Wal-Martization And The Fair Share Health Care Acts, Julia Contreras, Orly Lobel Jan 2006

Wal-Martization And The Fair Share Health Care Acts, Julia Contreras, Orly Lobel

St. Thomas Law Review

In January 2006, Maryland passed a bill mandating employer contribution to employee health insurance in very large corporations, in effect, targeting one large retailer: Wal-Mart.' Around the same time, the American Federation of Labor-Congress of Industrial Unions ("AFL-CIO") and other worker advocacy groups launched a major health care campaign in approximately thirty other states, demanding that the nation's largest corporations contribute to employee health care provision. The Fair Share Health Care Act ("FSHA" or the "Act") was enacted by the Maryland state legislature in an effort to leverage private resources necessary to maintain government-funded health insurance.' The Act requires corporations …

Assessing Treatment Integrity: A Case Example, Anat Zeira, Betty Blythe, Anita Reithoffer Jan 2006

Assessing Treatment Integrity: A Case Example, Anat Zeira, Betty Blythe, Anita Reithoffer

Journal of Family Strengths

This paper presents an example of assessing treatment integrity as part of an experimental study of home-based, intensive family preservation services (IFPS). Participants were 103 IFPS workers and 24 state public child welfare agency workers (FC). The structured, self-report questionnaire included questions about specific components of the services, as well as the characteristics of the family and the workers themselves. Findings suggest that IFPS workers delivered services according to the treatment model guidelines. The procedure yielded a good estimate of whether the structural components of treatment were delivered according to the model as delineated in the treatment manual. The paper …

Post-Permanency: An Assessment For Families’ Needs For Services And Supports, Madelyn Freundlich, Rosemary J. Avery, Sarah Gerstenzang, Sara Munson

Journal of Family Strengths

This article reports the results of a qualitative study that sought the perspectives of birth parents and adoptive parents following reunification or adoption of children from foster care. Using a participatory action design that actively involved young adults formerly in foster care and parents in the design and implementation of the study, the study focused on the consumers’ perspectives on several issues related to permanency. The article reports findings from interviews with a subset of 27 birth and adoptive families in New York City who were asked about their post-permanency experiences and from interviews with 38 child welfare professionals who …

Looking Inside The Black Box, Daria V. Hanssen, Irwin Epstein Jan 2006

Looking Inside The Black Box, Daria V. Hanssen, Irwin Epstein

Journal of Family Strengths

Intensive family preservation services (IFPS), designed to stabilize at-risk families and avert out-of-home care, have been the focus of many randomized, experimental studies. The emphasis on "gold-standard" evaluation of IFPS has resulted in fewer "black box" studies that describe actual IFPS service patterns and the fidelity with which they adhere to IFPS program theory. Intervention research is important to the advancement of programs designed to protect the safety of children, improve family functioning, as well as prevent out-of-home placement. Employing a retrospective “clinical data-mining” (CDM) methodology, this exploratory study of Families First, an IFPS program, makes use of available information …

Can Consumer-Driven Health Care, Health Reimbursement Arrangements And Health Savings Accounts Save Employer Sponsored Health Care From Ruin, Larry Grudzien Jan 2006

Can Consumer-Driven Health Care, Health Reimbursement Arrangements And Health Savings Accounts Save Employer Sponsored Health Care From Ruin, Larry Grudzien

St. Thomas Law Review

Employer sponsored health care programs have been in crisis for over ten years because, year after year, health care costs and premiums continue to increase faster than inflation. Employers have tried a number of solutions, but nothing seems to stop the trend. Between 2000 to 2006, premiums for family health coverage increased by 87% compared with general inflation growth of 18% and wage growth of 20%.2 Employee spending for health insurance coverage increased 126% between 2000 and 2004. Since 2001, the employees share of health insurance costs have soared 63% for single coverage and 58% for family coverage.3 For 2006 …

