Technology is changing the way that children are communicating (particularly elementary and pre-school aged children), and these changes have significant implications for alternative dispute resolution processes and practices. Although ADR practitioners and theorists are not ignoring technology, we have focused almost exclusively on the question of how we can use technology to enhance our existing practices. We are not paying sufficient attention to the fact that young children are communicating differently than we communicate. Insufficient energy is being dedicated to the question of how those differences in communication inevitably influence the way that those children resolve disputes.

Anti-Terrorist Finance In The United Kingdom And United States, Laura K. Donohue

This Article adopts a two-tiered approach: it provides a detailed, historical account of anti-terrorist finance initiatives in the United Kingdom and United States-two states driving global norms in this area. It then proceeds to a critique of these laws. The analysis assumes-and accepts-the goals of the two states in adopting these provisions. It questions how well the measures achieve their aim. Specifically, it highlights how the transfer of money laundering tools undermines the effectiveness of the states' counterterrorist efforts-flooding the systems with suspicious activity reports, driving money out of the regulated sector, and using inappropriate metrics to gauge success. The Light On The Horizon: Imagining The Death Of American Cities, Carl Abbott

Cities in the United States have never known the direct effects of total war. Lacking this bitter experience, Americans have had to imagine the impacts of catastrophic warfare on their urban centers. This paper examines fictional depictions of future warfare as it has been imagined to affect U.S. cities, particularly since 1945. It draws on films, short stories, and novels from the "thriller," "future war," and science fiction genres to explore common assumptions and underlying attitudes about cities and city life. It finds that cities are conspicuous by their absence from such stories of future war and its impacts. Cities …

In KP Permanent, the Supreme Court recently confirmed that plaintiffs in trademark infringement cases under the Lanham Act have the burden of proving likelihood of confusion. As such, this article argues that lower courts do not have the authority to switch that burden of proof for such claims, even though they involve nominative uses (in which defendant is using the actual mark of plaintiff as plaintiff’s source identifier and not as a description of the defendant's products or services). The U.S.S.C. expanded the scope of the Hatch-Waxman Act’s safe harbor provision in Merck III to include protection for infringing use of any type of invention as long as a researcher intended to perform research reasonably relevant to FDA approval. This broad interpretation is inconsistent with the legislative intent of the Hatch-Waxman Act, and the policies of the U.S. patent system. Many patent owners may unnecessarily experience such a reduction in their property rights as to constitute a regulatory taking. The proposed narrow interpretation would rectify the constitutional problems and inconsistencies in infringement exemptions. Section 271(e)(1) should apply only to …

On September 7, 2005, the Federal Circuit in In re Fisher upheld the PTO’s final rejection for lack of utility of a patent application for certain DNA sequence fragments generated from maize plants. The court, supporting a heightened utility standard, adopted the “real-world” test for establishing substantial and specific utility required by the PTO. This decision severely limits the granting of patent rights to DNA sequence fragments, which are capable of having value within the biotech community as research tools. Specifically, the agreements forming the legal framework of the World Trade Organization are discussed and their impact on the economic development of developing countries examined. The copyright policy of the United States developed from initial isolationism, through the 1891 Chase Act, various bilateral and inter-American agreements and the establishment of the Universal Copyright Convention, to active participation in the international copyright cooperation. This development was completed by the United States’ accession to the Berne Convention in 1988. This article highlights nine selected U.S. copyright law decisions handed down between February 1, 2005 and May 1, 2006. Two of the decisions concern peer-to-peer file sharing, including the U.S. Supreme Court’s landmark decision in MGM v. Grokster. One of the decisions questions the applicability of the idea/expression dichotomy to works of visual art. Two of the decisions discuss ownership of the renewal rights in a work under the 1909 Act when the author is deceased. On April 14, 2006, the Student Animal Legal Defense Fund of New York University School of Law hosted a symposium on how to overcome some common courtroom barriers faced by animal advocates. Panelists discussed cultural and legal transitions, legal standing for nonhuman animals, and potential causes of action. Symposium participants included prominent attorneys, authors, philosophers, and professors specializing in the field of animal protection law. Should the law treat dogs as vicious animals or loving family companions? This article analyzes common law strict liability as applied to dog bite cases and the shift to modern strict liability statutes, focusing on the defense of provocation. It discusses the inconsistency in the modern law treatment of strict liability in dog bite cases. The article then resolves why negligence is the proper cause of action in dog bite cases. The Author draws comparisons among dog owner liability in dog bite cases, parental liability for a child’s torts, and property owner liability for injuries caused by his property. The …

Research was conducted in two phases: first to determine optimal pump percentage for each of five pH-enhanced beef muscles and then to determine the effect of pH enhancement on consumer acceptability of beef steaks. Phase I was a 5 x 4 factorial design with five muscles: longissimus lumborum (LL), gluteus medius (GM), triceps brachii (TB), biceps femoris (BF), and psoas major (PM) and four pump percentages: 0, 10, 20, and 30% to determine optimum pump percentage for each muscle using an 8- member trained sensory panel. The overarching goal of this study was two-fold; to determine the prevalence of perinatal onset or worsening of OCD symptoms in women attending a university-based research program, and to determine whether there is a continuity between perinatal onset or worsening of OCD and premenstrual exacerbation of such symptoms. Women ages 18 to 69 years old that were enrolled in the Yale OCD Research Program between 1990 and 1995 were interviewed by phone or in person regarding demographics, onset and course of OCD, types of primary OCD symptoms, treatment history, comorbid diagnoses including substance use/abuse, and the impact of pregnancy and …

Currently technologies such as EEG, EMG and EOG recordings are the established methods used in the analysis of sleep. But if these methods are to be employed to study sleep in rodents, extensive surgery and recovery is involved which can be both time consuming and costly. This thesis presents and analyzes a cost effective, non-invasive, high throughput system for detecting the sleep and wake patterns in mice using a piezoelectric sensor. There are two varieties of timing games in economics: In a war of attrition, more predecessors helps; in a pre-emption game, more predecessors hurts. In this paper, we introduce and explore a spanning class with rank-order payoffs that subsumes both as special cases. In this environment with unobserved actions and complete information, there are endogenously-timed phase transition moments. We identify equilibria with a rich enough structure to capture a wide array of economic and social timing phenomena — shifting between phases of smooth and explosive entry. We introduce a tractable general theory of this class of timing games based on …
