Legal Pluralism And Human Agency, Jeremy Webber Jan 2006

Legal Pluralism And Human Agency, Jeremy Webber

Osgoode Hall Law Journal

Much legal-pluralist scholarship tends to naturalize "the law of the context," treating that law as though it were inherent in social interaction, emerging spontaneously, without conscious human decision. This view overstates the role of agreement in human societies and mischaracterizes the nature of law, including non-state law. All law is concerned with establishing a collective set of norms against a backdrop of normative disagreement, not agreement. It necessarily contains mechanisms for bringing contention to a provisional close, imposing a collective solution. This article presents a theory of legal pluralism that takes human disagreement seriously. The theory retains four themes crucial …

The Effect Of Cold-Acclimation On The Water Relations And Freezing Tolerance Of Hordeum Vulgare L, S Burchett, S Niven, Mp Fuller Jan 2006

The Effect Of Cold-Acclimation On The Water Relations And Freezing Tolerance Of Hordeum Vulgare L, S Burchett, S Niven, Mp Fuller

School of Biological and Marine Sciences

During a 5 degree C and a 5/-1 degree C cold acclimation (CA) regime there was a significant decline in the water potential of winter barley, and a concurrent decline in tissue water content of the 5/-1 degree C CA plants. Results of carbohydrate analysis illustrated a significant (P < 0.001) accumulation of sucrose, fructose and glucose in the 5/-1 degree C CA plants, which was inversely correlated to water potential. Using an infrared imaging radiometer during a convection frost test the water release time (WRT) of 5/-1 degree C CA was demonstrated to be significantly (P < 0.001) longer than that observed in non-cold acclimated plants. This observation is consistent with visual analysis of exotherm curves where the rate of cellular water release to extracellular ice is reduced in the 5/-1 degree C CA plants, compared to the non-cold acclimated plants. These biochemical and physiological changes were correlated to increased plant health following a non-lethal freezing test to -5 degree C, where non-cold acclimated plants produced 2.3 +/- 0.3 tillers and 5 degree C and 5/-1 degree C CA plants produced 2.4 +/- 0.3 and 4.7 +/- 0.7 tillers, respectively. Results from this study imply that cold acclimation leads to changes in the physical state of water that result in a less osmotically responsive cellular environment and subsequently significantly less damage to meristematic tissue.

Durum Wheat Quality I: Some Physical And Chemical Characteristics Of Syrian Durum Wheat Genotypes, Gh El-Khayat, A Samaan, Fa Manthey, Mp Fuller, Cs Brennan

School of Biological and Marine Sciences

Some physical and chemical characteristics of nine Syrian durum wheat genotypes were determined in order to investigate the relationships among individual kernel components and kernel quality. All genotypes were grown on fully irrigated plots in Syria. Test weight, 1000-kernel weight, kernel size distribution, hardness and semolina extraction rates were determined along with the chemical characteristics of the kernel (ash, moisture, protein, wet gluten, starch content and falling number). All tested genotypes had high test weight (83.1–85.9 kg hl−1) and 1000-kernel weight (42.5–55.5 g) indicating high milling yield potential. Additionally, all the wheat genotypes demonstrated high falling numbers (433–597 s). Correlation …

A Case Study Investigation Of The Development And Treatment Of Alter Personalities In Dissociative Identity Disorder, Ian Brown Jan 2006

A Case Study Investigation Of The Development And Treatment Of Alter Personalities In Dissociative Identity Disorder, Ian Brown

Theses: Doctorates and Masters

Progress in the study and treatment of Dissociative Identity Disorder (DID) has been hampered by ideological debate regarding its validity. This is particularly the case when patient's suffering from DID also report ritualistic abuse. Part of the difficulty has been that past studies have not established independent checks to assess whether alters are artefacts introduced by therapeutic bias. This study addressed this issue by using independent judges to test the validity of a patient being treated for DID who claimed ritualistic abuse. The judges were 16 clinicians with an average of 21 years experience in their respective disciplines. The study …

Dialectics Of The Banana Skirt: The Ambiguities Of Josephine Baker's Self-Representation, A Syska Jan 2006

Dialectics Of The Banana Skirt: The Ambiguities Of Josephine Baker's Self-Representation, A Syska

School of Law, Humanities and Social Sciences

The archive of Josephine Baker’s images is staggering. Hundreds of her photographs—dancing or frozen as in a reverie, with melancholic or comically crossed eyes, naked or glamorously clad—illustrate numerous books and writings, which portray, and attempt to explain, the celebrated African American expatriate in Paris. These photographs, paintings, and memorabilia are stored in museums and private collections; they are read and reread by performance and film scholars and those who are simply fascinated or intrigued by her countless personae. Multiple binaries have been used to explain her, but I argue that Baker invites us to see her as positioned within …

Distributional Ecology Of Fish In The Kanawha River, West Virginia., Kimberly Ann Bjorgo Jan 2006

