State Regulation Of Unsolicited Bulk Commercial E-Mail And The Dormant Commerce Clause, Jeffrey D. Zentner

Vanderbilt Journal of Entertainment & Technology Law

This note will analyze the implications of the dormant Commerce Clause as applied to Virginia's stringent anti-spam law, under which two spammers have already been convicted of felony spamming. Part I will lay out the background of anti-spam legislation, case law involving other state statutes, and a brief history of United States Supreme Court dormant Commerce Clause jurisprudence. Part II will examine the validity of state spam regulation under the Federal CAN-SPAM Act of 2003 and current dormant Commerce Clause jurisprudence, using Virginia's anti-spam law as an example. Finally, Part III will examine the shortcomings of the CAN-SPAM Act and …

"Neutralism" In Worcestershire, Margaret Bertram Jan 2006

"Neutralism" In Worcestershire, Margaret Bertram

Constructing the Past

This article discusses the supposed "neutralism" of the county of Worcestershire in the 1640s and suggests that the reason it seemed to be neutral was because there were many different groups there that balanced each other, rather than a single, yet neutral force.

Sovereignty, Identity, And The Apparatus Of Death, Tawia Baidoe Ansah Jan 2006

Sovereignty, Identity, And The Apparatus Of Death, Tawia Baidoe Ansah

Faculty Publications

Ten years after the genocide in Rwanda, the government issued broad new laws outlawing the use of ethnic categories, with a view to uniting all Rwandans under a single Rwandan identity. This self-erasure of ethnic identity is deployed primarily within the borders of the state, to enable reconciliation after the genocide in 1994. Outside the borders, the state deploys ethnic identity as one of the rationales for its cross-border wars (in the Democratic Republic of Congo).

Firm Size Diversity, Functional Richness, And Resilience, Ahjond S. Garmestani, Craig R. Allen, John D. Mittelstaedt, Craig A. Stow, William A. Ward Jan 2006

Firm Size Diversity, Functional Richness, And Resilience, Ahjond S. Garmestani, Craig R. Allen, John D. Mittelstaedt, Craig A. Stow, William A. Ward

Nebraska Cooperative Fish and Wildlife Research Unit: Staff Publications

This paper applies recent advances in ecology to our understanding of firm development, sustainability, and economic development. The ecological literature indicates that the greater the functional richness of species in a system, the greater its resilience – that is, its ability to persist in the face of substantial changes in the environment. This paper focuses on the effects of functional richness across firm size on the ability of industries to survive in the face of economic change. Our results indicate that industries with a richness of industrial functions are more resilient to employment volatility.

This paper discusses the quality and the accuracy of the Joint Research Center (JRC) fraction of absorbed photosynthetically active radiation (FAPAR) products generated from an analysis of Sea-viewing Wide Field-of-view Sensor (SeaWiFS) data. The FAPAR value acts as an indicator of the presence and state of the vegetation and it can be estimated from remote sensing measurements using a physically based approach.

Intra-Seasonal Ndvi Change Projections In Semi-Arid Africa, Chris C. Funk, Molly E. Brown Jan 2006

Intra-Seasonal Ndvi Change Projections In Semi-Arid Africa, Chris C. Funk, Molly E. Brown

United States National Aeronautics and Space Administration: Publications

Early warning systems (EWS) tend to focus on the identification of slow onset disasters such famine and epidemic disease. Since hazardous environmental conditions often precede disastrous outcomes by many months, effective monitoring via satellite and in situ observations can successfully guide mitigation activities. Accurate short term forecasts of NDVI could increase lead times, making early warning earlier. This paper presents a simple empirical model for making 1 to 4 month NDVI projections. These statistical projections are based on parameterized satellite rainfall estimates (RFE) and relative humidity demand (RHD). A quasi-global, 1 month ahead, 1° study demonstrates reasonable accuracies in many …

Complexity Trends In The Evolutionary History Of Dasycladalean Algae, Michael Stearns Jan 2006

Complexity Trends In The Evolutionary History Of Dasycladalean Algae, Michael Stearns

Senior Honors Theses and Projects

Dasycladalean algae are a group of marine algae that have an excellent fossil record extending back more than 500 million years. In our study, we investigated morphological complexity over the evolutionary history of this group. To determine complexity for each of more than 400 species, we assigned numerical values for six morphological features; the sum for each species forms a quantitative expression of complexity. We found that although maximum complexity increased over time, forms with minimum complexity persisted during most of the evolutionary history of the group.

