Duchamp And Pragmatics, Kiam Loong Daniel Lai
Duchamp And Pragmatics, Kiam Loong Daniel Lai
Theses, Dissertations and Culminating Projects
There is a correspondence between the mechanism of visual communication in Duchamp’s art and the principles of pragmatics in linguistics. The process from Duchamp’s intended meaning encoded in his art to the correct interpretation on the part of the addressee is similar to the process in which intended meaning encoded in speech being accurately decoded by the addressee. This is because the correct interpretation in both processes involves inferences. Be it language or art, to fully understand the intended meaning of a statement, an addressee must first understand the natural meaning known as entailment; and subsequently uncover the unnatural, but …
Fugitive Slaves And Ship-Jumping Sailors: The Enforcement And Survival Of Coerced Labor, Jonathan M. Gutoff
Fugitive Slaves And Ship-Jumping Sailors: The Enforcement And Survival Of Coerced Labor, Jonathan M. Gutoff
Law Faculty Scholarship
This article explores the relationship between the law of maritime labor and the law of slavery. In the eighteenth century, both sailors and slaves were part of a broad regime of unfree labor relations, with slaves, of course, the most oppressed. In the nineteenth century, an era otherwise supposedly devoted to the ideal of "free" labor, sailors and slaves instead remained unfree, subject to federal laws providing for the forced return to their toils if they deserted - the Merchant Seaman's Act and the Fugitive Slave Act. Both of those statutes were deemed to be within Congress' authority, despite questionable …

Challenging Standard Conceptions Of Tradition, Science And Technology In 2006: Why Laws Prohibiting The Sale Of Violent Video Games To Minors Should Be Ultimately Upheld, Ilana Lubin
Cardozo Journal of Equal Rights & Social Justice
The note argues that regulating the sale of violent video games to minors is constitutionally justifiable, supported by scientific evidence on adolescent brain development and legal precedents. It critiques the lack of a clear legal standard in court decisions and advocates for a nuanced approach that balances First Amendment rights with public safety concerns.
Cultural, Economic And Legal Factors Underlying Trafficking In Thailand And Their Impact On Women And Girls From Burma, Christa Foster Crawford
Cultural, Economic And Legal Factors Underlying Trafficking In Thailand And Their Impact On Women And Girls From Burma, Christa Foster Crawford
Cardozo Journal of Equal Rights & Social Justice
The article examines the complex factors underlying human trafficking in Thailand, particularly focusing on the trafficking of women and girls from Burma. It argues that while Thailand has made efforts to address the issue, the root causes, including cultural attitudes, economic interests, and legal frameworks, remain unaddressed. The analysis highlights the shift in trafficking patterns from Thai women to Burmese migrants due to improved socio-economic conditions for Thai nationals and worsening conditions in Burma. The article emphasizes the need for comprehensive solutions addressing both supply and demand factors, including legal reforms and policy changes.

Religion In The Classroom In Germany And The United States, Edward J. Eberle
Law Faculty Scholarship
In this Article, Professor Eberle evaluates the relationship of religion in the classroom in Germany and the United States, as formulated by the countries' highest courts, the German Constitutional Court and the United States Supreme Court Pursuant to the German model of church-state cooperation, public finds are channeled to religious organizations, such as, for example, using the machinery of the state to rise and disperse tax monies to religious organizations. Religious groups may then use the tax monies collected to support religious education in the public schools. However, pursuant to guidelines announced by the German Constitutional Court, teaching of religious …
Art Informing Science Education: The Potential Contributions Of Ornithological Illustration To Ecology Education, Vanessa Hunt
Art Informing Science Education: The Potential Contributions Of Ornithological Illustration To Ecology Education, Vanessa Hunt
LSU Doctoral Dissertations
Birds serve as an excellent group of organisms from which to introduce the study of ecology, being of inherent aesthetic interest to many otherwise uninterested in science, and are also ubiquitous in the immediate environment of many students. By extension, images of birds might serve as a valuable resource for the ecology educator, and bird artists – as a subset of ecologists - might provide useful models for expertise in ecology. This study examines the potential contributions of bird artists and bird art to education in ecology at the high school and college level. Eight contemporary bird artists were interviewed …
Entropy Of Electroencephalogram (Eeg) Signals Changes With Sleep State, Blesy Anu Mathew
Entropy Of Electroencephalogram (Eeg) Signals Changes With Sleep State, Blesy Anu Mathew
University of Kentucky Master's Theses
We hypothesized that temporal features of EEG are altered in sleep apnea subjects comparedto normal subjects. The initial aim was to develop a measure to discriminate sleep stages innormals. The longer-term goal was to apply these methods to identify differences in EEGactivity in sleep apnea subjects from normals. We analyzed the C3A2 EEG and anelectrooculogram (EOG) recorded from 9 normal adults awake and in rapid eye movement(REM) and non-REM sleep. The EEG signals were filtered to remove EOG contamination. Twomeasures of the irregularity of EEG signals, Sample Entropy (SpEn) and Tsallis Entropy, wereevaluated for their ability to discriminate sleep stages. …
Sutton Hoo: The Body In The Mound, Tanya Knight Ruffin
Sutton Hoo: The Body In The Mound, Tanya Knight Ruffin
LSU Master's Theses
Seven miles from the Deben River in Suffolk, England, is a large pagan cemetery named Sutton Hoo, which consists of seventeen burial mounds. The most impressive of these mounds contains a ninety-foot Anglo-Saxon ship buried beneath the earth. Atop the ship is a burial chamber that contained artifacts such as: a helmet, sword, shield, scepter, standard and a purse holding thirty-seven Merovingian coins. This ship-burial has intrigued scholars since it was discovered and subsequently excavated in 1939. Dozens of theories still circulate on the burial’s intended purpose and date as well as whether or not there was an individual buried …