Distributional Ecology Of Fish In The Kanawha River, West Virginia., Kimberly Ann Bjorgo

Graduate Theses, Dissertations, and Problem Reports (ETD)

Large rivers are multidimensional systems where ecological processes occur at a variety of spatial and temporal scales. This investigation addresses the relationship between fish distribution and habitat use within the Marmet Pool of the Kanawha River, West Virginia. Fish habitat use, movement patterns, distribution, and density data were obtained concurrently with abiotic data such as river discharge, temperature, depth, and sediment composition to provide essential dimensions to the assumption that habitat dictates location of organisms. Radio telemetry was used to examine movement, habitat use, and associations between large river fish species. These data were also used to make inferences about …

Spiritual Capital, Danah Zohar Jan 2006

Spiritual Capital, Danah Zohar

International Journal of Servant-Leadership

Good morning, everybody. I'm as happy as you are to be at this conference again. I think it's my favorite conference. My second favorite is the conference that Peter Senge runs, every November or December, the Soul Conference or the Systems Theory Conference. What's nice about both of these conferences is that they are more than conferences, they've built a community around them and you see old friends and there's a great spirit of community at the conferences, and that makes them both very special. And the theme of servant-leadership brings out the nicest people. I'm going to talk this …

Mass Spectrometric Investigation Of Metallothionein And Ionic Liquids Using Electrospray Ion Source Coupled With Quadrupole Ion Trap Mass Analyzer, Yuchen Lu Jan 2006

Mass Spectrometric Investigation Of Metallothionein And Ionic Liquids Using Electrospray Ion Source Coupled With Quadrupole Ion Trap Mass Analyzer, Yuchen Lu

Graduate Theses, Dissertations, and Problem Reports (ETD)

Electrospray is a well-developed ionization technique for transferring intact dissolved molecules from liquid into the gas-phase through a capillary emitter. As a 'soft' ionization method, intact molecules are transformed and are ready for mass identification and structure characterization. Quadrupole ion traps are versatile mass analyzers and are well-known for the capability to perform tandem mass scans by which the structural information can be obtained.;Collision-induced dissociation (CID) is applicable used in quadrupole ion trap to produce fragment ions. Metal-protein bond dissociation properties were studied by the tandem mass spectrometry. Binding properties of metal ions and ligand groups on peptide chains were …

Fmri Studies Of Binocular Suppression In Human Amblyopic Subjects, Yuenan Sun Pitrolo Jan 2006

Fmri Studies Of Binocular Suppression In Human Amblyopic Subjects, Yuenan Sun Pitrolo

Graduate Theses, Dissertations, and Problem Reports (ETD)

Binocular suppression has been previously studied psychophysically and with VEPs. Here we used functional magnetic resonance imaging (fMRI) to image activity in visual cortex while human subjects with normal vision or amblyopia experienced binocular integration. One eye viewed a dynamic grating pattern. The other eye viewed one of four stimuli, i.e., black mask, gray mask, or two grating masks that varied in contrast. We observed a luminance masking effect, that is, when the gray mask is compared to the black mask, there was less activation in many retinotopic areas (consistent with previous VEP studies). The result was observed in all …

All Faculty Scholarship

We assessed the digestibility and utilization of ice algae and phytoplankton by the shallow, subtidal benthos in Ny Ålesund (Kongsfjord) on Svalbard (79°N, 12°E) using chlorophyll a (chl a), essential fatty acids (EFAs) and stable isotopes as tracers of food consumption and assimilation. Intact benthic communities in sediment cores and individuals of dominant benthic taxa were given ice algae, phytoplankton, 13C-enriched ice algae or a no food addition control for 19 to 32 d. Ice algae and phytoplankton had significantly different isotopic signatures and relative concentrations of fatty acids. In the food addition cores, sediment concentrations of chl a …

These experiments are part of a larger study designed to investigate the influence of husbandry parameters on the life history of the apple snail, Marisa cornuarietis. The overall objective of the program is to identify suitable husbandry conditions for maintaining multigeneration populations of this species in the laboratory for use in ecotoxicological testing. In this article, we focus on the effects of photoperiod, temperature, and population density on adult fecundity and juvenile growth. Increasing photoperiod from 12 to 16 h of light per day had no effect on adult fecundity or egg hatching and relatively minor effects on juvenile growth …

Gesture, Pulsion, Grain: Barthes' Musical Semiology, Michael Szekely Jan 2006

Gesture, Pulsion, Grain: Barthes' Musical Semiology, Michael Szekely

Contemporary Aesthetics (Journal Archive)

Although Barthes is perhaps best known as a semiotician, he is paradoxically always in search of precisely that which defies the constraints of language, whether art, signs or, in fact, language itself. Enter the relevance of music for Barthesian aesthetics. Barthes called for a "second semiology," in contrast to the classical semiology, which would explore "the body in a state of music." In this essay, I explore Barthes' musical semiology in terms of key concepts, including gesture, pulsion, grain, and jouissance. I extend the relevancy of Barthes' concepts, often articulated within the context of the Western classical musical tradition, to …