Preserving Nature, Shahid Naeem, Robin S. Waples, Craig Moritz Jan 2006

Preserving Nature, Shahid Naeem, Robin S. Waples, Craig Moritz

United States Department of Commerce: Staff Publications

To consider the broader environmental significance of protecting species at risk of extinction, we must first consider the roles or functions that species fulfill in nature. Although "nature" has many definitions, here we define it to mean the end product of ecological and evolutionary processes. That is, within ahabitat, region, or biosphere, the condition of the soil, water, air, and biota reßects the outcome of physical, chemical, ecological, and evolutionary processes. We refer to this combination of abiotic and biotic conditions as "nature" and to the ecological and evolutionary processes that create it as "natural processes."

Using these definitions, we …

Survival Estimates Of Western Gray Whales Eschrichtius Robustus Incorporating Individual Heterogeneity And Temporary Emigration, Amanda Bradford, Paul R. Wade, David Weller, Alexander M. Burdin, Yulia V. Ivashchenko, Grigory A. Tsidulko, Glenn R. Vanblaricom, Robert L. Brownell Jr. Jan 2006

Survival Estimates Of Western Gray Whales Eschrichtius Robustus Incorporating Individual Heterogeneity And Temporary Emigration, Amanda Bradford, Paul R. Wade, David Weller, Alexander M. Burdin, Yulia V. Ivashchenko, Grigory A. Tsidulko, Glenn R. Vanblaricom, Robert L. Brownell Jr.

United States Department of Commerce: Staff Publications

Gray whales Eschrichtius robustus exist as a 2 geographically and genetically distinct populations in the eastern and western North Pacific. Subjected to intensive commercial whaling during the 19th and 20th centuries, the western population presently numbers approximately 100 individuals and is regarded as one of the most endangered baleen whale populations in the world.

Spatial Statistical Models That Use Flow And Stream Distance, Jay M. Ver Hoef, Erin Peterson, David Theobald Jan 2006

Spatial Statistical Models That Use Flow And Stream Distance, Jay M. Ver Hoef, Erin Peterson, David Theobald

United States Department of Commerce: Staff Publications

We develop spatial statistical models for stream networks that can estimate relationships between a response variable and other covariates, make predictions at unsampled locations, and predict an average or total for a stream or a stream segment. There have been very few attempts to develop valid spatial covariance models that incorporate flow, stream distance, or both. The application of typical spatial autocovariance functions based on Euclidean distance, such as the spherical covariance model, are not valid when using stream distance. In this paper we develop a large class of valid models that incorporate flow and stream distance by using spatial …

Eolian Additions To Late Quaternary Alpine Soils, Indian Peaks Wilderness Area, Colorado Front Range, Daniel R. Muhs, James B. Benedict Jan 2006

Eolian Additions To Late Quaternary Alpine Soils, Indian Peaks Wilderness Area, Colorado Front Range, Daniel R. Muhs, James B. Benedict

United States Geological Survey: Staff Publications

Surface horizons of many alpine soils on Quaternary deposits in high-mountain settings are enriched in silt. The origin of these particles has been debated, particularly in the Rocky Mountain region of North America. The most common explanations are frost shattering of coarser particles and eolian additions from distant sources. We studied soil A horizons on alpine moraines of late-glacial (Satanta Peak) age in the Colorado Front Range. Surface horizons of soils on these moraines are enriched in silt and have a particle size distribution that resembles loess and dust deposits found elsewhere. The compositions of sand and silt fractions of …

