Down To The Wire: Assessing The Constitutionality Of The National Security Agency's Warrantless Wiretapping Program: Exit The Rule Of Law, Fletcher N. Baldwin Jr., Robert B. Shaw Dec 2006

Down To The Wire: Assessing The Constitutionality Of The National Security Agency's Warrantless Wiretapping Program: Exit The Rule Of Law, Fletcher N. Baldwin Jr., Robert B. Shaw

UF Law Faculty Publications

The article discusses the constitutionality of warrantless wiretapping surveillance by the National Security Agency (NSA) on U.S. citizens. The wiretapping program existed weeks after the September 11, 2001 attacks, on the justification that Congress authorized the president to wiretap U.S. citizens without a warrant, and that the president had inherent authority as commander-in-chief. But it is argued that Congress did not expressly authorize the president to conduct warrantless wiretapping and that he does not have such inherent authority.

We intend this Article to be a commentary on the constitutionality of the NSA wiretapping program solely as it relates to the …

Boffin's Books And Darwin's Finches: Victorian Cultures Of Collecting, Michael W. Hancock '89 Dec 2006

Boffin's Books And Darwin's Finches: Victorian Cultures Of Collecting, Michael W. Hancock '89

Doctoral Dissertations

Although wealthy continental virtuosos had passionately and selectively accumulated a variety of natural and artificial objects from the Renaissance onwards, not until the nineteenth century did collecting become a conspicuous national pastime among all classes in Britain. As industry and empire made available many new and exotic goods for acquisition and display, the collection as a cultural form offered the Victorians a popular strategy of self-fashioning that was often represented in the literature of the age as a source of prestige and social legitimation. Through interdisciplinary readings of Victorian fiction, narrative nonfiction, and poetry, my study examines how textual representations …

Federal Communications Law Journal

In December 2000, Congress passed the Information Quality Act - a two sentence rider to a 712-page Appropriations Bill. The Information Quality Act, which seeks to ensure the quality of government-disseminated information, places the White House Office of Management and Budget in a supervisory role. The Office of Management and Budget subsequently finalized a set of mandatory Guidelines applicable to all federal agencies. Among other things, the Guidelines require adherence to the scientific standard articulated in the 1996 Amendments to the Safe Drinking Water Act where such agencies engage in risk analysis to human health, safety, and the environment. Pedagogy Of Social Justice: An Inquiry Into The Experiences Of African American Adolescent Males, Natalie Ann Lambright

College of Graduate Studies: Theses & Dissertations

Using Critical Race Theory (Crenshaw, Gotanda, Peller, & Thomas, 1995; Ladson-Billing, 1998; Richard Delgado & Jean Stefanic, 2000; Solorzano & Yasso, 2002) as a theoretical framework, and critical narrative inquiry (Clendanin & Connelly, 1999) as research methodology, I explored stories from five eighth grade African American adolescent males in order to identify how home, community, and school experiences contributed to their academic success and social development. My passion for the inquiry was driven for my desire to foster a sense of agency for social justice and positive changes for the African American community. Selection of participants was based upon reading …

Curriculum Of Imagination Beyond The Walls Of Standardization, Robert Lewis Lake

College of Graduate Studies: Theses & Dissertations

This dissertation is a theoretical inquiry into ways of seeing, knowing, and learning that are frequently excluded in this present climate of standardized practices in the field of education. In this study, I explore how imagination permeates every aspect of life experience and helps develop personal and political awareness in students to look beyond what they take for granted, to question the normal, and to develop various ways of knowing, seeing, feeling, and acting upon positive social and educational change in an era of accountability. This is accomplished by tracing the historical and contemporary evolution of the concepts of imagination …

Relational Leadership Theory: Exploring The Social Processes Of Leadership And Organizing, Mary Uhl-Bien Dec 2006

Relational Leadership Theory: Exploring The Social Processes Of Leadership And Organizing, Mary Uhl-Bien

Leadership Institute: Faculty Publications

Relational leadership is a relatively new term in the leadership literature, and because of this, its meaning is open to interpretation. In the present article I describe two perspectives of relational leadership: an entity perspective that focuses on identifying attributes of individuals as they engage in interpersonal relationships, and a relational perspective that views leadership as a process of social construction through which certain understandings of leadership come about and are given privileged ontology. These approaches can be complementary, but their implications for study and practice are quite different. After reviewing leadership research relative to these two perspectives I offer …

A Handheld Neutron-Detection Sensor System Utilizing A New Class Of Boron Carbide Diode, Kevin Osberg, Nathan Schemm, M. Susan Hallbeck, Sina Balkir, Peter A. Dowben, Jennifer I. Brand, Michael W. Hoffman

Peter Dowben Publications

A handheld neutron-detection sensor application is described in this paper. The sensor system utilizes a new class of boron carbide diode that interacts with incoming neutrons. To interface with the boron carbide diode, an integrated front end is designed in a 1.5-μm standard CMOS technology. With the diode and front-end microchip, a handheld neutron-detection system was realized with an embedded microcontroller for real-time processing. The handheld detector operation was then tested with a plutonium–beryllium neutron source. Test and measurement results confirm the validity of the approach and the functionality of the design.

