Victimhood, Jessie K. Liu Jan 2006

Victimhood, Jessie K. Liu

Missouri Law Review

Part I of this paper examines the theoretical tension between using the total harm caused by a convicted defendant to determine the proper punishment and limiting the categories of harm for which punishment can be imposed. This is the equivalent in the criminal context of the problem discussed in the classic tort case of Palsgraf v Long Island Railroad. How should a legal regime limit the universe of victims? Part II provides a brief overview of pre-Guidelines decisions defining the term "victim" for sentencing purposes, focusing in particular on constitutional decisions about victim participation. Although the Sentencing Guidelines have made …

Nutrient Loads In An Urban Ozark Watershed: Jordan, Fassnight And Upper Wilson's Creeks, Springfield, Missouri, Ronald B. Miller Jan 2006

Nutrient Loads In An Urban Ozark Watershed: Jordan, Fassnight And Upper Wilson's Creeks, Springfield, Missouri, Ronald B. Miller

Graduate Theses/Dissertations

The study watershed includes Jordan Creek, the primary stream draining the central downtown area of Springfield, Missouri, and also Fassnight and upper Wilson Creeks. Ten sample sites were established within the watershed and water samples and were collected during baseflow and storm runoff events between August 1, 2004 and July 31, 2005. Samples were tested for total nitrogen (TN), total phosphorus (TP) and selected heavy metals (zinc, arsenic, lead, copper and cadmium) and the parameters pH, specific conductance, turbidity, temperature and dissolved oxygen. Rating curves were used to correlate discharge and water quality variables. Separate rating curves were developed for …

Retrieval Of Physical Properties Of Particulate Emission From Animal Feeding Operations Using Three-Wavelength Elastic Lidar Measurements, Vladimir V. Zavyalov, Christian Marchant, Gail E. Bingham, Thomas D. Wilkerson, Jason Swasey, Christopher Rogers, Douglas Ahlstrom, Paul Timothy Jan 2006

Retrieval Of Physical Properties Of Particulate Emission From Animal Feeding Operations Using Three-Wavelength Elastic Lidar Measurements, Vladimir V. Zavyalov, Christian Marchant, Gail E. Bingham, Thomas D. Wilkerson, Jason Swasey, Christopher Rogers, Douglas Ahlstrom, Paul Timothy

Space Dynamics Laboratory Publications

Agricultural operations produce a variety of particulates and gases that influence ambient air quality. Lidar (LIght Detection And Ranging) technology provides a means to derive quantitative information of particulate spatial distribution and optical/physical properties over remote distances. A three-wavelength scanning lidar system built at the Space Dynamic Laboratory (SDL) is used to extract optical parameters of particulate matter and to convert these optical properties to physical parameters of particles. This particulate emission includes background aerosols, emissions from the agricultural feeding operations, and fugitive dust from the road. Aerosol optical parameters are retrieved using the widely accepted solution proposed by Klett. …

Training Manual On International Environmental Law, Nicholas A. Robinson

Elisabeth Haub School of Law Faculty Publications

Without analyzing each of the hundreds of agreements and instruments in the field, this Training Manual seeks to provide a comprehensive overview of the current body of environmental law. It is aimed at legal stakeholders from all backgrounds including government representatives, judges, university professors and students from both developed and developing countries, to enable them to more effectively participate in the global, regional and national efforts to preserve our Earth for future generations. Points Of Control: Complexity And Crisis In Animated Architecture, Andrew J. Lynn Jan 2006

Points Of Control: Complexity And Crisis In Animated Architecture, Andrew J. Lynn

Architecture Senior Theses

"The 'traditional' use of computers in architectural design has focused on CAD as a productivity tool for design and construction drawings and 3D visualization as a method of presenting designs to clients and the public. In other words, the computer as a tool for creating representation. However, in the last decade, a movement has emerged that uses computation as a medium for design."

Trehalose Uptake Through P2x7 Purinergic Channels Provides Dehydration Protection., Gloria Elliott, Jennifer Cusick, Xiang-Hong Liu, Michael Menze, Trudy Witt, Steven Hand, Mehmet Toner

Faculty and Staff Scholarship

The tetra-anionic form of ATP (ATP4-) is known to induce monovalent and divalent ion fluxes in cells that express purinergic P2X7 receptors (Steinberg et al., 1987; Sung et al., 1985), and with sustained application of ATP it has been shown that dyes as large as 831 daltons can permeate the cell membrane (Steinberg et al, 1987). The current study explores the kinetics of loading α,α-trehalose (342 daltons) into ATP stimulated J774.A1 cells, which are known to express the purinergic P2X7 receptor (Steinberg et al., 1987). Cells that were incubated at 37 ̊C in a 50 mM phosphate buffer (pH 7.0) …

The Shi'ites, The West And The Future Of Democracy: Reframing Political Change In A Religio-Secular World, John Rees Jan 2006

The Shi'ites, The West And The Future Of Democracy: Reframing Political Change In A Religio-Secular World, John Rees

Arts Papers and Journal Articles

The present article critically reviews Paul McGeough’s important analysis of the most recent Iraq war within a broader consideration of secular-religious relations in international affairs. The thesis of Mission Impossible: The Sheikhs, the US and the Future of Iraq (2004) can be summarised around two ideas: that the US strategy in Iraq was flawed because it wilfully bypassed the traditional power structures of Iraqi society; and that these structures, formed around the tribe and the mosque, are anti-democratic thus rendering attempts at democratisation impossible. The article affirms McGeough’s argument concerning the inadequacy of the US strategy, but critically examines the …

Counseling Patients Exposed To Ionizing Radiation During Pregnancy, Robert L. Brent Jan 2006

Counseling Patients Exposed To Ionizing Radiation During Pregnancy, Robert L. Brent

The Selected Works of Robert Brent

Health physicists and knowledgeable clinicians have the responsibility to counsel women of reproductive age about the reproductive risks of ionizing radiation exposure before conception or during pregnancy. It is important to realize that lay individuals have many misconceptions about the reproductive risks of ionizing radiation. Many patients who have already had or will undergo some type of radiological test are apprehensive about the reproductive and developmental risks of diagnostic radiological procedures. Epidemiological studies and animal studies indicate that high exposures of ionizing radiation can cause miscarriage, congenital malformations, growth retardation, stillbirth, and cancer. With the exception of cancer, there are …
