Regulatory Purpose And 'Like Products' In Article Iii:4 Of The Gatt (With Additional Remarks On Article Iii:2), Donald H. Regan

Book Chapters

In EC-Asbestos the Appellate Body has told us that (l) in interpreting Article III:4 of the GATT, we must take explicit account of the policy in Article III: l that measures should not be applied "so as to afford protection to domestic production" [hereafter just "so as to afford protection"]. In Chile- Alcohol the Appellate Body has told us that (2) in deciding whether a measure is applied "so as to afford protection," we must consider "the purposes or objectives of a Member's legislature and government as a whole"- in other words, the regulatory purpose of the measure. Chile- Alcohol …

A Parent Information Guide For Assisting Their Child With The Transition To High School, Wendi Frank Jan 2006

A Parent Information Guide For Assisting Their Child With The Transition To High School, Wendi Frank

All Graduate Projects

The purpose of this project was to develop a guide for parents of Eisenhower High School and the various feeder middle schools in the Yakima School District to help the eighth graders transitioning from middle school to high school. The intent of the program was to increase the ninth grade student's academic and social success by having parents involved in the transition along with various transition activities. To accomplish this purpose, a review of current literature, research and selected programs related to transitioning middle school students and parent involvement in the transition, were examined. The culminating guide was designed and …

A 5-Stage Cross-Cultural Reentry Training Model: Proactive Curriculum And Training Giude For Exchange Organization Representatives, Sponsor Teachers And Returning Student Sojourners, Stacey Anne Howell

All Graduate Projects

This project is the result of an exploration into the process and product of cross-cultural reentry; that is, reentry into one's country of origin following an extended stay in a host country. The history of reentry training programs in the United States was researched, the process of cross-cultural adjustment was explored, and research involving the identity development of adolescents and the effects of stress on adolescents and adolescent sojourners was reviewed. Following a review of the research in these areas, an extensive five-stage curriculum model for cross-cultural reentry training was designed. The curriculum model includes a complete training outline, a …

Fostering Academic Achievement For Out-Of-Home Students In Transition, Valory Porter Jan 2006

Fostering Academic Achievement For Out-Of-Home Students In Transition, Valory Porter

All Graduate Projects

This manuscript is intended to serve as a resource for instructors seeking to assist out-of-home youth to successfully transition from the foster care system to post•system living. Frequently, teens transitioning out of foster care have deficiencies in effective independent living skills, useful employment training, and knowledge of post-high school options. A discussion of the information supporting this position is provided, as well as a review of related literature and research. The implementation of a transitional curriculum focused on independent living skills will help provide at-risk youth in out-of-home care with the skills necessary to become positive, contributing members of society …

Giving Credit Where Credit Is Due: Avoiding Plagiarism In Christian Writing And Speaking, Gregory A. Smith

Faculty Publications and Presentations

Plagiarism is an ethical breach involving the misuse of others' intellectual property. Instances of alleged plagiarism have discredited various Christian ministers and authors. Various style manuals provide guidelines for acknowledging direct quotation, paraphrasing, and other uses of sources. Preachers and teachers should adapt those guidelines to the context of verbal communication.

Embedding Engagement Into The University: Lessons Learned From A Case Study Of One Public Research University, Jodi Anderson Jan 2006

Embedding Engagement Into The University: Lessons Learned From A Case Study Of One Public Research University, Jodi Anderson

Higher Education

In recent years, practitioners, faculty, administrators and students have called for institutions of higher education to undergo change in order to more fully embrace their civic roles. However, little research on this topic has examined how universities might undertake institutional change efforts for these purposes. In particular, scant attention has been given to understanding the rationale for developing university centers for community partnerships and how they might begin to stimulate public research universities to embed engagement into the institution. Therefore, the focus of this paper is the presentation of findings from a case study at one public research university. In …

Laboratory And Field Assessment Of Some Kairomone Blends For Host-Seeking Aedes Aegypti, Craig R. Williams, Ramona Bergbauer, Martin Geier, Daniel L. Kline, Ulrich R. Bernier, Richard Russell, Scott A. Ritchie

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Using laboratory Y-tube olfactometers, the attractiveness of lactic acid and 2 kairomone blends from the United States Department of Agriculture (USDA) and BioGents GmbH (BG) was assessed for attractiveness to Aedes aegypti. Four geographically disparate populations were assessed: North Queensland Australia (NQA), Florida USA, Minas Gerais Brazil (MGB), and Singapore. In descending order, populations were attracted to USE)A, BG blends, and lactic acid. MGB was poorly attracted to lactic acid alone. The blends were less attractive than human odor. Proprietary blends were modified, and their attractiveness was assessed to find the optimum attractive mixture for NQA. Adding acetone to …

