Hiding In Plain View: A Neglected Supreme Court Decision Resolves The Debate Over Non-Debtor Releases In Chapter 11 Reorganizations, Joshua M. Silverstein

Law Faculty Scholarship

This article presents a novel resolution of a long-standing circuit split on an issue of critical significance to bankruptcy and tort law: whether bankruptcy courts may extinguish liabilities of parties that have not filed for bankruptcy. Such "non-debtor releases" are similar in effect to a bankruptcy discharge and have become particularly common in both mass tort disputes and general insolvencies adjudicated through the bankruptcy process. In this article, I illustrate how an overlooked Supreme Court decision—United States v. Energy Resources, 495 U.S. 545 (1990)—offers crucial support for the pro-release position. Energy Resources demonstrates that the bankruptcy courts’ "general equitable power" …

American Indian mascots have been used by High Schools, Colleges and Professional sports teams for decades. Such use of monikers and mascots that depict Native American images and stereotypes have come under intense criticism in the past decade. Despite the outcry, a few professional sports teams and major Division I institutions continue to stubbornly persist in using derogatory and offensive nicknames and stereotypes for their athletic competitors.

This article urges those stubborn institutions and professional sports teams to reconsider the use of names and monikers that demean and disparage. By reconsidering the reasonable person standard, examining recent caselaw, and discussing …

Improving Mental Health Assessments For Looked After Children, Michael Murray Jan 2006

Improving Mental Health Assessments For Looked After Children, Michael Murray

Irish Journal of Applied Social Studies

As part of the UK's National Health Service modernisation agenda, the Department of Health, Social Services and Public Safety, Northern Ireland set up a Service Improvement Unit (SIU). The aim of the SIU was to identify key areas in the Health and Social Services that needed improvement and to provide a structured framework in which to achieve the necessary developments. A key area identified was the interface between children in care and the Child and Adolescent Mental Health Services. It was believed that a lot of work needed to be undertaken to identify those children and young people in the …

Why People Who Face Losing Their Homes In Legal Proceedings Must Have A Right To Counsel, Andrew Scherer Jan 2006

Why People Who Face Losing Their Homes In Legal Proceedings Must Have A Right To Counsel, Andrew Scherer

Cardozo Public Law, Policy & Ethics Journal

The article advocates for the establishment of a right to counsel for individuals facing eviction in New York City's Housing Court, arguing that such a right is essential for fair legal proceedings, aligns with constitutional principles of due process and equal protection, and is cost-effective in preventing homelessness and reducing societal costs. The author emphasizes that the current system disproportionately disadvantages low-income tenants, who often lack legal representation, and draws on international precedents where such rights are recognized.

The Housing Court Act (1972) And Computer Technology (2005): How The Ambitious Mission Of The Housing Court To Protect The Housing Stock Of New York City May Finally Be Achieved, Mary Marsh Zulack

Cardozo Public Law, Policy & Ethics Journal

The New York City Housing Court, established in 1972, was designed to preserve the city's housing stock by consolidating housing-related cases and empowering judges to ensure repairs. However, the court faces a significant challenge in measuring its effectiveness due to a lack of comprehensive data. The author proposes implementing a database system to track repair-related information, which would enhance the court's ability to enforce housing standards, make its operations transparent, and align its activities with its mission.

Social Productivity, Law, And The Regulation Of Conflicts Of Interest In The Investment Industry, Larry D. Barnett Jan 2006

Social Productivity, Law, And The Regulation Of Conflicts Of Interest In The Investment Industry, Larry D. Barnett

Cardozo Public Law, Policy & Ethics Journal

The article introduces the concept of "social productivity," a sociological framework analyzing how organized groups influence society through their actions and policies. It distinguishes social productivity from economic productivity by focusing on social outputs like reputation, symbols, trust, and behavioral standards, which can enhance or diminish societal well-being. The article argues that law plays a critical role in mitigating harm and restoring trust by regulating behavior and reflecting societal values. It advocates for considering social productivity in policy and legal frameworks to foster a stable society, emphasizing the non-economic impacts of group actions on the social fabric.

Ethnobotanical Leaflets

Olive oil is a natural fruit, product of fine aroma, pleasant taste and has high nutritional values. Olive oil is considered as most useful edible oil in the world due to its nutrient contents and well tolerated by the stomach. Olive oil provides beneficial effects against ulcer, gastritis and colon cancer. It is composed of triglycerides, free fatty acids hydrocarbons, antioxidants and flavor compounds. In the present study we report new edible oil extracted from fruit of wild olive (Olea cuspedata). Samples of olive fruits were collected from hilly areas of Kotli Sattian, (District Rawalpindi) and were analyzed to evaluate …

Economic Development And The Role Of Agricultural Technology, Richard Grabowski, Sharmistha Self Jan 2006

Economic Development And The Role Of Agricultural Technology, Richard Grabowski, Sharmistha Self

Economics Discussion Papers

In earlier debates on economic development, the agricultural sector’s role was somewhat controversial. While dualistic models highlighted the importance of agriculture, the mainstream literature placed a greater emphasis on the creation of a modern industrial sector. Soon agriculture disappeared from the mainstream development literature to re-emerge recently with a variety of multiple-sector growth models emphasizing the key role of agriculture and specifically technology in agriculture. This paper is an empirical cross-country analysis of agricultural technology’s role in economic development. Specifically, the hypothesis being tested is whether improvements in agricultural technology have a significant impact on long-run economic growth. The results …

Local Flexibility In Molecular Function Paradigm, Jag Bhalla, Geoffrey B. Storchan, Caitlin M. Maccarthy, Vladimir N. Uversky, Olga Tcherkasskaya Jan 2006

Local Flexibility In Molecular Function Paradigm, Jag Bhalla, Geoffrey B. Storchan, Caitlin M. Maccarthy, Vladimir N. Uversky, Olga Tcherkasskaya

Molecular Medicine Faculty Publications

It is generally accepted that the functional activity of biological macromolecules requires tightly packed three-dimensional structures. Recent theoretical and experimental evidence indicates, however, the importance of molecular flexibility for the proper functioning of some proteins. We examined high resolution structures of proteins in various functional categories with respect to the secondary structure assessment. The latter was considered as a characteristic of the inherent flexibility of a polypeptide chain. We found that the proteins in functionally competent conformational states might be comprised of 20–70% flexible residues. For instance, proteins involved in gene regulation, e.g. transcription factors, are on average largely disordered …

Molecular Medicine Faculty Publications

Recent proteome-wide screening approaches have provided a wealth of information about interacting proteins in various organisms. To test for a potential association between protein connectivity and the amount of predicted structural disorder, the disorder propensities of proteins with various numbers of interacting partners from four eukaryotic organisms (Caenorhabditis elegans, Saccharomyces cerevisiae, Drosophila melanogaster, and Homo sapiens) were investigated. The results of PONDR VL-XT disorder analysis show that for all four studied organisms, hub proteins, defined here as those that interact with ≥10 partners, are significantly more disordered than end proteins, defined here as those that interact with just one partner. …