State Law Health Care Initiatives, Susan J. Stabile Jan 2006

State Law Health Care Initiatives, Susan J. Stabile

St. Thomas Law Review

The failure of the federal government to enact comprehensive health care reform has led to efforts by states to regulate both access to and quality of care. However, the ability of states to contribute solutions to the health care crisis has been limited by ERISA's broad preemption of state law. Thus, the federal government has arguably created the worst of all possible worlds-lack of a comprehensive federal approach while hampering the ability of the states to attempt to enact meaningful reform. In many areas of the law, states have been looked to as laboratories for innovative public policy. States have …

Global Macroeconomic Trends, Thomas Power Jan 2006

Global Macroeconomic Trends, Thomas Power

Articles

The business of real estate is but a subset of the wider investment markets and macroeconomic trends will significantly shape the way real estate investment decisions are made. The McKinsey Institute is a global economic consultancy firm providing cutting-edge research on a wide range of macroeconomic and business trends. This article reviews macroeconomic trends that they believe will transform the global economy. McKinsey research show that “over two-thirds of organic growth of western companies can be attributed to being in the right markets and geographies” and “companies that ride the tide succeed and those that swim against it usually struggle” …

Cultural Compactness, Daniel R. Oritz Jan 2006

Cultural Compactness, Daniel R. Oritz

Michigan Law Review First Impressions

The Supreme Court’s opinions in LULAC v. Perry, the Texas redistricting case, confounded expectation. While many believed that the Court would develop the law governing partisan gerrymandering in one direction or another, it did not. As exactly before, such claims are justiciable but there is no law to govern them. In other words, the courthouse doors are open, but until some plaintiff advances a novel theory persuasive to five justices, no claims will succeed. On the other hand, few expected the Court to make any major changes to doctrine under the Voting Rights Act and Shaw v. Reno. But LULAC …

Still "Left In The Dark": The Confrontation Clause And Child Abuse Cases After Davis V. Washington, Anthony J. Franze, Jacob E. Smiles

Michigan Law Review First Impressions

In his concurring opinion in Crawford v. Washington, Chief Justice Rehnquist criticized the majority for holding that the Confrontation Clause applies to “testimonial” statements but leaving for “another day” any effort to define sufficiently what “testimonial” means. Prosecutors and defendants, he said, “should not be left in the dark in this manner.” Over the next two years, both sides grappled with the meaning of testimonial, each gleaning import from sections of Crawford that seemingly proved their test was the right one. When the Court granted certiorari in Davis v. Washington and Hammon v. Indiana (hereinafter Davis), hopes were high that …

Site-Specific Labeling Of Supercoiled Dna., Alexander Y. Lushnikov, Vladimir N. Potaman, Yuri L. Lyubchenko

Journal Articles: Pharmaceutical Sciences

Visualization of site-specific labels in long linear or circular DNA allows unambiguous identification of various local DNA structures. Here we describe a novel and efficient approach to site-specific DNA labeling. The restriction enzyme SfiI binds to DNA but leaves it intact in the presence of calcium and therefore may serve as a protein label of 13 bp recognition sites. Since SfiI requires simultaneous interaction with two DNA recognition sites for stable binding, this requirement is satisfied by providing an isolated recognition site in the DNA target and an additional short DNA duplex also containing the recognition site. The SfiI/DNA complexes …

The Relationship Between Religious Coping And Psychological Adjustment To College, Monika A. Harasim-Pieper

Graduate Theses and Dissertations

This study examined the relationship between religious coping and psychological adjustment to college in participants (A/=211) recruited from undergraduate introductory psychology classes at a Catholic university in the Midwest. Participants completed self-report questionnaires measuring psychological adjustment (i.e. Anxiety, Depression, Alcohol Consumption), religious problem-solving style (i.e., Deferring, Self-Directing, Collaborative) and nonreligious coping (i.e., Denial, Seeking Social Emotional Support, Planning). This study addressed the following questions: 1) To what extent do first year college students use religious coping? The study produced partial support for the hypothesis that first-year students use religious coping 2) How does religious coping relate to adjustment to college? …
