The Rise And Fall Of Patent Law Uniformity And The Need For A Congressional Response, Scott Cole Apr 2006

The Rise And Fall Of Patent Law Uniformity And The Need For A Congressional Response, Scott Cole

Chicago-Kent Law Review

Congress established the Federal Circuit Court of Appeals a quarter century ago to create uniformity in the field of patent law. By significantly limiting the appellate jurisdiction of the Federal Circuit in patent related cases, the recent decision of Holmes v. Vornado in the United States Supreme Court makes this goal an impossibility. This Article addresses the purposes of uniformity in patent law, the ramifications of the limited jurisdiction of the Federal Circuit, and concludes with a proposed Congressional response designed to withstand a future appeal to the Supreme Court.

War Over Water: Water, Poverty, And Conflict, Tyker Mcmahon Apr 2006

War Over Water: Water, Poverty, And Conflict, Tyker Mcmahon

Independent Study Project (ISP) Collection

The theme of this paper is; “What else would you do with 500 million dollars?” In a country as small and diverse as Nepal, with many immediate needs, are large scale projects really the answer at the present time? The stage that this paper will be set in is the 1990’s during the democracy and the beginning of the Maoist insurgency. Also, happening during this time was the pursuit of several large-scale projects like the Mahakali Treaty and the Melamchi Water Delivery Project. These both involved projects that would potentially bring large benefits but were also fraught with uncertainties relating …

The Political Landscape Of Mycenaean States: A-Pu2 And The Hither Province Of Pylos, Michael B. Cosmopoulos Apr 2006

The Political Landscape Of Mycenaean States: A-Pu2 And The Hither Province Of Pylos, Michael B. Cosmopoulos

Educator Preparation & Leadership Faculty Works

Our knowledge of the political landscape of the Mycenaean state of Pylos has been shaped largely by the evidence from the palatial center at Ano Englianos and also by the shortage of systematic and fully published archaeological fieldwork in nonpalatial sites. In the present article an effort is made to shift our perspective from the palatial center to one of the administrative districts of the Pylian state. The study draws on the results of a current archaeological project investigating Iklaina, which has been plausibly identified as a-pu2, one of the district capitals of the Hither province of Pylos. After …

The Life And Impact Of Daniel Alexander Payne, Brian A. Vazzano Apr 2006

The Life And Impact Of Daniel Alexander Payne, Brian A. Vazzano

Hidden in Plain Sight Projects

On Washington Street, across from McKnight Hall and adjacent to the Intercultural Resource Center, a sign stands in commemoration of the life and accomplishments of an African American who studied at the seminary from 1835 to 1837. The plaque reads: Daniel Alexander Payne (1811-1893). Born a free African American. He taught the colored people at this college, 1837, while a student at the Lutheran Seminary. A historian, he was elected bishop of the AME Church, 1852, and was president of Wilberforce University, 1863-76. What Payne was able to achieve in his life is matched by few of his contemporaries …

Internationalization From Emerging Nations: Evidence Of Strategic Entrepreneurship, J Ramachandran, Sourav Mukherji, M Sud

Working Papers

This study focuses on firms from emerging economies competing in global markets. Such internationalization initiatives are intensely risky because of ("ertain characteristics specific to emerging nations such as resource scarcity. Drawing inferences from our case based research on two firms from the Indian pharmaceutical industry, we propose that firms need to exhibit entrepreneurial behaviour in order to grapple with the risks that they confront while entering and competing in highly advanced global markets. Specifically, firms were found to adopt a strategy of 'fund as you go' to overcome resource constraints over and above the model of 'learn as you go', …

Nitrogen Spatial Heterogeneity Influences Diversity Following Restoration In A Ponderosa Pine Forest, Montana, Michael J. Gundale, Kerry L. Metlen, Carl E. Fiedler, Thomas H. Deluca Apr 2006

Nitrogen Spatial Heterogeneity Influences Diversity Following Restoration In A Ponderosa Pine Forest, Montana, Michael J. Gundale, Kerry L. Metlen, Carl E. Fiedler, Thomas H. Deluca

Forest Management Faculty Publications

The resource heterogeneity hypothesis (RHH) is frequently cited in the ecological literature as an important mechanism for maintaining species diversity. The RHH has rarely been evaluated in the context of restoration ecology in which a commonly cited goal is to restore diversity. In this study we focused oil the spatial heterogeneity of total inorganic nitrogen (TIN) following restoration treatments in a ponderosa pine (Pinus ponderosa)/Douglas-fir (Pseudotsuga inenziesii) forest in western Montana, USA. Our objective was to evaluate relationships between understory species richness and TIN heterogeneity following mechanical thinning (thin-only), prescribed burning (burn-only), and mechanical thinning with prescribed burning (thin/burn) to …

Minority Protagonists In The Young Adult Historical Fiction Novel, Patty L. Martin Apr 2006

Minority Protagonists In The Young Adult Historical Fiction Novel, Patty L. Martin

Regis University Student Publications (comprehensive collection)

In young adult literature, the reader finds most of the same genres as are available for adult fiction. One of the challenges that readers of young adult literature face is that, although some progress has been made to develop and feature minority characters and protagonists, minorities are still underrepresented in young adult literature. Although young adult historical fiction features more minority protagonists, this is ordinarily done because historical fiction lends itself as an educational tool, where history, geography, and social studies can be illuminated through the genre. As demographics in the United States continue to change and as minority groups …

Considering The Relationship Between Religion And Psychology, Robert L. Gleave, Dallas R. Jensen, Roger Belisle, Philip L. Nelson