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Surface arthropods on pome fruits can cause export problems and disrupt commercial markets. Eliminating insects and mites on the packing line would be the last opportunity to provide for pest-free produce. In this study, an experimental packing line was used to evaluate techniques using different surfactant baths, pressurized water sprays, and styles of rotating brushes to remove field-collected and laboratory-reared grape mealybug, Pseudococcus maritimus (Ehrhorn) (Homoptera: Pseudococcidae), the diapausing two-spotted spider mite, Tetranychus urticae Koch (Acari: Tetranychidae) and the woolly apple aphid, Eriosoma lanigerum (Hausman) (Homoptera: Aphididae). The organosilicone Silwet L-77 was no more effective than a silicone-based food grade …

Characterization Of A Higher Plant Herbicide-Resistant Phytoene Desaturase And Its Use As A Selectable Marker, R. S. Arias, Franck E. Dayan, Albrecht Michel, J’Lynn Howell, Brian E. Scheffler

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Three natural somatic mutations at codon 304 of the phytoene desaturase gene (pds) of Hydrilla verticillata (L. f. Royle) have been reported to provide resistance to the herbicide fluridone. We substituted the arginine 304 present in the wild-type H. verticillata phytoene desaturase (PDS) with all 19 other natural amino acids and tested PDS against fluridone. In in vitro assays, the threonine ( Thr), cysteine (Cys), alanine (Ala) and glutamine (Gln) mutations imparted the highest resistance to fluridone. Thr, the three natural mutations [Cys, serine (Ser), histidine (His)] and the wild-type PDS protein were tested in vitro against seven …

Current Trends In Quarantine Entomology, Peter A. Follett, Lisa G. Neven Jan 2006

Current Trends In Quarantine Entomology, Peter A. Follett, Lisa G. Neven

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

With world trade in agricultural commodities increasing, the introduction of exotic insects into new areas where they become pests will increase. The development and application of quarantine treatments or other mitigation approaches to prevent pest introduction in traded commodities raise many research and regulatory issues. The probit 9 standard for quarantine treatment efficacy has given way to risk-based alternatives. Varietal testing may have merit for some treatments or commodities but not for others. Development of generic treatments to control broad groups of insects or insects in all commodities can expedite new trade in agricultural products. Area-wide pest management programs lower …

Embracing Uncertainty, Complexity, And Change: An Eco-Pragmatic Reinvention Of A First-Generation Environmental Law, Mary Jane Angelo Jan 2006

Embracing Uncertainty, Complexity, And Change: An Eco-Pragmatic Reinvention Of A First-Generation Environmental Law, Mary Jane Angelo

UF Law Faculty Publications

Recent scientific reports demonstrate that despite more than thirty years of environmental regulation, bird and wildlife species as well as ecosystem services, are in unprecedented decline. Pesticides are at least in part to blame for these profound declines. U.S. pesticide law has failed to carry out its mission of environmental protection. A number of recently-filed lawsuits assert that the registration of certain pesticides violates the federal Endangered Species Act. One of the great ironies of environmental law is that the ecological consequences of pesticide use, which fueled the environmental movement of the late 1960s and early 1970s, largely have been …

Sexual Labor And Human Rights, Berta E. Hernández-Truyol, Jane E. Larson Jan 2006

Sexual Labor And Human Rights, Berta E. Hernández-Truyol, Jane E. Larson

UF Law Faculty Publications

In this Article, we engage the current human rights debate that dichotomizes prostitution either as a modern form of slavery or as the exercise of the right to work. This framework effectively sets up a coercion/consent polarity. These poles raise fundamental human rights issues; both the prohibition against slavery and the right to work are matters addressed by and central to the international human rights paradigm. Yet we argue in this Article that the human rights issues raised by prostitution cannot properly be studied nor moved towards meaningful resolution in the context of the prevailing polarity. Prostitution in its current …

Defending The Polygon: The Emerging Human Right To Communal Property, Thomas T. Ankersen, Thomas K. Ruppert

UF Law Faculty Publications

For many peoples in the developing world, "homeland security" has a meaning very different from its post-September 11 meaning in the United States. In many cases, peoples who have a shared cultural conception of "territory" within nation-states have begun to adopt the dominant Western property paradigm of land titling to formalize their rights to that territory. Many view this paradigm and the individualization of property rights it facilitates as an inevitable outcome of the inexorable march of social evolution, evidenced by the end of the twentieth century collapse of communism. The Enlightenment era conception of fungible individual property emerged triumphant. …