Are Credit Card Late Fees Unconstitutional?, Seana Valentine Shiffrin Dec 2006

Are Credit Card Late Fees Unconstitutional?, Seana Valentine Shiffrin

William & Mary Bill of Rights Journal

State Farm Mutual Automobile Insurance Co. v. Campbell articulated serious and specific constitutional constraints upon the imposition of punitive damages. Justice Kennedy's majority opinion announced that, apart from exceptional cases, punitive damages should not exceed nine times the amount of the actual losses sustained by the plaintiff and should usually be far lower. Indeed, the opinion observed, they typically should be much lower, citing double, treble, and quadruple multipliers as "instructive" examples. Some commentators have worried that the decision could adversely affect consumer interests by offering insulation for tortious behavior that is difficult to detect or litigate. This Article will …

E-Lawyering, The Aba's Current Choice Of Ethics Law Rule & The Dormant Commerce Clause Invalidates Model Rule 8.5(B)(2) When Applied To Attorney Internet Representations Of Clients, Michael W. Loudenslager

William & Mary Bill of Rights Journal

The Internet is becoming the primary manner in which some attorneys serve clients. States have already taken differing views on whether it is acceptable for an attorney to engage in electronic representations of clients. Thus, determining what jurisdiction's law applies to such attorney conduct can be very important in deciding whether this activity constitutes the unauthorized practice of law and, if not, determining the exact duties of an attorney in such representations. This Article argues that the current version of Model Rule of Professional Responsibility 8.5(b), which governs choice of ethics law, can be interpreted to apply the legal ethics …

Linear Conditions Imposed On Flag Varieties, Julianna S. Tymoczko Dec 2006

Linear Conditions Imposed On Flag Varieties, Julianna S. Tymoczko

Mathematics Sciences: Faculty Publications

We study subvarieties of the flag variety called Hessenberg varieties, defined by certain linear conditions. These subvarieties arise naturally in applications including geometric representation theory, number theory, and numerical analysis. We describe completely the homology of Hessenberg varieties over GLn(ℂ) and show that they have no odd-dimensional homology. We provide an explicit geometric construction which partitions each Hessenberg variety into pieces homeomorphic to affine space. We characterize these affine pieces by fillings of Young tableaux and show that the dimension of the affine piece can be computed by combinatorial rules generalizing the Eulerian numbers. We give an equivalent formulation of …

Three Essays On Banks' Relative Efficiency, Jorge Guillen

Graduate Theses, Dissertations, and Problem Reports (ETD)

Three separate studies are conducted regarding banks' relative efficiency. Previous to start with the development of the studies, we review the situation before and after the enactment of the Riegle Neal's. This act restricts banks from opening branches in another state. The Riegle Neal act ended up the era of state branching deregulation which started in 1970. A discussion between proponents and opponents of branching deregulation is presented. A debate between bank's efficiency and concentration before Riegle Neal is introduced in the chapter.;The first essay found in chapter 2, develops a theoretical model of spatial competition between banks. Two different …

Perspectives Of 12th Grade Students, Their Families, And School Officials Related To Affordability And Accessibility Of The West Virginia Promise Scholarship Program At Logan High School, Craig S. Mcclellan

Graduate Theses, Dissertations, and Problem Reports (ETD)

With only 14% of West Virginia's population over 25 years old possessing a bachelor's degree, the lack of a skilled workforce often thwarted state legislators' attempts to attract new industry to the state's struggling economy. To address workforce qualification concerns, state educational stakeholders implemented a merit-based scholarship program with average requirements in 2002. The West Virginia PROMISE (Providing Real Opportunities for Maximizing In-state Student Excellence) Scholarship Program goals include encouraging high school students to work harder, and to entice more graduates to attempt post-secondary work at in-state institutions.;This qualitative study was designed to discover the perceptions of five high school …

An Examination Of Self Identity And Learning Styles: A Qualitative Study Within The Home Health Care Setting, Margo Kraft Dec 2006

An Examination Of Self Identity And Learning Styles: A Qualitative Study Within The Home Health Care Setting, Margo Kraft

Student Scholarship

Home health care practitioners interact with patients via a learning process. Research has proven that reciprocal learning and expert learning styles are the primary methods of knowledge sharing in these home health care settings. The research conducted uncovered three major themes regarding knowledge sharing in home health care--self-identity, learning orientation, and resilience. A conceptual model was developed using these learning concepts in relationship to effective patient outcomes. Our research demonstrated that these home health care practitioners predominately uses two types of learning styles. One of these styles, reciprocal learning, transfers the education responsibility to the patient. The process of a …