Fact And Fiction: Writing The Difference Between Suicide And Death, John Carvalho Jan 2006

Fact And Fiction: Writing The Difference Between Suicide And Death, John Carvalho

Contemporary Aesthetics (Journal Archive)

Did Michel Foucault die of AIDS or did he kill himself? Did he knowingly infect others in the bath houses in San Francisco or was he unaware that he was ill and of how less-than-safe sex could spread the same virus that infected him? What did he know about AIDS/HIV and what do we know about what he knew? Answers to these questions are ambiguous. This is due, in part, to the culture of homosexuality and the cultural response to AIDS/HIV at the time. It is also due to the conflicting reports about what Foucault knew, and when, in the …

Reflections On An Aesthetics Of Touch, Smell And Taste, Mădălina Diaconu Jan 2006

Reflections On An Aesthetics Of Touch, Smell And Taste, Mădălina Diaconu

Contemporary Aesthetics (Journal Archive)

Modern aesthetics regards sight and hearing as the only senses which were able to produce art. Touch, smell and taste might offer pleasant stimuli, but can never achieve the status of art objects. What are the arguments for this rejection, and are they still sustainable? This paper focuses on the general and specific difficulties of forming an aesthetics of touch, smell and taste; some can be overcome, while others are still waiting for a proper answer. At the same time, artistic movements, as well as changes in recent discussions of the aesthetics of everyday life prove the necessity of extending …

The Color Of The Sublime Is White, Jeffrey Downard Jan 2006

The Color Of The Sublime Is White, Jeffrey Downard

Contemporary Aesthetics (Journal Archive)

In this paper, I examine Melville's discussion in Moby Dick of the whiteness of the whale from the perspective of a Kantian account of the sublime. My aim, in the first instance, is to see if the comparison helps to shed light on Melville's puzzling discussion of the color white and why this color serves to heighten the feeling of being overwhelmed by terror when confronted with something extremely large or powerful. In turn, I intend to use Melville's discussion of whiteness to put pressure on some of the philosophical assumptions behind a Kantian analysis of the sublime. In particular, …

Jules Verne's Very Far West: America As Testing Ground In Les 500 Millions De La Bégum, Peter Schulman

World Languages and Cultures Faculty Publications

[First Paragraph] In his famous interview with the American journalist Robert H. Sherard in 1894, Jules Verne, nearing the end of his life, regretted not being able to see America one last time. "I should have liked to have gone to Chicago this year," he lamented, "but in the state of my health [...] it was quite impossible. I do so love America and the American," he continued, "As you are writing for America, be sure to tell them that if they love me- as I know they do, for I receive thousands of letters every year from the States- …

Humans infected with West Nile virus (WNV) may clinically present with symptoms that are suggestive of neurological infection. Nearly all treatments of WNV disease have been effective in animal models only if administered before or soon after viral challenge. Here, we evaluated whether a potent neutralizing anti-WNV humanized monoclonal antibody (MAb), hE16, could improve the course of disease in a hamster model when administered after the virus had infected neurons in the brain. Five days after viral injection, WNV was detected in the brains of hamsters by cytopathic assay, quantitative reverse-transcription polymerase chain reaction, and immunohistochemical staining of WNV envelope …

Deconstructing Hate Speech In The Drc: A Psychological Media Sensitization Campaign, Johann Vollhardt, Marie Coutin, Ervin Staub, George Weiss, Johan Deflander

Journal of Hate Studies

This article describes an interdisciplinary and theory-based radio campaign that has been developed to counteract, and sensitize citizens to hate speech in the Democratic Republic of the Congo (DRC). The article provides a brief overview of the instrumentalization of hate speech and the violent effects it has had in the Great Lakes region of Africa. A summary of the most recent events in the DRC is given. Here, hate speech was used in the presidential election campaigns in 2006, contributing to a polarization of the country and giving the campaign an ethnic underpinning. A radio program developed to counteract hate …

The Politics Of Hate: Ultranationalist And Fundamentalist Tactics And Goals, Joan Davison Jan 2006

The Politics Of Hate: Ultranationalist And Fundamentalist Tactics And Goals, Joan Davison

Journal of Hate Studies

Ultranationalist and religious fundamentalist movements frequently use hate to mobilize people. These groups possess a sophisticated understanding of the importance of appealing to the emotions. Leaders often employ xenophobic language intended to inspire fear and justify a defensive reaction. The movements also rely heavily upon symbols, myths, and public events to simplify and communicate the “truths” of their ideologies. The leaders convey messages with tremendous affective appeal. Yet, measures exist to counter and contain the politics of hate. The development of civil society, group rights, a free media, and integrated institutions can contribute to a durable solution in cases of …
