Obstruction Of Justice: The Arbitration Process For Anti-Doping Violations During The Olympic Games, Andrew Goldstone

Cardozo Journal of Conflict Resolution

This Note will discuss the serious legal, ethical, and scientific questions raised by the dispute resolution process for anti-doping violations during the Olympic Games. Throughout the Note, I will highlight both procedural and substantive aspects of the process which raise sufficiently serious legal issues to merit an American court's agreement to review an Olympic arbitration award. Part I will discuss the rise of doping in sports, and the manner in which the problem has been, and is currently being addressed within the Olympic Movement. Part II will explain the hierarchy of sports governing bodies beneath the IOC and also discuss …

The Role Of Citizens And The Future Of International Law: A Paradigm For A Changing World, Avnita Lakhani Jan 2006

The Role Of Citizens And The Future Of International Law: A Paradigm For A Changing World, Avnita Lakhani

Cardozo Journal of Conflict Resolution

Time is on our side and security is to be found, only if we would have a change of heart about the role that citizens can play in the future of international law. True, citizens do play a role in the development and enforcement of domestic laws, especially in more democratic and Western societies. Citizens have also had significant influence in the development of international law. However, citizens (i.e. non-state actors) have not had a direct hand in the enforcement of international law through private action as accorded to state-actors (i.e. governments). This means that citizens, in most cases, have …

Language, Morals, And Conceptual Frameworks In Dispute Resolution: Establishing, Employing, And Managing The Logos, Michael T. Wawrzycki Jan 2006

Language, Morals, And Conceptual Frameworks In Dispute Resolution: Establishing, Employing, And Managing The Logos, Michael T. Wawrzycki

Cardozo Journal of Conflict Resolution

Any lawyer knows that words and language are important. A single word can derail a painstakingly written contract; the characterization of a would-be killer as a victim framed by racist police officers, rather than a jealous husband, can change the outcome of a case. Yet like many maxims, this important lesson is often forgotten when one is not confronted with the direct principles of words and language. Moreover, even most lawyers do not fully understand how to appropriately utilize the language tools that can change outcomes: myopically focusing on specific issues or characterizations rather than the overall conceptual frames.

Mediating Cases Involving Domestic Violence: Solution Or Setback?, Aimee Davis Jan 2006

Mediating Cases Involving Domestic Violence: Solution Or Setback?, Aimee Davis

Cardozo Journal of Conflict Resolution

This Note will first explore the psychological and social aspects of domestic violence. It will then examine the appropriateness of mediation for such cases, exploring viewpoints on the topic. Lastly, the Note will propose a standard to guide cases involving domestic violence. Although the victim should always have the final word on whether to mediate, a judge, psychologist, and mediator should collaborate and make a united recommendation as to how they suggest the victim should proceed. This will allow the victim to make a thoughtful and individualized assessment of her situation.

Moving From Mandatory: Making Adr Voluntary In New York Commercial Division Cases, Ari Davis Jan 2006

Moving From Mandatory: Making Adr Voluntary In New York Commercial Division Cases, Ari Davis

Cardozo Journal of Conflict Resolution

Due to its success during the last thirteen years, New York's Commercial Division in the state's Supreme Court has become the model for other states and countries seeking to establish a commercial division for their court systems. Before 1993, New York's state court system had its dockets clogged with commercial cases. Judges who heard commercial litigation cases often did not have the expertise or resources to handle them well or give them proper attention. As a result, New York businesses turned to Delaware's Chancery Court, federal courts, and private dispute resolution to resolve their disputes and avoid the New York …

Helping Those Who Are Helping Us: Sarbanes-Oxley Whistleblower Protection And Its Interplay With Arbitration, Adam Fisher

Cardozo Journal of Conflict Resolution

The accounting profession took a major blow to its credibility in 2002 when numerous scandals surfaced on the front pages of newspapers seemingly everyday. The most notable stories told of two women who, despite the enormous pressure and harassment they knew they would face, came forward to reveal the ugly truth behind the facades of America's corporate skyscrapers. Cynthia Cooper and Sherron Watkins, employees at WorldCom and Enron respectively, blew the whistle on major accounting frauds at these companies. Their employers' retaliation was harsh and swift, revealing the truth about how todays' corporate juggernauts operate.

