The Salience Of Species Difference For Feminist Theory, Maneesha Deckha
UC Law SF Journal on Gender and Justice
This Article assumes an intersectional and feminist perspective to argue that being human should not be the qualification for justice or legal personhood. Drawing from feminist analyses of animal theory, and various strands of critical theory, this Article argues that feminists and other advocates of human rights, for whom interrogating constructs of gender, race, culture, sexuality, etc., are important, must also attend to species difference and the treatment of nonhuman animals to be consistent and effective in their discursive critiques and legal interventions. In addition, the law contributes to the ossification of rulemaking agencies; encourages agencies to make decisions informally through guidance documents and policies rather than rules; and encourages agencies to avoid using electronic dialogues and disseminating information to the public. This Article examines the problems created by the IQA suggests repeal of the law or some reforms to address those problems.

Plasmid-Mediated High-Level Gentamicin Resistance Among Enteric Bacteria Isolated From Pet Turtles In Louisiana, María Alejandra Díaz, Richard Kent Cooper, Axel Cloeckaert, Ronald John Siebeling

The sale of small turtles is banned by the Food and Drug Administration from the U.S. market due to concerns about their excretion of Salmonella spp. To produce a safe pet for the export market, the Louisiana pet turtle industry uses gentamicin sulfate baths (1,000 μg/ml) to eradicate Salmonella spp. from turtle eggs. In 1999, we analyzed bacterial samples recovered from turtle farms and found that strains of Salmonella enterica subsp. arizonae and other bacteria, such as Enterobacter cloacae, Citrobacter freundii, Pseudomonas aeruginosa, and Stenotrophomonas maltophilia, were resistant to high concentrations of gentamicin (>2,000 μg/ml) and to other aminoglycosides. …

Effect Of Scraping Frequency In A Freestall Barn On Volatile Nitrogen Loss From Dairy Manure, V. R. Moreira, L. D. Satter

The objective of this investigation was to evaluate the effect of scraping frequency (2× vs. 6× daily) on N volatilization from manure on the floor of a dairy free-stall barn. Three trials (crossover design) were conducted in the summers of 2001 and 2002, and in the winter of 2003. Nitrogen volatilization was estimated from the change in the N:P ratio in excreta at the time of excretion to the time when manure was scraped from the barn. Total N loss was considered a maximum estimate of NH3-N loss, because small amounts of nonammonia N may be volatilized. Nitrogen was determined …

Three experiments were conducted to investigate the feasibility of using crystalline methionine and lysine as protein supplements for lactating Holstein cows. In the first experiment, Met (DL-methionine) and Lys (L-lysine-HCl) were added to diets used in continuous culture bioreactors to estimate optimal concentrations for use in subsequent in vivo experiments. The second experiment measured ruminal fermentation and nutrient flow to the small intestine when Met and Lys were top-dressed on diets fed to nonlactating cows. The third experiment measured lactation performance when Met and Lys were added to diets fed to late-lactation cows. Providing 0.29 and 2.27% of dry matter …

Avian plumage traits are the targets of both natural and sexual selection. Consequently, genetic changes resulting in plumage variation among closely related taxa might represent important evolutionary events. The molecular basis of such differences, however, is unknown in most cases. Sequence variation in the melanocortin-1 receptor gene (MC1R) is associated with melanistic phenotypes in many vertebrate taxa, including several avian species. The blue-crowned manakin (Lepidothrix coronata), a widespread, sexually dichromatic passerine, exhibits striking geographic variation in male plumage colour across its range in southern Central America and western Amazonia. Northern males are black with brilliant blue crowns whereas southern males …

In his insightful and sometimes troubled contemporary writings, Philip Roth demonstrates a nuanced understanding of how the development of Jewish-American identity is a painful and often hilariously paradoxical journey of discovery as Jewish traditions intersect (and often collide) with the American ideal of vertical advancement. Since the successful fulfillment of the American Dream requires some measure of assimilation into the majority American culture known as Americanization, Roth's Jewish-American characters are continually and precariously ill-balanced between retaining and abandoning their Jewish heritage in favor of a new American identity. A Broad-Spectrum Mer Operon In A Multi-Drug Resistant Strain Of The Fish Pathogen, Aeromonas Salmonicida, Erin Parry

Aeromonas salmonicida AS03, a potential fish pathogen, was isolated from Atlantic salmon, Salmo salar, in 2003. This strain was found to be resistant to ≥1000 mM HgCl2 and ≥32 mM phenylmercuric acetate as well as multiple antimicrobials. Mercury (Hg) and antibiotic resistance genes are often located on the same mobile genetic elements, so the genetic determinants of both resistances and the possibility of horizontal gene transfer were examined. Specific PCR primers were used to amplify and sequence distinctive regions of the mer operon. The “traveling imagination,” is of paramount importance to both western and postcolonial travelers. Since both groups create “travel imaginations” by extensive reading, the nature of the books that inform them must directly affect their travels. A westerner, for example, who reads only colonial-era accounts has the “travel imagination” of a different generation. If all perspectives were represented equally in libraries, the “travel imagination” of a given person would be entirely his/her own. But usually the “traveler’s imagination” is biased by prevailing opinion. Libraries are not democracies, and sometimes extensive reading only indoctrinates the reader with the biases of the canon. …

This Article addresses the question of the appropriate response of appellate counsel for Black defendants tarred at trial by the indirect deployment of powerful racial stereotypes. The crux of the problem is that even now, the courts only take exception to blatant racist appeals, even though indirectly racist summations can have a determinative impact at trial. In laying out the contours of the problem, we must draw upon the discipline of rhetoric, or persuasion through oration, to describe various techniques of intentional indirectness that prosecutors use to obviate the possibility of appellate review under the stringent standards of the Fourteenth …

The Tribal Sovereign As Citizen: Protecting Indian Country Health And Welfare Through Federal Environmental Citizen Suits, James M. Grijalva

This Article suggests that federal environmental citizen suits can serve tribal sovereignty interests without presenting the legal risks tribes face when they attempt direct regulation of non-Indians. Section I briefly describes governmental regulatory roles tribes may play in the implementation of federal environmental law and policy. Section II overviews the conceptual and procedural framework for tribal claims as "citizens." Section III argues that in bringing environmental citizen suits, tribal governments exercise their inherent sovereign power and responsibility to protect the health and welfare of tribal citizens and the quality of the Indian country environment.
