Between Rights And Contract: Arbitration Agreements And Non-Compete Covenants As A Hybrid Form Of Employment Law, Cynthia Estlund Jan 2006

Between Rights And Contract: Arbitration Agreements And Non-Compete Covenants As A Hybrid Form Of Employment Law, Cynthia Estlund

Faculty Articles

The employment relationship is governed largely by contract, but with a heavy overlay of “rights”: minimum terms and individual rights that are established by external law and are typically nonwaivable. But some terms of employment are governed neither by ordinary contract nor by ordinary rights, nor even by ordinary waivable rights. Both of the two most controversial contractual instruments in employment law today—non-compete covenants and mandatory arbitration agreements—take the form of written contracts; both waive important employee rights (the right to compete postemployment, the right to litigate future claims); and both are subject to substantive criteria of validity that are …

The Supreme Court’S Casual Use Of The Assignment Of Income Doctrine, Brant J. Hellwig Jan 2006

The Supreme Court’S Casual Use Of The Assignment Of Income Doctrine, Brant J. Hellwig

Faculty Articles

In early 2005, the U.S. Supreme Court answered a question that had been plaguing courts for years: whether plaintiffs should be taxed on the portion of contingent fee awards paid to their attorneys. The Court determined that they should. In this article, Professor Brant J. Hellwig focuses on the analysis employed by the Court to reach its conclusion in Commissioner v. Banks and the implications of that analysis for future cases. Although Professor Hellwig believes that the Court correctly ascertained the plaintiff’s tax burden, he suggests that the Court’s use of the assignment of income doctrine was both unnecessary to …

Credit Card Accountability, Samuel Issacharoff, Erin F. Delaney Jan 2006

Credit Card Accountability, Samuel Issacharoff, Erin F. Delaney

Faculty Articles

The dramatic expansion in consumer credit, particularly through the ready availability of credit cards, raises significant questions about checks on potentially unscrupulous behavior. In democratized markets characterized by large sellers and small transaction consumers, there is the risk that marginal charges may impose costs not worth the consumer's bother, but amounting in the aggregate to significant gains for the seller. This article examines the problem of insufficient regulatory responses as a result of the creation of effective barriers against deterrence-based oversight of the credit card market. The first barrier is the ability of small states to export favorable treatment of …

Safety And Security, Jeremy Waldron Jan 2006

Safety And Security, Jeremy Waldron

Faculty Articles

When people talk, as they often do, about a trade-off between security and liberty-when they say (as many people said after September 11, 2001) that we need to adjust the balance between security and civil liberties -what do they mean by security? Talk of a liberty-security balance has become so common that many view it as just an ambient feature of our political environment: "[I]t has become a part of the drinking water in this country that there has been a tradeoff of liberty for security, . . . that we have had to encroach upon civil liberty and trade …

How Children’S Lawyers Serve State Interests, Martin Guggenheim Jan 2006

How Children’S Lawyers Serve State Interests, Martin Guggenheim

Faculty Articles

I am pleased to be a part of this conference and to have this opportunity to expand my focus of concern over providing children with lawyers from the details of the role of lawyers to a consideration of the costs associated with providing them. This article is limited to the subject of representing children in child welfare cases. In this article, I will recount the history of child welfare practice in New York City. I do this because it is a history I know best, having practiced there since I graduated from law school in 1971. I also believe this …

Federalism As Westphalian Liberalism, Roderick M. Hills Jr. Jan 2006

Federalism As Westphalian Liberalism, Roderick M. Hills Jr.

Faculty Articles

In what follows, I will describe three sorts of liberalism, each of which attempts to side-step deep disagreements by appealing to our shared intuitions about the right process or institution for resolving disputes. I will call two of these theories “Millian” and “Madisonian” liberalism after their most famous proponents, John Stuart Mill and James Madison. These two versions of liberalism dominate constitutional doctrine and scholarship, although constitutional theorists do not always recognize them as theories about neutral decision-making processes. But the third theory, which I will dub “Westphalian” liberalism, after the Peace of Westphalia that is its most famous and, …

Children's Attorneys' Obligation To Turn To Parents To Assess Best Interests, Christine Gottlieb Jan 2006

Children's Attorneys' Obligation To Turn To Parents To Assess Best Interests, Christine Gottlieb

Faculty Articles

Since the introduction of lawyers for children into child welfare proceedings, lawyers have struggled with how to determine their child clients' best interests. There has been widespread recognition that lawyers bring no particular expertise to such assessments. A sense of humility has led to calls to avoid imposing lawyers' subjective values on their clients. A desire for fairness has led to calls that like cases be treated alike. Sensitivity to the race, class, gender, and culture dynamics of today's child welfare system has led to awareness of the dangers of imposing our particular perspectives-however well intentioned-on clients. Yet while there …
