-technology products. Korea represents an important case study, since it possesses one of the fast growing knowledge-intensive economies, among industrialized countries. Empirical results indicate that over this period, discrimination (the unexplained portion of the gender wage gaps) in Korea was …
Comparison Of Power Output Between Rotor And Normal Cranks During A 16.1 Km Time Trial, Walter Hailes
Comparison Of Power Output Between Rotor And Normal Cranks During A 16.1 Km Time Trial, Walter Hailes
Graduate Student Theses, Dissertations, & Professional Papers
Previous research has evaluated the Rotor crank system on indices of endurance performance (e.g. peak power output, VO2max, lactate threshold, onset of blood lactate accumulation, economy, delta, and gross efficiency) under laboratory conditions. However, previous research has not attempted to determine whether the use of the Rotor cranks can improve sustainable power output during a time trial. The purpose of this study was to investigate the effect of the Rotor crank system on 16.1km time trial performance in the field. Eleven recreationally trained cyclists (7 male, 4 female; age 21±2 yrs) volunteered to participate in the study. On two separate …

Patterns Of Government In Onondaga County : Structure And Services Of County, City, Town And Village Governments, Syracuse University. Maxwell School. Community Benchmarks Program, League Of Women Voters Of The Syracuse Metropolitan Area, F.O.C.U.S. Greater Syracuse
Community Benchmarks Program
Although residential and commercial development seems to spread without regard to political boundaries, much of the Syracuse metropolitan area lies within Onondaga County. Metropolitan area is defined as the city and the communities around it which draw much of their livelihood from the city and use many city services. This handbook attempts to describe not only the traditional institutions of government in Onondaga County with its city, towns, and villages, but also the extent of metropolitan growth and its effect upon these institutions. The Syracuse metropolitan area has unique features and many advantages as this book will detail. However, the …

Analysis Of Damage In Laminated Automotive Glazing Subjected To Simulated Head Impact, Shuangmei Zhao, Li Chai, S. D. Barbat, Lokeswarappa R. Dharani
Mechanical and Aerospace Engineering Faculty Research & Creative Works
During vehicle accidents, occupant's head impacting on windshield or side window is commonly observed. Any attempt to design glazing that minimizes injury to and death of occupants during a vehicle accident requires a thorough understanding of the mechanical behavior of automotive glazing subjected to head impact loads. A continuum damage mechanics (CDM) based constitutive model is developed and implemented into an axisymmetric finite element model to study the failure and impact resistance of laminated automotive glazing subjected to simulated head impact. An anisotropic elastic damage tensor with a linear damage evolution law is chosen to model the failure of the …

Resolving Medical Malpractice Claims In The Medicare Program: Can It Be Done?, Eleanor D. Kinney, William M. Sage
Resolving Medical Malpractice Claims In The Medicare Program: Can It Be Done?, Eleanor D. Kinney, William M. Sage
Faculty Scholarship
There is increasing interest in an integrated approach to patient safety and medical liability among policymakers. We have proposed Medicareled malpractice reform that would provide Medicare beneficiaries with better safety, improved communication in the event of error, preservation of therapeutic relationships, timely settlement, and fair compensation at a lower administrative cost. Disputes in the reformed system would be adjudicated by Medicare's existing administrative appeals system that would work together with Medicare's quality improvement regulation and payment policy to reduce errors and compensate injured patients.
Despite the laudable rationale for Medicare-led malpractice reform, important issues attend the constitutional and statutory authority …
Pay For Performance: Will It Work In Theory, William M. Sage
Pay For Performance: Will It Work In Theory, William M. Sage
Faculty Scholarship
The title of my lecture about pay for performance in health care (often abbreviated as "P4P") echoes a French management saying: "It's all very well in practice, but it will never work in theory." There is no doubt that medical pay for performance is popular. P4P initiatives are everywhere; a search of online news reveals nearly 2,500 stories about pay for performance in the last two years alone. Folk legend Arlo Guthrie would have called P4P a movement-a "Pay for Performance Medical Quality Movement." But before you join in, you might want to know what you are joining. So let's …
The Role Of Medicare In Medical Malpractice Reform, William M. Sage
The Role Of Medicare In Medical Malpractice Reform, William M. Sage
Faculty Scholarship
The medical malpractice crisis we think we are in is not the medical malpractice crisis we actually are in. Today's malpractice crisis is not an epidemic of lawsuits, impressionable juries, or even excessive insurance premiums. The real medical malpractice crisis is that the law has formed little connection between the malpractice system and the health care system.
Emergency Contraception, Abortion And Evidence-Based Law, Rebecca Cook, Bernard Dickens, Joanna Erdman
Emergency Contraception, Abortion And Evidence-Based Law, Rebecca Cook, Bernard Dickens, Joanna Erdman
Articles, Book Chapters, & Popular Press
Courts and legal tribunals increasingly decline to serve as religious or moral guardians, and require social evidence to support litigants' claims. Recent cases on emergency contraception and abortion are examined to show how judicial interpretations can take account of evidence of the impact that different understandings of the law will have for how ordinary people can plan their lives and reproductive choices. In an emergency contraception case, an interpretation was rejected that would have criminalized choices that millions of decent, law-abiding physicians, pharmacists and women routinely make. In an abortion case, three judges unanimously rejected a government ministry's defence of …
Defining What To Regulate: Silica And The Problem Of Regulatory Categorization, Andrew P. Morriss, Susan E. Dudley
Defining What To Regulate: Silica And The Problem Of Regulatory Categorization, Andrew P. Morriss, Susan E. Dudley
Faculty Scholarship
This article examines the history of human exposure to silica, the second most common element on earth, to explore the problem of categorizing substances for regulatory purposes and the role interest groups play in developing policy. The regulatory history of silica teaches three important lessons: First, the most compelling account of the cycle of action and inaction on the part of regulators is the one based on interest groups. Second, knowledge about hazards is endogenous - it arises in response to outside events, to regulations, and to interest groups. Accepting particular states of knowledge as definitive is thus a mistake, …

The Flagellar Motility Of Chlamydomonas Pf25 Mutant Lacking An Akap-Binding Protein Is Overtly Sensitive To Medium Conditions, Chun Yang, Pinfen Yang
Biological Sciences Faculty Research and Publications
Radial spokes are a conserved axonemal structural complex postulated to regulate the motility of 9 + 2 cilia and flagella via a network of phosphoenzymes and regulatory proteins. Consistently, a Chlamydomonas radial spoke protein, RSP3, has been identified by RII overlays as an A-kinase anchoring protein (AKAP) that localizes the cAMP-dependent protein kinase (PKA) holoenzyme by binding to the RIIa domain of PKA RII subunit. However, the highly conserved docking domain of PKA is also found in the N termini of several AKAP-binding proteins unrelated to PKA as well as a 24-kDa novel spoke protein, RSP11. Here, we report that …

Litigating To Regulate: Massachusetts V. Environmental Protection Agency, Andrew P. Morriss
Litigating To Regulate: Massachusetts V. Environmental Protection Agency, Andrew P. Morriss
Faculty Scholarship
By a 5-4 vote in Massachusetts v. Environmental Protection Agency, the Supreme Court took yet another significant step away from the Framers' vision of the judiciary and toward a politicized Supreme Court sitting as a super-legislature and super-regulator. The Court substituted its judgment for that of the politically accountable branches of the federal government. By dramatically loosening the rules of standing, the Court invited those unhappy with the federal government's failure to regulate in a particular manner in any substantive area to use the federal courts to force federal agencies to regulate. In short, the Court encouraged interest groups …