Screed Or Scholarship: The Days Of Whine And Roses, Jeffrey M. Lipshaw
Suffolk University Law School Faculty Works
This is a review of, The Destruction of Young Lawyers: Beyond One L. by Douglas Litowitz (Akron: University of Akron Press, 2006).
While the book may be a credible (if tiresome) account of Mr. Litowitz's own unhappiness as a law student and large firm new associate, and evidence of the fact there are unhappy lawyers in the world, it overpromotes itself on two counts. Although it is written by a law professor and published by a university press, and makes broad and universal claims about evils in the legal profession, it is largely a slapdash pastiche of hyperbole and anecdote. …

Rapports de recherche scientifique
The nanoparticle and nanotechnology field is a fast-growing research niche[1]. Research has already led to significant breakthroughs, and several products are available commercially. It is currently anticipated that the number of exposed Quebec workers, both in use and processing and in production, will increase over the next few years. The purpose of this literature review is to determine whether nanoparticles represent health risks for workers. The chosen presentation format has the advantage of covering all the aspects that must be considered in toxic risk assessment. For some nanoparticles, the toxicological data are very partial, so this presentation format …
Adults With Low Vision: Continuing Education For Occupational Therapists And Occupational Therapy Students, Ashley Berglund, Kelli Hughes
Adults With Low Vision: Continuing Education For Occupational Therapists And Occupational Therapy Students, Ashley Berglund, Kelli Hughes
Occupational Therapy Capstones
Low vision is a condition that occurs when an individual has "some amount of usable vision, but their visual functioning is impaired and interferes with their ability to carry out desired tasks" (Lampert & Lapolice, 1995, p. 885). Impairments in vision cause disruptions in areas of daily living including work and leisure, routines, habits, roles, and social participation. There is a great need for holistic and client-centered occupational therapy in low vision rehabilitation services to improve an individual's functional performance and overall quality of life.
A comprehensive literature review was conducted on low vision definitions and medical conditions, the variety …

Eating Disorders: A Guide For The Occupational Therapist, Randi Horner
Occupational Therapy Capstones
Eating disorders are serious illnesses that can impact physical and mental health. Increasingly, occupational therapists encounter this population in general psychiatric hospitals and treatment facilities, as well as specialized eating disorders treatment facilities. Yet, questions concerning the role of occupational therapy in the treatment of eating disorders remain. The purpose of this project is to increase the awareness of the role of occupational therapy in the treatment of eating disorders by providing a guide for effective treatment of these illnesses. A literature review includes information regarding eating disorders, the demographics and diagnostic criteria of eating disorders, multidisciplinary treatment settings and …

Natural Justice, Lawrence B. Solum

Justice is a natural virtue. Well-functioning humans are just, as are well-ordered human societies. Roughly, this means that in a well-ordered society, just humans internalize the laws and social norms (the nomoi)--they internalize lawfulness as a disposition that guides the way they relate to other humans. In societies that are mostly well-ordered, with isolated zones of substantial dysfunction, the nomoi are limited to those norms that are not clearly inconsistent with the function of law--to create the conditions for human flourishing. In a radically dysfunctional society, humans are thrown back on their own resources--doing the best they can in …

Perhaps to no one’s surprise, a recent survey found that most Americans know far more about television hits than they know about the United States Constitution. For instance, 52% of Americans surveyed could name at least two characters from The Simpsons, and 41% could name at least two judges from American Idol. Meanwhile, a mere 28% could identify more than one of the rights protected by the First Amendment.
Surveys such as this help clear up one of the apparent mysteries of the last five years: How did we change so quickly from a nation in which the …

Beyond Unconscionability: Class Action Waivers And Mandatory Arbitration Agreements, J. Maria Glover
Georgetown Law Faculty Publications and Other Works
We live in an age of convenience. From financial transactions to electronic correspondence, we frequently deal with large corporations that provide services in our daily lives. One of the prices we pay for the convenience of these transactions, however, is that our commercial relationships increasingly are based on standard form contracts written by large corporations. While these standard form contracts are necessary to an economically efficient society, the growing use of mandatory arbitration provisions and clauses that prohibit class actions in these contracts raises the spectre of corporate abuse.
