Dissolving The Divide: Cross-Racial Communication In The Restorative Justice Process, Krista Smith Jan 2006

Dissolving The Divide: Cross-Racial Communication In The Restorative Justice Process, Krista Smith

Dalhousie Journal of Legal Studies

Restorative justice encounters often bring together participants of differing races. The communication style of participants has a significant impact on such encounters. To date, the restorative justice literature has given little attention to the effect of cross-racial communication on the encounter process. This paper discusses this issue by exploring the risks and opportunities present when an individual from a traditionally marginalized race openly shares her experience of the crime with an individual from the dominant race. In order to draw these risks and opportunities into high relief, the author relies on a single example: a restorative justice encounter between a …

Pandemics And Pandemonium: Constitutional Jurisdiction Over Public Health, Keri Gammon Jan 2006

Pandemics And Pandemonium: Constitutional Jurisdiction Over Public Health, Keri Gammon

Dalhousie Journal of Legal Studies

It has long been accepted that the provinces have general jurisdiction over healthcare. But many aspects of public health – the branch concerned with the welfare of populations – can be argued to lend themselves to federal involvement. This was recently illustrated in 2003 when SARS, a previously unknown disease, arrived in Toronto and wreaked havoc on the local public health system. The epidemic highlighted numerous shortcomings within Ontario’s system and caused us to question those of the other provinces. Not surprisingly, the federal government quickly came under heavy pressure to take leadership and action in respect of public health. …

“One For All: The Problem Of Uniformity Cost In Intellectual Property Law.” American University Law Review 55, No.4 (May 2006): 845-900., Michael W. Carroll Jan 2006

“One For All: The Problem Of Uniformity Cost In Intellectual Property Law.” American University Law Review 55, No.4 (May 2006): 845-900., Michael W. Carroll

American University Law Review

Intellectual property law protects the owner of each patented invention or copyrighted work of authorship with a largely uniform set of exclusive rights. In the modern context, it is clear that innovators' needs for intellectual property protection vary substantially across industries and among types of innovation. Applying a socially costly, uniform solution to problems of differing magnitudes means that the law necessarily imposes uniformity cost by underprotecting those who invest in certain costly innovations and overprotecting those with low innovation costs or access to alternative appropriability mechanisms. This Article argues that reducing uniformity cost is the central problem for intellectual …

From Pirates To Partners (Episode Ii): Protecting Intellectual Property In Post-Wto China, Peter K. Yu Jan 2006

From Pirates To Partners (Episode Ii): Protecting Intellectual Property In Post-Wto China, Peter K. Yu

American University Law Review

In From Pirates to Partners: Protecting Intellectual Property in China in the Twenty-First Century, I criticized the ineffectiveness and short-sightedness of the U.S.-China intellectual property policy. As I argued, the approach taken by the administration in the 1980s and early 1990s had created a cycle of futility in which China and the United States repeatedly threatened each other with trade wars only to back down in the eleventh hour with a compromise that did not provide sustainable improvements in intellectual property protection. Since I wrote that article five years ago, China has joined the WTO and undertook a complete overhaul …

The Cape Town Approach: A New Method Of Making International Law, Mark J. Sundahl Jan 2006

The Cape Town Approach: A New Method Of Making International Law, Mark J. Sundahl

Law Faculty Articles and Essays

The use of multilateral treaties in the field of international commercial law has been in a state of steady decline. Traditional treaty law has been gradually replaced in recent years by softer methods of making international law, such as the use of restatements and model laws. Some scholars even claim that treaty law is dead or dying. This Article explains how the Cape Town Convention on International Interests in Mobile Equipment (which entered into force on March 1, 2006) provides an innovative approach to the creation of treaties that promises to revive the status of treaties in international law. The …

Changing The Bathwater And Keeping The Baby: Exploring New Ways Of Evaluating Intent In Environmental Discrimination Cases, Browne C. Lewis Jan 2006

Changing The Bathwater And Keeping The Baby: Exploring New Ways Of Evaluating Intent In Environmental Discrimination Cases, Browne C. Lewis

Law Faculty Articles and Essays

This paper is divided into four parts. Part one consists of a general overview of the problem of environmental discrimination. Part two gives a brief discussion of relevant Equal Protection jurisprudence. The section begins with a summary of general Equal Protection law. Then, the section analyzes the primary cases that established the foundation of modem-day Equal Protection doctrine. Part three examines the current application of the intent requirement in environmental discrimination cases. To that end, the section reviews the outcome of three of the early environmental discrimination cases, and speculates about the components that are necessary to prepare a successful …

