The Market Participant Doctrine And The Clear Statement Rule, David S. Bogen

Seattle University Law Review

When the state acts as a market regulator, the dormant Commerce Clause invalidates discriminatory regulation without the need for an order against the state. The courts simply refuse to enforce the state law on the ground that it is unconstitutional. When the state acts as a market participant, however, the court would have to direct its order against the state or its officials to negate the discrimination. This produces a direct confrontation with the state, the same kind of confrontation the clear statement rule was designed to avoid. Harry Potter, Ruby Slippers And Merlin: Telling The Client's Story Using The Characters And Paradigm Of The Archetypal Hero's Journey, Ruth Anne Robbins

Seattle University Law Review

This Article focuses on the relationship of mythology and folklore heroes to everyday lawyering decisions regarding case theory when the audience is a judge or panel of judges rather than a jury. This Article adds to the discourse by beginning a conversation about what might be termed “applied legal storytelling.” The term pertains to ideas of how everyday lawyers can utilize elements of mythology as a persuasive technique in stories told directly to judges--either via bench trials or via legal writing documents such as briefs--on behalf of an individual client in everyday litigation. Biotechnology Education In The State Of Iowa: A Survey Of Teachers And Factors Affecting Inclusion, Jason Allen Lang

This research studied biology, agricultural education, and family and consumer science teachers in Iowa regarding the topic of biotechnology in their classrooms. The survey study involved collecting demographic information about respondents, which could then be used to characterize those who teach biotechnology and those who do not. The survey also asked about perceived barriers to teaching biotechnology. As the first large scale sampling of Iowa teachers (1477), the survey attempted to provide a picture of biotechnology education in the state. Demographic data showed an aging teaching population, a teaching load of some teachers, especially those in FCS and Ag Ed, …

In 1920 there were approximately 6.5 million farms in the United States. 30.1 percent of United States population lived on farms. In 1992 those numbers were down to 2 million farms and less than 2 percent of the population living on farms [Allen and Lueck, 1998, 344].

The farming industry of today bears little resemblance to that of yesterday. Corporate farming has challenged the age-old structure of farming. Proponents of corporate farming say that it is more efficient than family farming and leads to more affordable food supplies. For decades, legal scholars have debated the proper balance of parents' rights and children's rights in the child welfare system. This Article argues that the debate mistakenly privileges rights. Neither parents' rights nor children's rights serve families well because, as implemented, a solely rights-based model of child welfare does not protect the interests of parents or children. Additionally, even if well-implemented, the model still would not serve parents or children because it obscures the important role of poverty in child abuse and neglect and fosters conflict, rather than collaboration, between the state and families. The primary purpose of this study was to examine the relationship between physical fitness measures, selected psychosocial correlates of physical activity, and self-reported physical activity among seventh and eighth-grade students in rural Iowa. Computerized physical fitness measures were obtained by the HealthFirst Trifit™ computer system, attitudes about physical activity were measured by the Correlates of Physical Activity in Children (CP AC) questionnaire, and physical activity levels were measured by the Physical Activity Questionnaire-Adolescents (PAQ-A). Concerns about the long term supply of petroleum, the instability of its prices, and growing environmental issues have led to a variety of legislative and public support for the use of agricultural commodities in industrial applications. Surrounding Embryos: Biology, Ideology And Politics, Janet L. Dolgin

This article considers several parameters of the late twentieth and early twenty-first-century debate in the U.S. about ethics, politics, science, and ideology (popularly referred to as the "culture wars"). The article focuses, in particular, on shifting understandings of the embryo. The article reviews developments in science (especially the advent of stem-cell research and cloning) that have affected understandings of embryo, the history of debate about abortion in the U.S., and the place of discourse about abortion in a more far-reaching social debate about family, personal relationships, and the scope of personhood in the U.S.
