Torture As A Problem In Ordinary Legal Interpretation, Alan Hyde Nov 2006

Torture As A Problem In Ordinary Legal Interpretation, Alan Hyde

Cornell Law Faculty Publications

American legal discourse on torture takes for granted some, usually all, of the following propositions, that make discussion of torture more difficult than it should be. Torture is assumed to present unusually difficult problems of definition, full of vague concepts, fine lines, gray areas, murky moral dilemmas, "dirty hands." This vagueness is thought to be even more of a problem for the attendant concept of "cruel, inhuman, and degrading treatment." The legal sources of either prohibition are assumed to be dubious under American law. Prohibiting torture is, perhaps for these reasons, thought to require moral justification not necessarily required of …

Information Systems and Engineering Management Research Publications

We present spectroscopy of a transit of the exoplanet HD 189733b. By modeling the Rossiter-McLaughlin effect (the anomalous Doppler shift due to the partial eclipse of the rotating stellar surface), we find the angle between the sky projections of the stellar spin axis and orbit normal to be λ = -1fdg4 ± 1fdg1. This is the third case of a "hot Jupiter" for which λ has been measured. In all three cases λ is small, ruling out random orientations with 99.96% confidence, and suggesting that the inward migration of hot Jupiters generally preserves spin-orbit alignment.

An Investigation Of Relationships Between Oral Reading Rate And Reading Comprehension, Karen F. Rimkus Nov 2006

An Investigation Of Relationships Between Oral Reading Rate And Reading Comprehension, Karen F. Rimkus

Regis University Student Publications (comprehensive collection)

Quantitative research methods were used including observations and tallies of reading rates, data compilation, generation of scatterplots, and descriptive statistical analysis of the results. The research focused on observations of 69 fourth graders from two fourth grade classes in a private parochial elementary school in Las Vegas, Nevada. The students each read a 198-word passage to measure oral reading rate. A positive relationship between oral reading rate and reading comprehension was then determined. As a result, teachers may be able to use an oral reading rate test to design curriculum before the Terra Nova achievement test is administered in September. …

Personal Health Records: The People's Choice?, Lisa Sprague Nov 2006

Personal Health Records: The People's Choice?, Lisa Sprague

National Health Policy Forum

Information technology (IT), especially in the form of an electronic health record (EHR), is touted by many as a key component of meaningful improvement in health care delivery and outcomes. A personal health record (PHR) may be an element of an EHR or a stand-alone record. Proponents of PHRs see them as tools that will improve consumers’ ability to manage their care and will also enlist consumers as advocates for widespread health IT adoption. This issue brief explores what a PHR is, the extent of demand for it, issues that need to be resolved before such records can be expected …

Job Applicants’ Testing And Organizational Perceptions: The Effects Of Test Information And Attitude Strength, Andrew L. Noon Nov 2006

Job Applicants’ Testing And Organizational Perceptions: The Effects Of Test Information And Attitude Strength, Andrew L. Noon

Department of Psychology: Dissertations, Theses, and Student Research

This quasi-experimental study examined job applicants’ organizational perceptions prior to and immediately after completing pre-employment assessments, and after the hiring decision was announced. Participants were actual applicants (N = 262) for non-exempt level data processing positions at a medium-size Midwestern insurance company. As part of the selection process, applicants completed both a cognitive ability test and a personality inventory. Information about the tests was used as a manipulation. Approximately half of the participants received information prior to completing the assessments that explained the tests’ content, job relatedness, and validity, and a description of the testing process, while the other …

Predictors Of Change In Health Care Use After Marital And Family Therapy, Scott H. Payne Nov 2006

Predictors Of Change In Health Care Use After Marital And Family Therapy, Scott H. Payne

Theses and Dissertations

The cost of health care continues to increase. Based on the biopsychosocial model of heath care, it has been shown that the treatment of psychological and social problems can have a cost offset effect on the cost of medical care. While this offset effect has been shown in an MFT population, there are no known studies that have looked at predictors of the change in medical use by those that receive marital and family therapy. This study looked at psychological and social measures of individuals who received marital and family therapy. These measures were evaluated based on the change from …

Utah Commercial Motor Vehicle Weigh-In-Motion Data Analysis And Calibration Methodology, Luke W. Seegmiller Nov 2006

Utah Commercial Motor Vehicle Weigh-In-Motion Data Analysis And Calibration Methodology, Luke W. Seegmiller

Theses and Dissertations

In preparation for changes in pavement design methodologies and to begin to assess the effectiveness of the weigh-in-motion (WIM) system in Utah, the Utah Department of Transportation (UDOT) contracted with a Brigham Young University (BYU) research team to conduct an evaluation of their commercial motor vehicle (CMV) data collection system statewide. The objective of this research was to evaluate the CMV data collection program in the state of Utah and to make limited recommendations for potential improvements and changes that will aid in more detailed and accurate CMV data collection across the state. To accomplish the research objectives, several tasks …