The Puzzle Of Ivf, Dena S. Davis Jan 2006

The Puzzle Of Ivf, Dena S. Davis

Law Faculty Articles and Essays

This essay seeks to address a puzzling element of the current political and legal struggles over abortion in the United States: if, as pro-life activists insist, embryos are morally equivalent to born, living persons, then why do these activists not oppose in vitro fertilization (IVF) as aggressively as they oppose abortion? IVF accounts for a significant number of destroyed embryos. Constitutionally, IVF appears to be a much more vulnerable target than abortion. And yet, legislative and political attempts to attack and restrict IVF are few, while attempts to erode women's capability to terminate pregnancies are a constant feature of our …

Size Matters: Gastric Pouch Size As A Predictor Of Weight Loss Following Laparoscopic Roux-Y Gastric Bypass, Joyce I. Kaufman

Yale Medicine Thesis Digital Library

Introduction: The identification of relevant components of successful weight reduction surgery is the most important endeavor in the latest research aiming to increase excess weight loss. Over the past twenty years there has been ongoing discussion about the importance of gastric pouch size as one of the key factors influencing weight loss after restrictive weight reduction surgery. The goal of our analysis is to determine the relationship between pouch size and weight reduction following laparoscopic Roux-Y gastric bypass (LRYGB). Methods: Between August 2002 and March 2005, 321 LRYGB procedures were performed at the same institution. Patient demographics were entered into …

T Cell Integrin Dependent, Mkk3/P38 Mapk-Mediated Stabilization Of Labile Cytokine Mrnas, Scott David Degregorio

Yale Medicine Thesis Digital Library

The goal of this project is to elucidate the signaling pathway involved in the T cell integrin lymphocyte function-associated antigen 1 (LFA-1) engagement-mediated, HuR nuclear-to-cytoplasmic translocation and subsequent mRNA stabilization. To examine the pathway transducing LFA-1 engagement-mediated mRNA stabilization, we employed quantitative, real time RT-PCR in the presence of a transcriptional inhibitor to examine the half-life of interferon gamma (IFN-γ) mRNA, a labile cytokine transcript. We used immunofluorescence to observe the nuclear-to-cytoplasmic tranlocation of HuR, an mRNA-binding and stabilizing protein. We also used Western blot analysis to analyze the activity levels of specific mitogen activated protein kinases (MAPKs) upon LFA-1 …

Onset And Exacerbation Of Obsessive-Compulsive Disorder In Pregnancy And The Postpartum Period, Mariel Aida Focseneanu

Yale Medicine Thesis Digital Library

The overarching goal of this study was two-fold; to determine the prevalence of perinatal onset or worsening of OCD symptoms in women attending a university-based research program, and to determine whether there is a continuity between perinatal onset or worsening of OCD and premenstrual exacerbation of such symptoms. Women ages 18 to 69 years old that were enrolled in the Yale OCD Research Program between 1990 and 1995 were interviewed by phone or in person regarding demographics, onset and course of OCD, types of primary OCD symptoms, treatment history, comorbid diagnoses including substance use/abuse, and the impact of pregnancy and …

A Quantitative Analysis Of Computed Tomography Scanner Utilization In An Academic Medical Center, Amichai J. Erdfarb Jan 2006

A Quantitative Analysis Of Computed Tomography Scanner Utilization In An Academic Medical Center, Amichai J. Erdfarb

Yale Medicine Thesis Digital Library

The purpose of this study is to quantify computed tomography (CT) scanner utilization and productivity in an academic hospital setting and determine the primary causes of idle time. Two CT scanners were observed for a total of 202 scanner-hours. Scanner time was divided into two primary components: "active" and "idle." Active time was further divided into preparation, scan, and take-down times. Independent variables recorded include in- vs. outpatient, IV contrast (IVC) vs. non-IVC, and scanner type. Primary contributors to idle time were identified in six main categories: preventative maintenance (PM), technical failure, upgrades, calibration, understaffing, and poor flow management. 275 …

Educational Studies Dissertations

The British author and educator Alice Yardley (1913-2002) worked in Nottingham City Schools (UK) as a teacher and headteacher between 1934 and 1961, and was instrumental in the evolution of the English Infant School for five to seven year olds as a model of progressive theory and practice in action... Based on information gathered from interviews with Alice Yardley over a three year period (1999-2002) and incorporating a number of primary sources, including her memoir, notebooks, archival documents and records, visits to places where she lived and taught, and conversations with her colleagues and students, the dissertation draws on historical …

