Toward A New Horizontal Federalism: Interstate Water Management In The Great Lakes Region, Noah D. Hall Jan 2006

Toward A New Horizontal Federalism: Interstate Water Management In The Great Lakes Region, Noah D. Hall

Law Faculty Research Publications

This article presents a new model for environmental policy, called cooperative horizontal federalism. The cooperative horizontal federalism approach utilizes a constitutional mechanism for states to bind themselves to common substantive and procedural environmental protection standards, implemented individually with regional resources and enforcement. Here, the concept of the cooperative horizontal federalism model is illustrated through the recently proposed Great Lakes-St. Lawrence River Basin Water Resources Compact. Under this proposed compact, the eight Great Lakes states would cooperatively manage the world's largest freshwater resource under common minimum standards, which are then incorporated into state law and implemented individually. This cooperative horizontal federalism …

White Collar Crime Sentences After Booker: Was The Sentencing Of Bernie Ebbers Too Harsh?, Peter J. Henning Jan 2006

White Collar Crime Sentences After Booker: Was The Sentencing Of Bernie Ebbers Too Harsh?, Peter J. Henning

Law Faculty Research Publications

Bernie Ebbers received a twenty-five year prison sentence for his conviction on conspiracy and securities fraud charges related to the collapse of WorldCom in 2001. The Ebbers sentence came at a time of significant upheaval in the world of sentencing law. The Supreme Court reordered federal sentencing just a few months before the district court sentenced Ebbers, and the prison term largely follows the Federal Sentencing Guidelines even though, after United States v. Booker, they are no longer mandatory, but only advisory for federal judges. While the sentence was likely close to the one Ebbers would have received under a …

Communicating Feelings: Links Between Mothers' Representations Of Their Infants, Parenting, And Infant Emotional Development, Katherine L. Rosenblum, Carolyn Joy Dayton, Susan Mcdonough Jan 2006

Communicating Feelings: Links Between Mothers' Representations Of Their Infants, Parenting, And Infant Emotional Development, Katherine L. Rosenblum, Carolyn Joy Dayton, Susan Mcdonough

Social Work Faculty Publications

In the present chapter we explore how mothers' internal working models of their seven-month-old infants organize emotions in the parenting context, and ultimately, influence infant emotion regulation. We propose that mothers' internal working models of their infants function as emotion regulators, and influence a variety of components of the affective organization of parenting, including a) maternal emotion activation, b) qualities of maternal emotional engagement with their infants, and c) emotion regulation strategies mothers employ during emotionally challenging interactions. Results underscore the important role played by emotional processes in explaining the correspondence between maternal and infant emotion regulation strategies.

A Model For Emergency Service Of Voip Certification And Labeling, Tom Lookabaugh, Patrick S. Ryan, Douglas C. Sicker Jan 2006

A Model For Emergency Service Of Voip Certification And Labeling, Tom Lookabaugh, Patrick S. Ryan, Douglas C. Sicker

Federal Communications Law Journal

The diffusion of VoIP technology promises revolutionary changes to a century old model of voice telephony. Though these changes bring extraordinary opportunities, they also bring challenging policy implications for businesses and regulators. In this Article, the Authors examine the technical difficulties of providing the same quality and dependability of emergency services in VoIP based telephony as consumers have come to expect from PSTN-based telephone networks. Given the technical complexity and heterogeneity of VolP, the Authors propose industry self-regulation through an advanced certification framework as a more effective alternative to direct government regulation. After surveying a number of successful self-regulatory regimes, …

Costs And Consequences Of Federal Telecommunications Regulations, Jerry Ellig Jan 2006

Costs And Consequences Of Federal Telecommunications Regulations, Jerry Ellig

Federal Communications Law Journal

Federal regulation of telecommunication profoundly affects United States consumers, determining what services are priced above and below cost, what kinds of technologies and services are offered and when, and what firms are allowed to compete. In this Article, the Author surveys the voluminous literature on the economic costs and outcomes of these regulations, focusing predominantly on the effects of regulation on prices, quantity, quality of service, and overall consumer and social welfare. The Author estimates costs and assesses outcomes for ten types of federal telecommunications regulated activity: telecommunications regulatory spending, long-distance access charges, universal service funding, local number portability, enhanced …

Why Stovepipe Regulation No Longer Works: An Essay On The Need For A New Market-Oriented Communications Policy, Randolph J. May Jan 2006

Why Stovepipe Regulation No Longer Works: An Essay On The Need For A New Market-Oriented Communications Policy, Randolph J. May

Federal Communications Law Journal

In the ten years since the 1996 Telecommunications Act, the telecommunications industry has undergone profound technological and marketplace changes. May argues that the "techno-functional constructs" of the statute regulate services based on increasingly obsolete definitions. This Article argues that those changes have undermined the "stovepipe" regulatory scheme of the 1996 Act. In an increasingly diverse and competitive marketplace, the "stovepipe" model of regulation should be left in the dustbin of history. Instead, May argues that a new market-oriented regulatory regime focusing on consumer welfare through the application of antitrust principles should form the basis of a new regulatory model.

Communications Policy For 2006 And Beyond, Reed H. Hundt, Gregory L. Rosston Jan 2006

Communications Policy For 2006 And Beyond, Reed H. Hundt, Gregory L. Rosston

Federal Communications Law Journal

In this Article, the Authors propose sweeping changes to the current telecommunications regulatory regime. With impending reform in telecommunications laws, the Authors argue that an important first step is the creation of a bipartisan, independent commission to examine and recommend implementation of more market-oriented communications policy. Through maximizing the operation of the markets, the authors argue that communications policy will better serve its goals of increasing business productivity and consumer welfare through the better services and lower prices. Important steps to achieve optimal market operation include deregulating retail prices where multifirm competition is available, minimizing the cost of public property …

Seeking Different Treatment, Or Seeking The Same Regard: Remarketing The Transracial Adoption Debate, Angela Mae Kupenda Jan 2006

Seeking Different Treatment, Or Seeking The Same Regard: Remarketing The Transracial Adoption Debate, Angela Mae Kupenda

Journal Articles

The transracial adoption discourse mistakenly has been phrased as a request for black children awaiting adoption to be treated different from white children and to be placed with parents of like race only. This paper urges a remarketing of the transracial adoption debate to reflect a request based on sameness, not difference. The request presented here is not a request for different treatment for black children. Rather, it is for black children to be given the same regard that is given to white children. This request is illustrated with the story of a black couple seeking to adopt healthy, fat …

Understanding The Person Beneath The Robe: Practical Methods For Neutralizing Harmful Judicial Biases, Evan R. Seamone Jan 2006

Understanding The Person Beneath The Robe: Practical Methods For Neutralizing Harmful Judicial Biases, Evan R. Seamone

Journal Articles

This article presents hands-on self-awareness techniques for use by judges, arbitrators, members of commissions, and other legal decision-makers who are confronted with complex cases. All too often, these judges are expected to make the “right” decisions without knowing how to accomplish this task. While judges, no doubt, are capable of applying the law to a case, this is only one aspect of righteous behavior. This article is concerned with the related expectation that judges are capable of rendering fair and impartial decisions. No matter how much training they receive, judges can only avoid biases that are known to them.