Developments And Hurdles In Generating Vaccines For Controlling Helminth Parasites Of Grazing Ruminants, W.D. Smith, D.S. Zarlenga

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

As a direct consequence of rising drug resistance among common nematodes of grazing animals, efforts toward state-of-the- art vaccine development have clearly intensified in recent years, fuelled primarily by the advent of newer technologies in gene discovery, by advancements in antigen identification, characterisation and production. In this regard, it is appropriate to review progress that has been made in generating helminth vaccines and in particular, vaccines against common nematodes of production animals for consumption. In like manner, it is prudent to evaluate barriers that have hindered progress in the past and continue to present obstacles that must be solved when …

Host Specificity Of Divergent Populations Of The Leaf Beetle Diorhabda Elongata (Coleoptera: Chrysomelidae), A Biological Control Agent Of Saltcedar (Tamarix Spp.), Lindsey R. Milbrath, C. Clark Deloach

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

The leaf beetle, Diorhabda elongata (Brullé) sensu lato, was released in 2001 for the classical biological control of exotic saltcedars, a complex of invasive Tamarix species and hybrids. It did not establish at sites south of 37°N latitude where summer daylengths are below the critical photoperiod of the northern-adapted populations of the beetle that were released. Therefore, we assessed the host specificity of four D. elongata populations collected from more southern latitudes in the Old World (Tunisia, Crete, Uzbekistan, and Turpan, China). All populations were similar to each other and the previously released populations of D. elongata in their …

Aboveground Productivity And Root–Shoot Allocation Diver Between Native And Introduced Grass Species, Brian J. Wilsey, H. Wayne Polley Jan 2006

Aboveground Productivity And Root–Shoot Allocation Diver Between Native And Introduced Grass Species, Brian J. Wilsey, H. Wayne Polley

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Plant species in grasslands are often separated into groups (C4 and C3 grasses, and forbs) with presumed links to ecosystem functioning. Each of these in turn can be separated into native and introduced (i.e., exotic) species. Although numerous studies have compared plant traits between the traditional groups of grasses and forbs, fewer have compared native versus introduced species. Introduced grass species, which were often introduced to prevent erosion or to improve grazing opportunities, have become common or even dominant species in grasslands. By virtue of their abundances, introduced species may alter ecosystems if they differ from natives in …

On Improving Wireless Broadcast Reliability Of Sensor Networks Using Erasure Codes, Rajnish Kumar, Arnab Paul, Umakishore Ramachandran, David Kotz

Dartmouth Scholarship

Efficient and reliable dissemination of information over a large area is a critical ability of a sensor network for various reasons such as software updates and transferring large data objects (e.g., surveillance images). Thus efficiency of wireless broadcast is an important aspect of sensor network deployment. In this paper, we study FBcast, a new broadcast protocol based on the principles of modern erasure codes. We show that our approach provides high reliability, often considered critical for disseminating codes. In addition FBcast offers limited data confidentiality. For a large network, where every node may not be reachable by the source, we …

Additive Lithography Fabrication And Integration Of Micro Optics, Mahesh Pitchumani Jan 2006

Additive Lithography Fabrication And Integration Of Micro Optics, Mahesh Pitchumani

Electronic Theses and Dissertations

Optical elements are the fundamental components in photonic systems and are used to transform an input optical beam into a desired beam profile or to couple the input beam into waveguides, fibers, or other optical systems or devices. Macroscopic optical elements are easily fabricated using grinding and polishing techniques, but few methods exist for inexpensive fabrication of micro optical elements. In this work we present an innovative technique termed Additive Lithography that makes use of binary masks and controlled partial exposures to sculpt photoresist into the desired optical surface relief profile. We explore various masking schemes for fabricating a variety …

Up-Conversion In Rare-Earth Doped Micro-Particles Applied To New Emissive 2d Dislays, Anne Milliez Jan 2006

