What Was Taney Thinking? American Indian Citizenship In The Era Of Dred Scott, Frederick E. Hoxie

Chicago-Kent Law Review

Historians have often noted that Chief Justice Taney's decision in Dred Scott juxtaposed a denial of African American rights to citizenship with an assertion that Native Americans could obtain that status. Explaining this apparently inconsistent description of two racial minority groups requires an examination of the history of Native American classification in the law prior to 1857. This article argues that political leaders and judges of Taney's generation were committed to the removal of Indian tribes from eastern states and commonly proposed this removal as a choice between migrating west or dissolving tribal governments in order to remain in the …

Sleep is a vital, highly organized process regulated by complex systems of neuronal networks and neurotransmitters. Sleep plays an important role in the regulation of central nervous system and body physiologic functions. Sleep architecture changes with age and is easily susceptible to external and internal disruption. Reduction or disruption of sleep can affect numerous functions varying from thermoregulation to learning and memory during the waking state.

Comparative Perspectives On The Functions Of Sleep, John A. Lesku

All-Inclusive List of Electronic Theses and Dissertations

Previous comparative studies of sleep identified relationships between sleep and constitutive and ecological variables. Results from these studies helped shape early hypotheses for the function of sleep; however, all were conducted without an explicit phylogenetic or theoretic framework and focused exclusively on mammals. Hence, the validity of their results and applicability to other taxa is unclear. We ( 1) reviewed the literature on sleep in animals, (2) updated and reanalyzed the mammalian dataset using independent contrasts and (3) multivariate path analysis, and ( 4) presented the first quantitative analysis of sleep in a non-mammalian taxon: birds. Remote sensing, i.e. the technology that allows measuring object's properties from a distance, is currently undergoing tremendous advances in both precision and areas of applicability. Our study provides an overview of the recent developments in RS applications and their implications to the society. This was approached from three distinct directions, all with significant influence on the human's perception of the technology. Public Law and Legal Theory Working Papers

In constitutional law, first-order perfectionism represents an effort to cast the Constitution’s ideals in the best constructive light. Ronald Dworkin’s conception of law as “integrity” can be seen as a form of firstorder perfectionism. By contrast, second-order perfectionism attempts to set out an account of constitutional adjudication that is sensitive to the fallibility of federal judges. Originalism is best defended as a form of second-order perfectionism; the same can be said of Thayerism, captured in the view that judges should uphold statutes unless they are unquestionably violative of the Constitution. Minimalism, which calls for narrow, incompletely theorized judgments, is another …

The FDA estimates that 35% of Americans regularly consume aspartame, an artificial sweetener used in diet drinks and other sugar-free food items. Some anecdotal reports indicate the substance has been associated with health, behavioral, and cognitive concerns. The FDA and other regulatory agencies indicate it is safe for use up to 50mg/kg/day. They further advise individuals with metabolic phenylalanine disorders not to consume this product. This conflicting advice has caused confusion for consumers and practioners. Therefore, the purpose of this study was to examine the effects of aspartame consumption on cognitive functioning of healthy adults.

The Experience Of Transition By Baccalaureate Nursing Graduates, Linda R. Pettersen

The purpose of this phenomenological study was to investigate the transition experience of new baccalaureate-prepared graduates entering nursing practice as registered nurses. Participants were a convenience sample of six graduates from a midwestem university who were employed as registered nurses from eight to twelve months in acute care nursing practice. Transition theory was used as a guide in designing interview questions. Participants were interviewed and the audio-recorded interviews were transcribed and then analyzed for codes, categories, and themes.

Four themes emerged from analysis of the data. Theme One: Lack of experience contributes to self-doubt for the new graduate nurse. Although …

This paper is based on the results of an ethno botanical research project conducted in Ayubia National Park. The people of the park have always used the medicinal herbs for various ailments and are dependent on the plants in their surroundings for food, shelter, health, medicines, fodder and various cultural purposes. A total of 21 important herbs belonging to 19 Families were recorded which were used medicinally by the local inhabitants. About 100 informants were interviewed in this regard. Extracts of Sida cordifolia standardized to ephedrine are available in the Indian as well as international market. In western world ephedrine once upon a time was widely used for weight loss but recently it has been banned due to reported hepatotoxicity (injurious to the liver). Qualified neurologists and movement disorders specialists make a diagnosis on the basis of their knowledgeable observations. If a cause is found, a cure will follow. The Savannah Parkinson Support Group has existed for fifteen years. It has a membership of 250 people with Parkinson's Disease, their relatives and caregivers. The expression of race and racism in material culture is of increasing interest in historical archaeology ( e.g., Epperson 1990, 1999, 2000; Mullins 1996, 1999). This study investigates 6 ceramic sherds from one vessel associated with a white urban domestic site on First Street, in Holetown Barbados. This vessel conveys a racist message. A black slave in a loincloth serving tea to a white person is transfer printed on the ceramic. The ceramic seems to be an annular designed pearlware from England in the first half of the 19th century.

Permanent removal of the olfactory organ in adult zebrafish has been shown to result in a significant reduction in the total volume of the ipsilateral olfactory bulb. The overall objective of the current project was to investigate the hypothesis that contact between the axons of the olfactory sensory neurons and the olfactory bulb is necessary for the maintenance of the normal post-synaptic organization of the olfactory bulb by quantifying the morphological changes that take place within specific laminae of the olfactory bulb following peripheral deafferentation. Modulation Of Gene Expression And Dna Adduct Formation By Chlorophyllin In Human Mammary Cells Exposed To Benzopyrenes, Kaarthik John

This study investigated metabolic activation by benzopyrenes (BP and B[e]P) in human mammary cells and modulation by chlorophyllin (CHL, a chemopreventive agent). Among 6 NHMEC strains monitored using microarrays, 54 genes were up-regulated and 11 down-regulated by signal log ratio (SLR) ≥ 1.5 on treatment with BP alone. Pre CHL + post BP+CHL treatment up-regulated the expression of 129 genes and down-regulated those of 35 genes by SLR ≥ 1.5. Studies on CYP1 gene induction and BP-DNA adduct formation among 20 NHMECs revealed wide inter-individual variations both in the induction (3-96-fold for CYP1A1 and 4-43-fold for CYP1B1, respectively) and modulation …
