This essay considers the current debate in legal theory over the future of marriage. Should the state, as some scholars argue, privilege marriage because of the benefits it provides to society? Or should it, as others argue, distance itself from relationships between adults on the ground that adults should be left to order their own affairs? The essay argues that scholars involved in this debate have reached such diametrically different conclusions from one another because each side has focused on a particular, narrow range of goods at issue in these relationships. Light From The Trees: The Story Of Minors Oposa And The Russian Forest Cases , Oliver Austin Houck

This article describes two lawsuits in the late twentieth century that changed their countries in ways from which there will be no return. One took place in the Philippines, emerging from the reign of Fernando Marcos, and the other in Russia, following a near century of communist rule. They have two things in common. They declared the rights of their citizens to challenge, and reverse, government decisions. And they were about the environment, more particularly, trees. The purpose of this article is to understand how the public domain has been construed by the Courts. In the first part of the article, the different ways the public domain has been qualified and construed by scholars are briefly sketched out- for descriptive and introductory purposes to the analyzed cases law. On The Legal Consequence Of Sauces: Should Thomas Keller's Recipes Be Per Se Copyrightable, Christopher J. Buccafusco

This article is devoted to copyright protection for one of the restaurant industry’s most valuable assets – original recipes. The two most recent appellate courts to consider the issue have been hostile to the notion that recipes are copyrightable, but given the enormous amount of money at stake, litigation in this area is likely about to expand. The article begins by critiquing the courts’ conclusions. Following an analogy to musical composition, I argue that recipes are simply the means of fixation for culinary works of authorship, i.e, dishes. Crisis Bureaucracy: Homeland Security And The Political Design Of Legal Mandates, Mariano-Florentino Cuellar

Policymakers fight over bureaucratic structure because it helps shape the legal interpretations and regulatory decisions of agencies through which modern governments operate. In this article, we update positive political theories of bureaucratic structure to encompass two new issues with important implications for lawyers and political scientists: the implications of legislative responses to a crisis, and the uncertainty surrounding major bureaucratic reorganizations. The resulting perspective affords a better understanding of how agencies interpret their legal mandates and deploy their administrative discretion. Jumlah kasus flu burung pada manusia meningkat sangat pesat. Studi ini bertujuan untuk mengetahui gambaran epidemiologi penyakit flu burung (Avian Influenza/AI) pada kejadian luar biasa di 5 provinsi Indonesia in 2005-2006. Studi ini mengunakan sumber data sekunder data surveilens, sub direktorat Surveilens, Depkes RI, pada periode Juli 2005-2006. Dari 28 kasus konfirmasi ditemukan banyak pada pria (57.1%). Sekitar 89.3% kasus memperlihatkan gejala demam tinggi (>38°C), batuk dan masalah pernapasan dan sekitar 80% diantaranya meninggal dunia. Gejala tersebut mengindikasikan kerusakan jaringan paru-paru pada tubuh penderita. Berdasarkan laporan hasil pemeriksaan laboratorium, terlihat bahwa 60.7% penderita mengalami penurunan kadar leukosit (leucopenia) dan …

Background

Many genes produce multiple transcripts due to alternative splicing or utilization of alternative transcription initiation/termination sites. This 'transcriptome expansion' is thought to increase phenotypic complexity by allowing a single locus to produce several functionally distinct proteins. However, sex, genetic and developmental variation in the representation of alternative transcripts has never been examined systematically. Here, we describe a genome-wide analysis of sex-specific expression of alternative transcripts in Drosophila melanogaster.

Wolves (Canis lupus) have expanded their distribution into areas of the midwest United States that have not had wolves for several decades. With recolonization of wolves into agricultural areas, there is increasing concern of wolf–livestock conflicts. To assess the risk wolves may pose to livestock, we initiated a 3-year study investigating the activity patterns, movements, habitat use, visitation to livestock pastures by wolves, and the occurrence of depredation events in an agricultural–wildland matrix in northwestern Minnesota, USA. From June 1997 to November 1999, we captured 23 wolves, including pups, from 3 packs; we radio-collared 16 of these wolves. …

I am an artist, and I use cartoons. My work consists mainly of images that communicate to the viewer through recognizable forms. I also use text to help tell my stories. I often create visual elements that function in place of text or information. I use a third visual tool, a hybrid descendant of images and words: the cartoon. Cartoons, once situated at the margins of visual discourse, now have a place in the fine art world. There are comics and animated television shows created for adult audiences. Public places are becoming highly networked environments. Municipalities are draping wireless clouds and meshes over vast public spaces, facilitating always-on internet connectivity. Surveillance cameras are now a pervasive presence in many public places. The people who gather in public and use public spaces are wearing and carrying ever more sophisticated computing devices. An integrated grid of networked connectivity is being built into traditional bricks-and-mortar public places. Broadening The Scope Of Electronic Reproductions: The Interpretation Of Section 201(C) In Faulkner V. National Geographic Enterprises Inc., Shan Sivalingam

This Article analyzes the implications of the recent decision of the United States Court of Appeals for the Second Circuit in Faulkner v. National Geographic Enterprises Inc. The court interpreted § 201(c) of the federal Copyright Act to permit National Geographic to compile print issues of its magazine into a CD-ROM digital archive without explicit permission from freelance authors who contributed to the print issues. The court’s decision has raised concern among freelance journalists and photographers who contribute works to newspapers and other periodicals that compile copyrighted works. Background: Cartilage disorders affect millions of people in the United States alone, with effects ranging from poor skeletal development and joint pain to shortened lifespan and perinatal lethality. Many of these disorders have their root in defects of collagen, type XI collagen being among the most important. A mouse model of such a type XI collagen defect is the chondrodysplasia (cho) mutant. Mice homozygous for this null mutation in the Col11a1 gene do not express the α1 chain of type XI collagen. This results in a functional knockout of type XI collagen, leading to insufficient skeletal development and perinatal lethality. …
