The Freedom To Manifest Religious Belief: An Analysis Of The Neccesity Clauses Of The Iccpr And The Echr, Todd Parker Mar 2006

The Freedom To Manifest Religious Belief: An Analysis Of The Neccesity Clauses Of The Iccpr And The Echr, Todd Parker

ExpressO

This paper examines Article 18 of the International Covenant on Civil and Political Rights and Article 9 of the European Convention on Human Rights. Both documents affirm freedom of religion as a fundamental human right, yet both recognize the need for restrictions on freedom of religion when “necessary.” The paper discusses the text of Articles 18 and 9, as well as European Court of Human Rights and Human Rights Committee cases interpreting and applying the Articles. The paper then analyzes several current laws restricting religious freedom on necessity grounds as to whether the restrictions are legitimate or illegitimate under the …

Global Pharmaceutical Patent Law In Developing Countries- Amending Trips To Promote Access For All, Angela J. Anderson Mar 2006

Global Pharmaceutical Patent Law In Developing Countries- Amending Trips To Promote Access For All, Angela J. Anderson

ExpressO

This comment will analyze the need to amend and revise the current global pharmaceutical patent system under TRIPS to take into account the needs of developing countries and overall public health. This comment will emphasize that the current international trade rules, which although administered by the WTO, are dictated by developed country governments and powerful pharmaceutical companies, and therefore, without reform will further diminish the access of poor people in developing countries to vital medicines. Part II of this comment will provide a general overview of the international trade law governing patents on pharmaceuticals focusing specifically on the development of …

The Action Bias In American Law: Internet Jurisdiction And The Triumph Of Zippo Dot Com, Richard Greenstein Mar 2006

The Action Bias In American Law: Internet Jurisdiction And The Triumph Of Zippo Dot Com, Richard Greenstein

ExpressO

American law reflects the stories we tell ourselves about who we are as a nation. To illustrate the effect of America’s stories on the law, I identify and describe in this essay a particular characteristic of American law: an “action bias” – a propensity to bestow disproportionately greater legal significance upon affirmative acts than on failures to act – and I argue that this bias reflects, in turn, a powerful myth at the core of the self-image of the United States, a myth I call the “Immigrant’s Tale.”

To illustrate this thesis, I give a number of instances of the …

A Decision Model For Choosing Among Photovoltaic Technologies To Generate Electricity At Grid-Connected Air Force Facilities: A Value-Focused Approach, Mostyn O. Kellner Mar 2006

A Decision Model For Choosing Among Photovoltaic Technologies To Generate Electricity At Grid-Connected Air Force Facilities: A Value-Focused Approach, Mostyn O. Kellner

Theses and Dissertations

The United States is currently consuming fossil fuels faster than natural processes can replace them. Our nation's leaders recognize that a diverse energy portfolio including renewable energy is the key to maintaining our economy, security, and the environment. The federal government is by far the greatest energy consumer; thus, our nation's leaders have directed federal agencies to strive to increase the use of renewable energy at federal facilities. Solar electricity technologies, in the form of photovoltaics, have great potential in the renewable energy mix. Although a major strategy should be integrating photovoltaics into the design of new facilities, an important …

Does Exposure Science Support The Concern Over Indoor Air Quality?, Kenneth Kasper Mar 2006

Does Exposure Science Support The Concern Over Indoor Air Quality?, Kenneth Kasper

Theses

The purpose of this thesis is to examine the growing concern over indoor air quality (IAQ) and determine if such concern is warranted. The first questions that steer this effort include: Does scientific research substantiate a causal link between IAQ contaminants and human health? In addition, which indoor air contaminants appear to present the greatest health risks? These questions were answered primarily by reviewing exposure science based criteria that have been developed by federal and state agencies and then comparing these criteria to nominal concentrations that have been measured in the workplace. The second purpose of this thesis was to …

Red-Winged Blackbird (Agelaius Phoeniceus) Reproduction In North Dakota, Rachel M. Bush, Mark E. Clark, Wendy L. Reed, George M. Linz Mar 2006

Red-Winged Blackbird (Agelaius Phoeniceus) Reproduction In North Dakota, Rachel M. Bush, Mark E. Clark, Wendy L. Reed, George M. Linz