Up-Conversion In Rare-Earth Doped Micro-Particles Applied To New Emissive 2d Dislays, Anne Milliez

Electronic Theses and Dissertations

Up-conversion (UC) in rare-earth co-doped fluorides to convert diode laser light in the near infrared to red, green and blue visible light is applied to make possible high performance emissive displays. The infrared-to-visible UC in the materials we study is a sequential form of non-linear two photon absorption in which a strong absorbing constituent absorbs two low energy photons and transfers this energy to another constituent which emits visible light. Some of the UC emitters' most appealing characteristics for displays are: a wide color gamut with very saturated colors, very high brightness operation without damage to the emitters, long lifetimes …

Investigating The Effectiveness Of Redundant Text And Animation In Multimedia Learning Environments, Shiau-Lung Chu Jan 2006

Investigating The Effectiveness Of Redundant Text And Animation In Multimedia Learning Environments, Shiau-Lung Chu

Electronic Theses and Dissertations

In multimedia learning environments, research suggests that simultaneous presentation of redundant text (i.e. identical narration and on-screen text) may inhibit learning when presented with animation at the same time. However, related studies are limited to testing with cause-and-effects content information (e.g., Moreno & Mayer, 1999, 2002). This study examined the effects of redundant text on learners' memory achievement and problem solving ability. The study replicated and extended prior research by using descriptive, rather than cause-and-effect content information. The primary research questions were (a) does redundant text improve learning performance if learners are presented with instructional material that addresses subject matter …

Investigation Of The Impact Of Video-Based Anchored Instruction On The Implementation Of Inclusive Practices By Students With Learning Disabilities, Christopher O'Brien Jan 2006

Investigation Of The Impact Of Video-Based Anchored Instruction On The Implementation Of Inclusive Practices By Students With Learning Disabilities, Christopher O'Brien

Electronic Theses and Dissertations

For several years emerging trends in special education services have favored inclusion for students with disabilities. Concurrent to this evolution of philosophy in special education has been the advent of what could be considered inclusive instructional practices--those methods that aid in the successful inclusion of students with disabilities. These inclusive practices include co-teaching, cooperative learning, peer-mediated instruction, positive behavioral support, embedded learning strategies, and content-enhancements (Ehren, Lenz, & Deshler, 2005; King-Sears, 1997). As inclusive placements become an increasingly common standard of practice, particularly for students with learning disabilities, the need to assist general educators in establishing inclusive classrooms becomes a …

Organizational Change At The Service Delivery Level: An Investigation Into The Perceived Reaction To Change Initiatives In Moral, Larry Cochran Jan 2006

Organizational Change At The Service Delivery Level: An Investigation Into The Perceived Reaction To Change Initiatives In Moral, Larry Cochran

Electronic Theses and Dissertations

As the speed of change increases, federal agencies are challenged more often to develop and implement improvements to existing programs, new programs to meet new needs, or adjustments to programs based on changed circumstances of delivery. Built on the foundation of systems theory, expectancy theory, and field theory, this research seeks to explain why some managers do not propose changes in their organizations---even when the very survival of the organization is at risk. By measuring the fields of influence encountered by managers, we find that the chain of command is supportive of change initiatives. Other organizational elements--human resources and legal …

The Effects Of The 5e Learning Cycle Model On Students' Understanding Of Force And Motion Concepts, Meghann Campbell Jan 2006

The Effects Of The 5e Learning Cycle Model On Students' Understanding Of Force And Motion Concepts, Meghann Campbell

Electronic Theses and Dissertations

As advocated by the National Research Council [NRC] (1996) and the American Association for the Advancement of Science [AAAS] (1989), a change in the manner in which science is taught must be recognized at a national level and also embraced at a level that is reflected in every science teacher's classroom. With these ideas set forth as a guide for change, this study investigated the fifth grade students' understanding of force and motion concepts as they engaged in inquiry-based science investigations through the use of the 5E Learning Cycle. The researcher's journey through this process was also a focus of the …