Issues in Religion and Psychotherapy

The interaction between Religion and Psychology, one of the founding principles of AMCAP, has been addressed several times in AMCAP forums (De Hoyos, 1982) and elsewhere (Richards & Bergin, 2005; Sorensen, 1981; Sperry & Shafranske, 2005). Many may have entered the helping professions to fulfill personal religious needs a well as service goals. The long standing dialogue on the topic of Religion in the helping professions will not end with this article, nor should it ever end in this life. We believe that examining the ways in which Religion and Psychology interface deserves the attention and effort of many minds, …

Chemical Taking: Glyphosate And The Eradication Of Due Process In Colombia, David A. Wilhite Apr 2006

Chemical Taking: Glyphosate And The Eradication Of Due Process In Colombia, David A. Wilhite

PEEL Alumni Scholarship

Cocaine politics continues to take a toll on Colombian social, political, economic, and legal stability. Coca is indigenous to the Andean Mountains and for hundreds of years, native populations and immigrants to the region have consumed its leaves for both medicinal and customary purposes. The United States consumes cocaine at a rate of over 300 metric tons per year. Each year approximately 6,548,000 North Americans consume cocaine, annually spending $43.6 billion. In an effort to curb this consumption, and because coca is the base of cocaine, the American and Colombian governments have combined forces using pesticide in an attempt to …

California's School Finance Reform: An Experiment In Fiscal Federalism, Eric J. Brunner, Jon Sonstelie Apr 2006

California's School Finance Reform: An Experiment In Fiscal Federalism, Eric J. Brunner, Jon Sonstelie

Economics Working Papers

The 1971 ruling of the California Supreme Court in the case of Serrano v. Priest initiated a chain of events that abruptly ended local financing of public schools in California. In seven short years, California transformed its school finance system from a decentralized one in which local communities chose how much to spend on their schools to a centralized one in which the state legislature determines the expenditures of every school district. This paper begins by describing California's school finance system before Serrano and the transformation from local to state finance. It then delineates some consequences of that transformation and …

Identifying Individual And Group Effects In The Presence Of Sorting: A Neighborhood Effects Application, Patrick Bayer, Stephen L. Ross Apr 2006

Identifying Individual And Group Effects In The Presence Of Sorting: A Neighborhood Effects Application, Patrick Bayer, Stephen L. Ross

Economics Working Papers

Researchers have long recognized that the non-random sorting of individuals into groups generates correlation between individual and group attributes that is likely to bias naive estimates of both individual and group effects. This paper proposes a non-parametric strategy for identifying these effects in a model that allows for both individual and group unobservables, applying this strategy to the estimation of neighborhood effects on labor market outcomes. The first part of this strategy is guided by a robust feature of the equilibrium in the canonical vertical sorting model of Epple and Platt (1998), that there is a monotonic relationship between neighborhood …

Evaluation Of Trends In Derived Snowfall And Rainfall Across Eurasia And Linkages With Discharge To The Arctic Ocean, Michael A. Rawlins, C J. Willmot, A Shiklomanov, Ernst Linder, Steve Frolking, Richard B. Lammers, Charles Vorosmarty Apr 2006

Lammers, Charles Vorosmarty

Earth Sciences

To more fully understand the role of precipitation in observed increases in freshwater discharge to the Arctic Ocean, data from a new archive of bias-adjusted precipitation records for the former USSR (TD9813), along with the CRU and Willmott-Matsuura data sets, were examined for the period 1936–1999. Across the six largest Eurasian river basins, snowfall derived from TD9813 exhibits a strongly significant increase until the late 1950s and a moderately significant decrease thereafter. A strongly significant decline in derived rainfall is also noted. Spatially, snowfall increases are found primarily across north-central Eurasia, an area where the rainfall decreases are most prominent. …

Building A City Of Ladies With Christine De Pizan And Arkansas State University Honors Students, Frances Malpezzi Apr 2006

Building A City Of Ladies With Christine De Pizan And Arkansas State University Honors Students, Frances Malpezzi

Journal of the National Collegiate Honors Council Online Archive

In “When We Dead Awaken: Writing as Re-Vision,” Adrienne Rich—American poet, feminist, and social critic—expressed exhilaration and confusion in being alive “in a time of awakening consciousness” (18). Self-knowledge, Rich emphasized, eludes us until we recognize and question the basic assumptions that shape our perspectives. Re-visioning is an important part of this process. For Rich, re-visioning is not the meticulous correcting of our comma splices and dangling modifiers but “the act of looking back, of seeing with fresh eyes, of entering an old text from a new critical direction” (18). The task Rich set before herself is not just the …

Grazing And Military Vehicle Effects On Grassland Soils And Vegetation, John A. Guretzky, Alan Anderson, Jeffrey Fehmi Apr 2006

Grazing And Military Vehicle Effects On Grassland Soils And Vegetation, John A. Guretzky, Alan Anderson, Jeffrey Fehmi

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

Vehicle training, a common disturbance of military lands, is part of a suite of land uses that also includes cattle grazing. Yet, no studies have examined their interaction. Our objective was to review the effects of vehicle training and grazing on grassland soils and vegetation and develop a state-and-transition model that incorporates grazing and training for Fort Hood, TX. Both grazing and training can cause soil compaction and vegetation disturbance, altering hydrology and increasing erosion. While the effects of grazing largely depend on stocking rate, vehicle training causes greater disturbance when wet soils are driven on, when vehicles are turned …
