Large-Scale Drainage Capture And Surface Uplift In Eastern Tibet-Sw China Before 24 Ma Inferred From Sediments Of The Hanoi Basin, Vietnam, Peter D. Clift, Jerzy Blusztajn, Nguyen Anh Duc

Faculty Publications

Current models of drainage evolution suggest that the non-dendritic patterns seen in rivers in SE Asia reflect progressive capture of headwaters away from the Red River during and as a result of surface uplift of Eastern Asia. Mass balancing of eroded and deposited rock volumes demonstrates that the Red River catchment must have been much larger in the past. In addition, the Nd isotope composition of sediments from the Hanoi Basin, Vietnam, interpreted as paleo-Red River sediments, shows rapid change during the Oligocene, before ~24 Ma. We interpret this change to reflect large-scale drainage capture away from the Red River, …

Lost Constitutional Moorings: Recovering The War Power, Louis Fisher Oct 2006

Lost Constitutional Moorings: Recovering The War Power, Louis Fisher

Indiana Law Journal

For the past half century, Presidents have claimed constitutional authority to take the country from a state of peace to a state of war against another nation. That was precisely the power that the Framers denied to the President and vested exclusively in Congress. That allocation of power was understood by all three branches until President Harry Truman went to war against North Korea in 1950. He never came to Congress for authority before he acted or at any time thereafter. Similar false claims of authority have been made by Presidents since that time. These constitutional violations have been assisted …

Youth, Governance And The City: Towards A Critical Urban Sociology Of Youth Crime And Disorder Prevention, Matt Bowden Oct 2006

Youth, Governance And The City: Towards A Critical Urban Sociology Of Youth Crime And Disorder Prevention, Matt Bowden

Articles

This article considers the historical and spatial context for the emergence of youth crime and disorder prevention initiatives in Ireland. These initiatives have to be understood in the context of their relationship to the broader ‘urban question’ and in particular the relationship of the peripheral housing estate to the rest of society and the economic sphere. More recent changes in the nature of society and the emergence of a ‘liberal creed’ have resulted in greater use of surveillance technologies for offsetting the opportunities for crime to be committed. In this context, youth crime prevention initiatives must be seen as an …

Liberating Estates Law From The Constraints Of Copyright, Lee-Ford Tritt Oct 2006

Liberating Estates Law From The Constraints Of Copyright, Lee-Ford Tritt

UF Law Faculty Publications

This Article addresses a disturbing statutory phenomenon of enormous importance to any artist, composer, writer, scholar, scientist or innovator. The phenomenon, which I have termed “estate-bumping,” has driven an unintended wedge between copyright law and estates law by effectively preventing authors of copyrights from disposing of their copyright interests through common estate planning mechanisms. Current copyright law imposes a unique restraint on the testamentary freedom of copyright authors, a restraint not imposed on any other type of property owner. In effect, this restraint enables unintended beneficiaries to rewrite, or “bump”, an author’s estate plan. Thus, it is copyright law – …

The International Dimension Of Regime Change: Economic Sanctions And The 1993 Democratic Transition In Nigeria, Kelechi A. Kalu Oct 2006

The International Dimension Of Regime Change: Economic Sanctions And The 1993 Democratic Transition In Nigeria, Kelechi A. Kalu

African Social Science Review

Within the context of the Post-Cold War international system, the annulled presidential elections in Nigeria in 1993 and the subsequent hanging of Ken Saro-Wiwa and eight members of the Movement for the Survival of Ogoni People (MOSOP) in 1995, the paper examines the argument for economic sanctions as a tool for international regime change. It clarifies the historical impact of colonialism and how that experience continues to constrain the use of traditional strategies of economic sanction to attempt to influence African governments, especially authoritarian governments. It argues that, if economic sanction as a tool of statecraft is to result in …

Constitutional Law & Criminal Law - The Eighth Amendment - The Juvenile Death Penalty: A Premature Decision Over Teenage Immaturity? Roper V. Simmons, 543 U.S. 551 (2005)., J. Blake Byrd Oct 2006

Constitutional Law & Criminal Law - The Eighth Amendment - The Juvenile Death Penalty: A Premature Decision Over Teenage Immaturity? Roper V. Simmons, 543 U.S. 551 (2005)., J. Blake Byrd

University of Arkansas at Little Rock Law Review

The final clause of the Eighth Amendment is the source of this nation's prohibition on unconstitutional punishment. Today, the Supreme Court's evolving-standard on the prohibition on unconstitutional punishment has two steps: The Court (1) looks at objective indicia of societal consensus against a particular practice and (2) ultimately uses its independent judgment to analyze whether the punishment is proportional to the offender's mental state and category of crime. There is tension within the Court, however, because some members believe that the evolving-standards jurisprudence is mistaken, and they fervently reject a proportionality analysis.

The United States has a long history of …

Intellectual Property - Copyright & Internet Law - "The Big Chill": The Supreme Court Adopts An Inducement Standard For Third-Party Copyright Infringement Liability, Leaving Innovation In The Cold Metro-Goldwyn-Mayer Studios, Inc. V. Grokster, Ltd., 125 S. Ct. 2764 (2005)., Darrin Keith Henning

University of Arkansas at Little Rock Law Review

A key feature of an effective copyright system is to provide protection against infringement that is consistent with a copyright's goal: to "promote . . . useful Arts." Thus, for the overall public good, it is vital to achieve a proper balance between protecting authors' works as an incentive to create and the public's interest in accessing both creative works and new technology. The outcome of Metro-Goldwyn-Mayer Studios, Inc. v. Grokster, Ltd. (Grosker III) and the resulting business and legal developments created ambiguity and doubt regarding potential liability in the copyright system that is having a deleterious effect on technical …

School Discipline 101: Students' Due Process Rights In Expulsion Hearings, Melissa Frydman, Shani M. King

UF Law Faculty Publications

Upholding the principle that school districts, as state actors, shall not deprive a student of liberty or property without due process of law, courts have expanded for more than four decades the Fourteenth Amendment's due process protection of public school students. Understanding this principle is essential to representing children in school discipline proceedings. Before presenting a practical guide to representing students in these proceedings, we offer a brief history of due process protection for children.