Intimate Homicide: Gender And Crime Control, 1880-1920, Carolyn B. Ramsey Jan 2006

Intimate Homicide: Gender And Crime Control, 1880-1920, Carolyn B. Ramsey

University of Colorado Law Review

The received wisdom, among feminists and others, is that historically the criminal justice system tolerated male violence against women. This article dramatically revises feminist understanding of the legal history of public responses to intimate homicide by showing that, in both the eastern and the western United States, men accused of killing their intimates often received stern punishment, including the death penalty, whereas women charged with similar crimes were treated leniently. Although no formal "battered woman's defense" existed in the late 1800s and early 1900s, courts and juries implicitly recognized one-and even extended it to abandoned women who killed their unfaithful …

Automatic Detection Of Sleep And Wake States In Mice Using Piezoelectric Sensors, Dharshan C. Medonza Jan 2006

Automatic Detection Of Sleep And Wake States In Mice Using Piezoelectric Sensors, Dharshan C. Medonza

University of Kentucky Master's Theses

Currently technologies such as EEG, EMG and EOG recordings are the established methods used in the analysis of sleep. But if these methods are to be employed to study sleep in rodents, extensive surgery and recovery is involved which can be both time consuming and costly. This thesis presents and analyzes a cost effective, non-invasive, high throughput system for detecting the sleep and wake patterns in mice using a piezoelectric sensor. This sensor was placed at the bottom of the mice cages to monitor the movements of the mice. The thesis work included the development of the instrumentation and signal …

The Psychological Assessment Of Applicants For Priesthood And Religious Life, Thomas G. Plante Jan 2006

The Psychological Assessment Of Applicants For Priesthood And Religious Life, Thomas G. Plante

Psychology

The recent clergy sexual abuse scandals in the Roman Catholic Church have focused a great deal of attention on how we evaluate applicants to the priesthood and religious life. The crisis has underscored the critical need to ensure that men who have a sexual predilection towards children be barred from entering religious life and priesthood. Additionally, men who have other significant psychiatric conditions that put them at risk of harming children or others have no place as Church leaders or clergy in positions where they have access to and power over vulnerable others.

The Virtues And Vices Of Sovereignty, Sarah Krakoff Jan 2006

The Virtues And Vices Of Sovereignty, Sarah Krakoff

Publications

American Indian tribal sovereignty is viewed very differently in the United States Supreme Court than it is in American Indian tribal nations. The United States Supreme Court, the progenitor of the legal doctrine of tribal sovereignty, appears skeptical of the doctrine's continuing viability. The Court is therefore veering away from any strong notion of retained inherent tribal sovereignty. American Indian tribes, the sources and perpetuators of de facto tribal sovereignty, are more committed than ever to enacting their sovereignty on the ground, as well as promoting and protecting its legal status in the courts and in Congress. There is an …

Our Places To Tell Stories: Making Connections With Our Audiences, Public Lands Institute Jan 2006

Our Places To Tell Stories: Making Connections With Our Audiences, Public Lands Institute

Our Places to Tell Stories

The idea for an annual Our Places Tell Stories conference was prompted by discussions that took place within a unique partnership of federal, state, university, and public organizations in southern Nevada. Members identified the need to share and learn from successful educational and interpretive strategies. Our increasingly urban surroundings and rapidly changing populations hinder personal connections between people and their natural environment. However, the right tools and techniques will help us inspire children and adults to understand, value, and take care of our shared natural places.

This first conference supports professionals in creating and evaluating effective educational programs and interpretive …

Buildings At The Center: Reasons For Building Tabernacles, Aaron Mcarthur Jan 2006

Buildings At The Center: Reasons For Building Tabernacles, Aaron Mcarthur

Psi Sigma Siren

There were generally three different motivations for the construction of a tabernacle in a specific community. The first was that the leadership of the Church in Salt Lake directed communities to build one. Leaders did this in settlements that they believed were to become important central communities for gatherings and large meetings. The decision was also made in areas that the Church desired to strengthen their claim to, legally and emotionally. In 1863, Brigham Young decided that the struggling cotton mission in St. George needed a shot in the arm. To rally the community, he determined that a tabernacle would …