Ice Sheets And Sea Level, Johannes Oerlemans, Dorthe Dahl-Jensen, Valérie Masson-Delmotte, Jonathan T. Overpeck, Bette L. Otto-Bliesner, Gifford H. Miller, Richard B. Alley, Daniel R. Muhs, Shawn J. Marshall

United States Geological Survey: Staff Publications

The estimate of the contribution of the Greenland Ice Sheet (GIS) to the higher sea level stand in the Eemian interglacial (between 2.2 and 3.4 m) is based on the assumption that there was no ice at the location of the Dye-3 ice core in southern Greenland. However, Eemian ice has been found at the base of this ice core. The presence of Eemian ice in south and coastal Greenland implies that the GIS was essentially intact in a much warmer climate and could not have contributed more than 1 to 2 m to sea-level rise.

Department of Plant Pathology: Faculty Publications

The soybean cyst nematode Heterodera glycines (SCN) is of major economic importance and widely distributed throughout soybean production regions of the United States where different maturity groups with the same sources of SCN resistance are grown. The objective of this study was to assess SCN-resistant and -susceptible soybean yield responses in infested soils across the northcentral region. In 1994 and 1995, eight SCN-resistant and eight SCN-susceptible public soybean cultivars representing maturity groups (MG) I to IV were planted in 63 fields, either infested or noninfested, in 10 states in the north-central United States. Soil samples were taken to determine initial …

Effects Of Historical Climate Change, Habitat Connectivity, And Vicariance On Genetic Structure And Diversity Across The Range Of The Red Tree Vole (Phenacomys Longicaudus) In The Pacific Northwestern United States, Mark P. Miller, M. Renee Bellinger, Eric D. Forsman, Susan M. Haig Jan 2006

United States Geological Survey: Staff Publications

Phylogeographical analyses conducted in the Pacific Northwestern United States have often revealed concordant patterns of genetic diversity among taxa. These studies demonstrate distinct North/South genetic discontinuities that have been attributed to Pleistocene glaciation. We examined phylogeographical patterns of red tree voles (Phenacomys longicaudus) in western Oregon by analysing mitochondrial control region sequences for 169 individuals from 18 areas across the species’ range. Cytochrome b sequences were also analysed from a subset of our samples to confirm the presence of major haplotype groups. Phylogenetic network analyses suggested the presence of two haplotype groups corresponding to northern and southern regions …

Federalism As Westphalian Liberalism, Roderick M. Hills Jr. Jan 2006

Federalism As Westphalian Liberalism, Roderick M. Hills Jr.

Faculty Articles

In what follows, I will describe three sorts of liberalism, each of which attempts to side-step deep disagreements by appealing to our shared intuitions about the right process or institution for resolving disputes. I will call two of these theories “Millian” and “Madisonian” liberalism after their most famous proponents, John Stuart Mill and James Madison. These two versions of liberalism dominate constitutional doctrine and scholarship, although constitutional theorists do not always recognize them as theories about neutral decision-making processes. But the third theory, which I will dub “Westphalian” liberalism, after the Peace of Westphalia that is its most famous and, …

Provincial Anthropology, Circumlocution, And The Copious Use Of Everything, Laurie Kain Hart Jan 2006

Provincial Anthropology, Circumlocution, And The Copious Use Of Everything, Laurie Kain Hart

Anthropology Faculty Scholarship

Provincial towns are not miniature replicas of national metropolises but centers with their own trajectories of aesthetic and civic development. They operate in a regional context in relation both to the rural villages within their spheres of influence and to international cultural circuits. Inhabitants of peripheral towns in Greece negotiate the challenges of pluralism, modernization, and the hegemony of the nation state in their own social, political, and cultural idioms of accommodation and distancing. A close analysis of the modern history, city planning, and architecture of Florina in Western Greek Macedonia, particularly in the period between WWI and WWII, shows …