Unsafe abortion is a major public health and human rights problem in
Argentina. Implementation of a woman-centered post-abortion care
(PAC) model is one strategy to improve the situation. The quality of PAC
services was measured in three public hospitals in Tucumin, a province
with high levels of poverty and maternal mortality due to unsafe abortion.
Overall, the quality of PAC services was found to be poor. Women
do not receive services in a manner that respects their human rights, in
particular their rights to health and health care, information, and to the
benefits of scientific progress. Findings from the evaluation …

Comparative Mapping Of Bovine Chromosome 27 With Human Chromosome 8 Near A Dairy Form Qtl In Cattle, E. E. Connor, M. S. Ashwell, R. Schnabel, J. L. Williams Jan 2006

Comparative Mapping Of Bovine Chromosome 27 With Human Chromosome 8 Near A Dairy Form Qtl In Cattle, E. E. Connor, M. S. Ashwell, R. Schnabel, J. L. Williams

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

In the absence of a complete and annotated bovine genome sequence, detailed human-bovine comparative maps are one of the most effective tools for identification of positional candidate genes contributing to quantitative trait loci (QTL) in cattle. In the present study, eight genes from human chromosome 8 were selected for mapping in cattle to improve breakpoint resolution and confirm gene order on the comparative map near the 40 cM region of the BTA27 linkage map where a QTL affecting dairy form had previously been identified. The resulting map identified ADRB3 as a positional candidate gene for the QTL contributing to the …

The Law Of The Lakes: From Protectionism To Sustainability, Christine A. Klein Jan 2006

The Law Of The Lakes: From Protectionism To Sustainability, Christine A. Klein

UF Law Faculty Publications

This Article has a practical goal: to convince state lawmakers of the need to regulate in a comprehensive and evenhanded manner, avoiding short-sighted fixes or politically appealing shortcuts. To accomplish that goal, Part I focuses upon another region of the country-the Colorado River Basin-where residents have also undertaken the task of managing a water system that includes two nations(The United States and Mexico) and numerous states. Learning from the successes and failures of the resultant Law of the River, this Article derives guiding principles for the emerging Law of the Lakes. Part II makes a crucial distinction between protectionism and …

Is It Sometimes Good To Run Budget Deficits? If So, Should We Admit It (Out Loud)?, Neil H. Buchanan Jan 2006

Is It Sometimes Good To Run Budget Deficits? If So, Should We Admit It (Out Loud)?, Neil H. Buchanan

UF Law Faculty Publications

There are bad deficits and there are good deficits. What makes a fiscal deficit good or bad depends on both the context in which the deficit is run and the reason that the deficit is rising. The belief that it is unquestionably foolish to adopt policies that directly or indirectly increase the government's annual borrowing on the financial markets - which is what it means to run a budget deficit - is not the universal truth that the current conventional wisdom might imply. Budget deficits are potentially dangerous and must be monitored carefully, but they are not always, inevitably, completely, …

Some Preliminary Statistical, Qualitative, And Anecdotal Findings Of An Empirical Study Of Collegiality Among Law Professors, Michael L. Seigel, Kathi Minor-Rubino Jan 2006

Some Preliminary Statistical, Qualitative, And Anecdotal Findings Of An Empirical Study Of Collegiality Among Law Professors, Michael L. Seigel, Kathi Minor-Rubino

UF Law Faculty Publications

In advance of a sophisticated analysis of the survey data, one must be very careful in drawing any overall conclusions about the state of collegiality and workplace well-being in legal academia. Certainly, no correlative assertions can be made. Nevertheless, this preliminary review has revealed some noteworthy information. Certainly, law faculties are far from perfectly collegial associations, and many if not most law professors have a gripe of one sort or another. Despite these facts, however, the overwhelming majority of faculty members appear to be happy with their choice of career. The qualitative data also leaves one with the impression that, …

The Experimental Use Exception To Patent Infringement: Do Universities Deserve Special Treatment?, Elizabeth A. Rowe Jan 2006

The Experimental Use Exception To Patent Infringement: Do Universities Deserve Special Treatment?, Elizabeth A. Rowe

UF Law Faculty Publications

The experimental use exception is a common law exception to the patent-holder's exclusive right of use. It permits the use of another's patented device when such use is for philosophical inquiry, curiosity, or amusement. It has recently come under attack by many who consider it too narrow. They fear that the courts' "narrowing" of the experimental use exception will stifle research and innovation. Much of the discontent with the doctrine has been spurred by a relatively recent Federal Circuit opinion, Madey v. Duke University, which makes clear that a research university does not receive immunity under the experimental use …