Managing Agricultural Risk: Examining Information Sources Preferred By Limited Resource Farmers, Ingrid Nya Ngathou, James O. Bukenya, Duncan M. Chembezi Dec 2006

Managing Agricultural Risk: Examining Information Sources Preferred By Limited Resource Farmers, Ingrid Nya Ngathou, James O. Bukenya, Duncan M. Chembezi

Journal of Extension

The study reported here explored limited resource farmers' perceptions of the usefulness of selected sources of risk management information using survey data collected among small and limited resource farmers in north Alabama. The rationale is to understand the information needs of this group of farmers and to customize outreach programs to address their needs. The results suggest that farmers' characteristics are correlated with their perceptions of the sources of information they consider valuable. Another key finding was that sources such as computerized systems and marketing clubs are the less preferred information sources.

Voluntary Environmental Improvement Programs: Teaching Them To Fish Or Providing A Professional Guide, John D. Lawrence, Suzanne Schuknecht, Joe Lally

Journal of Extension

Many Extension programs are built upon the parable of teaching people to fish rather than giving them fish. The lesson is that the impact will be longer lasting and clients will be self sufficient if they are taught to fish. Two separate voluntary environmental improvement programs (the Livestock Environmental Management System Pilot Project and Iowa Livestock External Stewardship Pilot Project) with similar goals yet different educational approaches were evaluated. For our fish analogy, LEMS taught them to how to fish, and WILESPP provided them a professional guide. This article looks at the accomplishments and attitudes of the participants.

Opening Doors: A Qualitative Evaluation Of The Waterbury Youth Leadership Project, Matthew S. Mutchler, Stephen A. Anderson, Margaret Grillo, Harry Mangle

Journal of Extension

This article describes efforts to evaluate the impact of the Waterbury Youth Leadership Program (WYLP). Although the program meets five criteria for effective youth development programs as identified in previous research, quantitative evaluation efforts have been disappointing. Because of the small number of program participants, the researchers held a qualitative focus group interview, which yielded impressive results. The contents of the program are outlined, as well as the qualitative methods and results. Implications for qualitative evaluation methods and recommendations for future efforts are discussed.

Generating Self-Organizing Capacity: Leadership Practices And Training Needs In Non-Profits, Beverlyn Lundy Allen, Lois Wright Morton Dec 2006

Generating Self-Organizing Capacity: Leadership Practices And Training Needs In Non-Profits, Beverlyn Lundy Allen, Lois Wright Morton

Journal of Extension

Capacity building is a major goal of today's organizations (Senge, 1990). The complex problems that organizations face along with conditions of uncertainty require increased capacity to effectively respond. We propose a self-organizing capacity framework (organizational identity, information flows, and interdependent relationships) and link it to 18 leadership and organizational practices. We find that visioning, mobilizing resources, technology, and building teamwork are self-identified key training needs. Visioning and mobilizing resources are central to organizational identity; technology is necessary for information flows; and building teamwork contributes to interdependent relationships. These are shared leadership skills that build capacity within the organization.

The Ability To Relate: Assessing The Influence Of A Relationship Marketing Strategy And Message Stimuli On Consumer Perceptions Of Extension, Tracy Irani, Amanda Ruth, Ricky W. Telg, Lisa K. Lundy

Journal of Extension

Extension professionals are encouraged to market their programs and their organizations, but one of the most important marketing resources--their relationships--could be overlooked. The exploratory study reported here assessed the influence of a relationship-oriented marketing strategy and specific message stimuli on consumer perceptions of a statewide Extension service. A set of two focus groups, comprised of members of the general public, was utilized. Probability samples were generated using a predetermined sampling frame based on demographic variables. Results of the study showed that the user-focused marketing concepts resonated with participants, providing support for a message strategy focused on a two-way communication approach.

Exploring The Adolescent Life Skill Outcomes Of State 4-H Congress Participation And The Different Outcomes Of Gender And Race Groups, Barry A. Garst, Joseph R. Hunnings, Kathleen Jamison, Jewel Hairston

Journal of Extension

Research suggests residential 4-H programs enhance life skills. The study reported here explored the life skill outcomes of a 4-day residential State 4-H Congress. Participants were youth ages 14-18. A retrospective pre test and post test were used to evaluate life skills development. Paired sample t-tests indicated significant differences among all of the pre-test and post-test gain scores. Analysis of variance comparisons indicated males and females differed on some life skill items. The study supports the importance of purposeful planning for positive outcomes, as the greatest gains were related to Congress components that were designed to enhance specific life skills.