United States Department of Agriculture Wildlife Services: Staff Publications

Many of the suggested management techniques directed at reducing blackbird breeding populations fail to incorporate the underlying mechanisms regulating populations. Theoretically, removal of individuals from the breeding population should lower the breeding densities and presumably reduce recruitment. However, compensatory responses might occur with decreased breeding densities, but no empirical data are available to test this hypothesis. Much of the underlying compensatory theory is based on differential allocation of resources to reproduction vs. self maintenance at different breeding densities, mainly in the form of depensatory effects of resource limitation on growth and survival. However, as the breeding density in an area …

The Children Of Science: Property, People, Or Something In Between?, Star Q. Lopez Mar 2006

The Children Of Science: Property, People, Or Something In Between?, Star Q. Lopez

ExpressO

How should states classify embryos? The war has often waged between two classifications, people versus property. But what if a state assumed something in between, finding the embryo to be a potential person entitled to special respect? If a state adopted this position, how would the law affect medical research?

Presuming embryos constitute potential persons, the debate would continue with how to define “special respect.” The status of a potential person runs along a spectrum between property and personhood. How one defines “special respect” determines where the potential person falls along this spectrum. Special respect would create a spectrum of …

The Promise (And Limits) Of Neuroeconomics, Jedediah S. Purdy Mar 2006

The Promise (And Limits) Of Neuroeconomics, Jedediah S. Purdy

ExpressO

Neuroeconomics – the study of brain activity in people engaged in tasks of reasoning and choice – looks set to be the next behavioral economics: a set of findings about how people make decisions that casts doubt on widely accepted premises about rationality and social life. This essay explains what is most exciting about the new field and lays out some specific research tasks for it.

By enabling researchers to view the mind at work, neuroeconomics puts in question the most basic premise of twentieth-century empiricism, sometimes called positivism or behaviorism: that people are black boxes to one another, and …

Property And Empire: The Law Of Imperialism In Johnson V. M'Intosh, Jedediah S. Purdy Mar 2006

Property And Empire: The Law Of Imperialism In Johnson V. M'Intosh, Jedediah S. Purdy

ExpressO

Justice Marshall’s opinion in Johnson v. M’Intosh has long been a puzzle in both its doctrinal structure and in Marshall’s manifest ambivalence and long, strange dicta that are both triumphal and elegiac. In this article, I show that the opinion becomes newly intelligible when read in the context of the law and theory of colonialism, concerned, which, like the case itself, was concerned with the expropriation of continents and relations between dominant and subject peoples.

I examine several instances where the seeming incoherence of the opinion instead shows its debt imperial jurisprudence, which rested on a distinction between two bodies …

The Ends And Means Of Public Art Making: A Case Study Of "Public Art" And "Art In Public" In The Portland, Oregon Metropolitan Region, Svetlana Gennadyevna Karasyova Mar 2006

The Ends And Means Of Public Art Making: A Case Study Of "Public Art" And "Art In Public" In The Portland, Oregon Metropolitan Region, Svetlana Gennadyevna Karasyova

Dissertations and Theses

The subject of public art has been prolifically but narrowly discussed in conjunction with controversies over particular public artworks. To investigate more broadly the complex aesthetic, institutional, social and political dimensions of public art, I examine a pluralistic landscape comprising nine arts organizations in the Portland, Oregon metropolitan region. A neo-Marxist framework defined by David Harvey organizes the case findings into four topics: material practices or public art outcomes; beliefs, values and desires; institutions and their rituals; and power and social relations.

I capture the differences among the arts organizations by portraying them as metaphorically inhabiting unique spaces in the …

Mining The Common Heritage Of Our Dna: Lessons Learned From Grotius And Pardo, Jasper A. Bovenberg Mar 2006

Mining The Common Heritage Of Our Dna: Lessons Learned From Grotius And Pardo, Jasper A. Bovenberg

Duke Law & Technology Review

The Human Genome Project generated oceans of DNA sequence data and spurred a multinational race to grab the bounties of these oceans. In response to these DNA property grabs, UNESCO, drawing upon international law precedents addressing analogous grabs in the past, declared the Human Genome the heritage of humanity. The UNESCO Declaration provided, first, that the heritage shall not, in its natural state, give rise to financial gains and, second, that countries establish an international framework to make the benefits from genome research available to all. This iBrief will first examine Grotius’s Mare Liberum to determine whether international law precedent …
